(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. GENERAL INFORMATION

1.0 Background and Purpose:

Scientists at the Roman L. Hruska U.S. Meat Animal Research Center (USMARC) are developing scientific information and new technology to solve high priority problems for the U.S. beef, sheep, and swine industries. Fertilizer is required for the crops grown to feed the research animals.

CONTRACTOR REQUIREMENTS

2.0 Technical Requirements/Tasks:

The requirement is for fertilizer in the amounts and applied as described below:

Item 1-Monoammonium Phosphate, MAP, 11-52-0. Product with 25 TON spreader application. Approximately 262 acres. Application 3-1-2021 through 4-30-2021. Applied as weather and field condition permits.

Item 2-Urea, 46-0-0, Granular free flowing, not prilled. Product with 125 TON spreader application. Multiple application rates, approximately 1600 acres. Application 3-1-2021 through 4-30-2021. Applied as weather and field condition permit.

Item 3-UREA, 46-0-0, Granular free flowing, not prilled. Product with 100 TON spreader application. Multiple locations, multiple rates.

Alfalfa/grass crop and selected irrigated cool season pasture.

Approximately 1200 acres. Application 5-15-21 through 6-15-21, as weather, field condition permit and as fields become available.

Item 4-Urea Ammonium Nitrate, UAN 32-0-0. Multiple delivery on an 750 TON as needed basis, 4-1-2021 through 10-15-2021. Final quantity may vary but will be no less than 80% of requirement. Vendor to provide for seasonal use 6 each tandem nurse trailers, each 1000- to 1300-gallon units, with 2 of the nurse trailers equipped with pumps and hoses with 2" couplers.

Item 5-Ammonium polyphosphate solution, 10-34-0. Delivery on an as 70 TON needed basis, 4-10-2021 through 5-15-2021. Vendor to provide 2 each, 1000- to 1300-gallon tandem axle trailers equipped with transfer pump and hoses, 2" couplers.

52.212-2 -- Evaluation -- Commercial Items.

As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation and is deemed to be the Lowest Price Technically Acceptable (LPTA) offer. The following factors shall be used to evaluate offers:

Technically Acceptable; Quote clearly meets the minimum requirements of the solicitation.

Technically Unacceptable; Quote does not meet the minimum requirements of the solicitation

Price and Past performance will be evaluated. The lowest priced offeror with an acceptable past performance record will be awarded the contract.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option(s).
