Industry Questions and Answers # 1:
1. Attachment 2: What is meant by the new construction or repair work? Do you mean if we cut a side walk or parking lot, we have to ensure the point of cutting is stable and will remain stable? Or are you indicating we will demo half a building and the other half will remain in use?
1.1 DESCRIPTION OF WORK: This project consists of furnishing all plant, labor, equipment, materials, and transportation and performing all work required for the accomplishment of Demolition and Abatement work as required in this agreement.
Work will be issued per individual Task Order (TO) using a Statement of Work (SOW) or Performance Work Statement (PWS). In addition to demolition and abatement, work includes possible backfilling foundation areas with suitable fill, grading and seeding, and possible ancillary new construction or repair work as may be required per Task Order (TO) Statement of Work (SOW) / Performance Work Statement
(PWS).
If the demolition destroys part of building, structure, or end item it may be required to construct or repair certain ancillary items to ensure safety, etc. The primary purpose of this IDIQ is demolition, but repairs may be necessitated as part of the demolition. Such as in the example above if you cut a sidewalk or parking lot, the new construction or repair may possibly include cutting for stability or installing a new curb, etc.
2. Attachment 2: Why is the section sighted below included in the Solicitation? Is the Government/ARS suggesting we need an engineer and or Architect on every project?
And why do they need to derive a majority of their income from reroofing design work?
The work relates to Demo and Abatement. There may be times it is necessary but isn’t that up to the contractor.
1.1.4.1 General: Contractor must provide a Professional Engineer or Registered Architect, registered in the State where work is being performed who derives the majority of their income from roof de-sign work to perform and seal all required Design Analysis and Drawings.
Attachment 2 Scope of Work, Paragraph 1.1.4.1 has been revised.
4. Attachment 2: Why does the Superintendent need to be on a roof when it is being demoed. This is a safety concern? If abatement work is being executed it seems reasonable but if demoing this very dangerous. Please clarify?
1.1.5 Quality Control:
1.1.5.1 Foreman/Superintendent: Contractor shall employ a job foreman/Superintendent for each active TO. The Foreman/Superintendent is required on-site at all times when site work is being accomplished. When roof work is being accomplished, the Foreman/Superintendent must be on the roof 100% of the time.
Attachment 2 Scope of Work, Paragraph 1.1.5.1 has been revised.
5. Attachment 2: In the case where no drawings are available the contractor will make arrangements but the cost is the responsibility of the Government/ARS?
1.1.6.5 Pre-construction Drawings. Pre-construction drawings will not be provided for every project. Government-developed pre-construction drawings will be normally provided for those projects where drawings are necessary in order to clearly depict the scope of work. However, on a project-by-project basis, the contractor may be required to provide drawings/sketches to clearly present the contractor’s method of accomplishing the ordered SOW or PWS to the Contracting Officer (CO) in enough detail that satisfies the requirements of the government. In such instances, approval of the contractor’s draw-ings/sketches shall be required prior the contractor proceeding with the project. In addition, the contractor may be required to provide drawings sealed by a Professional Engineer registered in the State in which the work will occur on a project order basis.
Attachment 2 Scope of Work, Paragraph 1.1.6.5 have been revised.
6. This section appears to relate to design build and is specifically shown in attachment 7.
Why is this included in a Demo Solicitation?
1.6 ADDITIONAL APPLICABLE PUBLICATIONS: ARS P&P 242.1M and Specification 01 01 00 Gen-eral Conditions rev May 22,2019 listed below form a part of this section to the extent referenced. Publi-cation is referred to in the text by basic designation only. Publication shall be assumed to be the most current edition in effect at the time a contract is awarded.
ARS Policy and Procedure (P&P) ARS-242.1M, ARS Facilities Design Standards Specification 01 01 00 General Conditions rev May 22,2019
ARS P&P 242.1M and Specification 01 01 00 General Conditions rev May 22,2019 give guidelines as to how work at ARS should be performed. These documents were included as they may apply to some work performed by the contractor on certain task orders, such as Specification 01 01 00 1.6 Fire Safety and Specification 01 01 00 page 19
- Hot Work Permit. Documents may also apply to ancillary work, such as plumbing or electrical ancillary repairs.
7. Bonding question – in the pre-emptive response to questions the doc indicates that the Bonding is for the full 5-year IDIQ. Isn’t the Bonding based per task order? Bonding agents won’t bond multiple TOs over the 5-year period as one which is what it appears you are asking for in the response below. Do you want the contractor to have a $3,000,000 bonding limit per project?
Performance and Payment bonds will be based on “per task order” amounts. The bid guarantee (bid bond) will be as indicated in Attachment 10. Bid Bonds are not the same as Performance and Payment Bonds. The bonding is correct as identified.
Q2. Please confirm that the bid / offer guarantee (20% of bid price or $3,000,000.00, whichever is less) is to be based on the total line of Attachment 1 (inclusive of 1st, 2nd, 3rd, 4th and 5th ordering periods).
A2. The bid guarantee amount is based off the total from cell E22 of Attachment 1 Bid Schedule Excel document.
8. Bonding is based on the total value of a project not just hours worked. It needs to incorporate hours, equipment, abatement which some jobs may need it and some may not. As instructed, it states to add Bonding cost to the hourly wage section. The information is too limited to generate a realistic number?
Offerors are not asked to provide Performance and Payment bonds as part of this solicitation response. Performance and Payment bonds will be required of the eventual awardee in response to a “Request for Task Order Proposal”, at which time they will provide their actual bonding cost incurred as part of their Task Order proposal.
9. The statement from Attachment 9 reflects General Contracting work. The Solicitation is for Demolition and Abatement. How does this fit into the solicitation?
Attachment 9
1.2 STATEMENT OF BID ITEMS
A. ITEM I, GENERAL CONSTRUCTION: Work includes general construction, alterations, and removal of existing structures and construction and certain other items.
10. Attachment 9: This is geared to a General contracting solicitation not a Demo Solicitation. How does this apply?
1.7 OPERATIONS AND STORAGE AREAS
H. When an unoccupied building is turned over to Contractor to complete construction as required, Contractor shall accept entire responsibility until contract completion.
1.7 H. has been revised in Attachment 9.
11. Attachment 9: Will the government/ARS provide the existing “As Built” draws for the contractor to mark up.
1.10 AS-BUILT DRAWINGS
A. The Contractor shall maintain two full size sets of as-built drawings which will be kept current during construction of the project, to include all contract changes, modifications and clarifications.
B. All variations shall be shown in the same general detail as used in the contract drawings. To insure compliance, as-built drawings shall be made available for the Contracting Officer’s review, as often as requested.
C. Contractor shall deliver two approved completed sets of as-built drawings and one electronic version to the Contracting Officer within 15 calendar days after each completed phase and after the acceptance of the project by the Contracting Officer.
D. Paragraphs A, B, & C shall also apply to all shop drawings.
1.10 E has been added to Attachment 9.
12. How will the Government handle when no As Built exists?
See number 11 above.
13. Attachment 9: The following section and its subparts have several references to construction projects not demo and abatement projects. What is the meaning in those situations.
1.17 CONSTRUCTION WASTE MANAGEMENT
The term “construction” in 1.17 shall be taken to mean any demolition, abatement or ancillary work the contractor is to perform per task order.
14. Attachment 9: Construction Waste; Why does ARS want to know the money paid ? I understand the weight and manifest tickets. Does the government/ARS intend to deduct the recycle of salvage value from the total Task Order Fixed price of a project?
e) Amount of any money paid or received for the recycled or salvaged material. Net total cost or savings of salvage or recycling each material. Attach manifests, weight tickets, receipts, and/or invoices. Indicate the project information, including project title, name of company completing form, and beginning and ending dates of period covered by summary form.
Information is used for reporting purposes only internal to USDA. Task Orders are firm fixed price. No deduction of salvage value from the total Task Order Fixed price of a project will occur.
15. Why is attachment 7 part of the Solicitation. This a Demo and Abatement Solicitation not a Design Build Solicitation? The only item I can see that somewhat applies is the section referencing 2. SITE PLANNING AND LANDSCAPE DESIGN. It is really about rehabilitation and restoration not “Design” as outlined?
ARS P&P 242.1M give guidelines as to how work at ARS should be performed. This document was included as it may apply to some work performed by the contractor on certain task orders involving ancillary work as described in # 2 above.
16. Where and how are the values related to the potential work. Are the values the maximum amounts ARS intends to spend?
A. Labor hours and roles?
B. Material and equipment? $210,000 C. ACM/Lead Testing? $92,000
These amounts are estimated amounts to be used for the purpose of price evaluation.
Actual task orders placed (to include amounts) will identified as requirements are generated.
Refer to Attachment 10, answers to questions 15 and 16.
17. Material and equipment cost include waste, trucking and rental equipment on a Task Order.
Refer to Attachment 10, answer to question 14. Direct equipment costs are allowable separately priced items on a Task Order proposal.
18. Each Task Order will be a fixed cost project based on unique project parameters?
Each Task Order will be firm fixed priced (after negotiations), based upon the associated
Task Order scope of work. Please refer to Solicitation paragraphs C.2.8 and C.2.9.
19. What is the correct number 14 or 10?
F.3 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (FAR 52.211-10) (APR
1984) The Contractor shall be required to:
(a) commence work under this contract within fourteen 10 calendar days after the date the Contractor receives
Typo, this should state 10 calendar days. “Fourteen” will be omitted on the contract award.
