DEBARMENT

A Bidder may be debarred from bidding or proposing upon or being awarded any contract with the City, or from being a subcontractor or supplier at any tier upon such contract, in accordance with the procedures in Fresno Municipal Code Section 4-104 adopted by Council on May 17, 2018. The initial period of any such debarment shall not be less than one year and may be permanent depending on the violation. A Bidder may request a hearing, in accordance with Fresno Municipal Code Section 4-104, upon receipt of a notice of proposed debarment from the City Manager or designee. A copy of the Resolution may be obtained from the City Clerk's Office, 2600 Fresno Street, Fresno, California 93721.

SUBLETTING OR ASSIGNING THE CONTRACT

Pursuant to Required Contract Provisions Federal-Aid Construction Contracts, Section VI of Federal Form 1273 (see page 3.13 herein), the Contractor shall perform with its own organization Contract Work amounting to not less than 30 percent of the original total Contract Price (i.e., the total net bid amount) and not less than 30 percent of each possible combination of the Base Bid plus Add Alternate(s), if applicable, excluding specialty items designated by the City on the bid proposal.

Accordingly, the three lowest Bidders shall provide, within three working days from the date of the bid opening, the CERTIFICATION FOR PRIME CONTRACTOR SELF PERFORMANCE form found on page 1.25 that the bidder will perform not less than 30 percent of the total net bid amount and not less than 30 percent of each possible combination of the Base Bid plus Add Alternate(s), if applicable, excluding specialty items designated by the City on the bid proposal.

The Bidder shall identify in the letter those bid items and dollar amounts for the work to be done by the Prime Contractor.

DISADVANTAGED BUSINESS ENTERPRISE (DBE)

An Interim Final Rule (IFR) published by the U.S. Department of Transportation (DOT) on October 3, 2025, eliminates the presumption that a business is disadvantaged based solely on the owner’s race, ethnicity, or sex. As a result, the DBE program still exists, but there is a temporary suspension while firms are being recertified. No DBE goal will be placed on this project, and proposals will not be evaluated based on proposed DBE participation.

ACH PAYMENT INITIATIVE-ELECTRONIC PAYMENT

Contractor shall provide complete and accurate billing invoices in order to receive payment.

Billing invoices submitted must contain all information and supporting documentation required by the contract.

A250090 2025-01 CPDFHWADivI xi rev. 07.25

Payment for invoices submitted by the contractor shall only be rendered electronically unless payment by paper check is expressly authorized by the Controller, in the Controller’s sole discretion, due to extenuating circumstances. Such electronic payment shall be made in accordance with ordinary City procedures and practices. The contractor shall comply with the Controller’s procedures to authorize electronic payments. Contractor acknowledges that it will not receive payment on any invoices submitted under this Contract if it does not comply with the Controller’s electronic payment procedures, except where the Controller has expressly authorized payment by paper check as set forth above.

HOT WORK SAFETY REQUIREMENTS

A. Applicability

This section applies whenever Contractor's work under this Contract involves or may involve "hot work," defined as soldering, welding, pipe-cutting, heat-treating, grinding, thawing pipes, hot riveting, torch-applied roofing, or any other activity involving open flame, heat, or the production of sparks. If Contractor's work does not involve hot work, this section does not apply.

B. Compliance with City Program Where applicable, Contractor shall comply with the City of Fresno Hot Work Safety Program (Program), as may be amended, a copy of which is available upon request from the City's Personnel Services Department, Risk Management Division, or from the City's project representative. In the event of any conflict between this section and the Program, the more stringent requirement shall control.

C. Designated Roles Prior to performing any hot work, Contractor shall designate, from among its own personnel, a Supervisor, a Fire Watch, and, when City personnel are not present at the work location, a Hot Work Approver, each trained consistent with the Program's requirements for that role.

D. Permits Where hot work is to be performed at a location where City employees are present, Contractor shall obtain a hot work permit from the City's designated Hot Work Approver prior to beginning work.

Where hot work is to be performed at a location where City employees are not present, Contractor is responsible for issuing its own permit consistent with the Program.

Contractor may use its own hot work permit form in lieu of the City's, provided it contains, at minimum, the information required by the Program's standard permit and has been approved in advance by the City.

Contractor shall provide the City's project representative with copies of all revoked/closed hot work permits by the end of each business day, or within such other reasonable time as may be mutually agreed.

E. Precautions Contractor shall, at a minimum: remove or protect combustible materials within 35 feet of the hot work; confirm any applicable fire suppression system is operational; ensure a fire watch is maintained during hot work and for not less than 60 minutes after work concludes; and ensure personnel performing or exposed to hot work use PPE appropriate to the hazard.

A250090 2025-01 CPDFHWADivI xii rev. 07.25

F. Notification Contractor shall notify the City's project representative before hot work begins so the City can coordinate access, evacuate affected areas if necessary, and confirm no conflicting activity is scheduled in the vicinity.

G. No Relief from Other Requirements Nothing in this section relieves Contractor of its independent obligation to comply with all applicable fire codes, Cal/OSHA requirements, NFPA standards, and manufacturer requirements for equipment used in hot work operations.
