About this file
This document is a set of Questions from Industry related to Solicitation Number 12805B24Q0356 for inspecting, repairing, and providing a plan for underground storage tank sump pumps at the National Bio & Agro-Defense Facility in Manhattan, KS.
The key details are:
- The solicitation requires vendors to provide a UEI number for any subcontractors. The government response indicates this is a self-reported item for awards over $500K, but it is unclear how this information is verified.
- The solicitation states that vendors can pay more than 50% of the contract price to a "similarly situated entity" subcontractor, which is defined as a small business under the same NAICS code.
- This is a firm-fixed-price contract set aside for 100% small business under NAICS code 541620, with a $19M size standard. The evaluation will use Lowest Price Technically Acceptable (LPTA) factors.
- Vendors must submit certification of being a licensed KDHE UST contractor and tester, as well as a statement acknowledging the limitations of subcontracting requirements, to be rated technically acceptable.
- Questions from industry were due by August 13, 2024, with responses posted on sam.gov. No site visit will be offered, but pictures of the site are available upon request.

Questions from Industry 12805B24Q0356 As of 8 August 2024
1. The solicitation stated that we need to observe FAR 52.204-14, of which paragraph (f) line (i) states:
"(i) Subcontract number [must be given] (including subcontractor name and unique entity identifier);"
Does this mean that our subcontractor must have a UEI?
Govt Response: This is a self-reported item you are required to do in sam.gov for awards over $500K, which our estimate is. I am unaware of how this is reviewed at the agency level to verify the information was submitted in sam.gov.
2. The solicitation also states that we need to observe FAR 52.219-14, of which paragraph (e) line (1) states:
"Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities" Doesn't this mean that we can pay more than 50% to a subcontractor who is a similarly situated entity (meaning they have the same set-aside and size standards as we in regards to this NAICS code)?
Govt Response: Yes. You may exceed 50% of the contract price to a similarly situated entity. Those entities are defined in paragraph b of that clause, so they would be required to be a small business AND be considered a small business under NAICS 541620.
