Questions and Answers #2

Q1 (Comment): We’ve done an analysis of Davis Bacon Wages for each state and county, and came up with variances ranging from $2.00 to $52.00. Since we don’t know where and how much work is going to be performed in each location, we will have to use the highest rate which will result the government not receiving the most cost-effective pricing on each project.

A1: The Government has taken this into account and the Government labor hours expended (solicitations, evaluations, negotiations, etc) will be drastically reduced under this pricing model, providing considerable cost savings and flexibility.

Q2 (Comment): Additionally, Davis Bacon rates are not close to competitive rates in many regions – competitive rates are typically higher.

A2. Construction Wage Rates Requirements (Davis Bacon Act) requirements are only the minimum wage requirements, Contractors shall price their projected Fully Burdened Labor rates to a rate they feel comfortable to be able to execute all potential work. Contractors are purposefully being tasked to find a rate they can operate profitability, yet still be competitive in this RFP. This rate should be well thought out and not expected to be modified based on profitability after award.

Q3: In these states, can you tell us where each location of work will take place?

Q4: What percentage of dollars will be spent in each location within each state?

A4: That information is unknown, work will be executed as requirements are generated.

Q5: There are non-material and non-labor costs that go into a bid such as hotels, vehicles, general requirements, dumpsters, portalets, insurance, taxes (taxes may vary in each state), etc. Where are we to list those items on the bid spreadsheet?

A5: Overhead Costs shall be included in the Firm Fixed Price Fully Burdened Labor Rates and the Equipment and Materials Overhead and Profit Rate. There will not be a separate pricing model to capture those costs. Again, we are purposefully tasking Contractors to find a rate they can operate profitability, yet still be competitive in this RFP. Contractors shall read this strictly as the plain language of the RFP that Equipment (lift rentals, crane, dumpsters, etc) and Materials (wood, wire, boilers, duct work, etc) only shall be priced out in the cost of Task Order proposal, everything else is considered overhead and captured by the proposed Overhead rate. If it is not direct equipment or materials, it shall not be priced separately on the Task Order proposal, it shall be covered by the two pricing categories listed above. The Contracting Officer shall make the final determination on all Equipment and Material costs, this determination is not an item that must be mutually agreed upon during Task Order negotiations.

(In this specific example provided the dumpsters/portlets, would be considered direct equipment/materials for the project and would be included in the Equipment/Materials cost and the proposed overhead rate applied to those items. The other overhead costs (ie company vehicle lease, hotels, general requirements, insurance, taxes) shall be captured in the Overhead rate, no exceptions).

Q6: Please confirm if we are to submit one copy of “attachment 1 bid schedule” that will include 1 price for each trade for all 6 states, or if we are to submit one copy of “attachment 1 bid schedule” for EACH individual state.

A6: There is only one (1) Bid Schedule. There is no separate break down per state.

Q7: Will the bond amount be set and only adjusted when requested by the Contracting Officer? Will the bond amount be set and only adjusted when requested by the Contracting Officer?

If not, how will the amount be determined and when? How will the Contractor be able to track what TO’s are added to and removed from the bond? Can a new bond be furnished each year to avoid unnecessary costly surcharges?

A7: The Contractor will be responsible for maintaining the proper bond amount, and no specific notice will be sent to the Contractor. The Bond shall be increased when a task order is issued for the task order amount, and remove the Task Order amount from the bond when it is final accepted.
