SECTION C - PERFORMANCE STATEMENT OF WORK (PWS)
This contract will support the black-footed ferret recovery efforts in South Dakota. The two primary locations where the services will be conducted are in the 3.63 Management Areas (Black-Footed Ferret Reintroduction habitat) on the Wall Ranger District and Badlands National Park. Future treatments may occur under this contract on the Fall River Ranger District 3.63 Management Areas if warranted by the conditions on the ground
(ie. Ferrets are found to be present there), and possibly Wind Cave National Park (additional interagency coordination is needed prior to any plague mitigation treatments on Wind Cave National Park through this contract).
A contractor to conduct plague mitigation services on identified locations. The primary method of plague mitigation in use is the application of dust insecticides to prairie dog colonies. Dusting machines are used to apply the dust insecticide to the colonies. A secondary method that will be covered under this contract is the application of a grain bait to prairie dog colonies which is consumed by the prairie dogs and contains an insecticide (fipronil).
Dusting (DeltaDust): As described in each task order, the contractor shall apply DeltaDust to burrows in designated prairie dog colonies on the Buffalo Gap National Grassland and Badlands National Park for sylvatic plague abatement. For each fiscal year, dusting can start when conditions allow and in coordination with the COR, but all designated colonies must be completed by 30 September of the same fiscal year.
Grain Baiting (Fipronil): As described in each task order, the contractor shall apply Kaput Flea Control Bait With Fipronil to active burrows in designated prairie dog colonies on the Buffalo Gap National Grassland and Badlands National Park for sylvatic plague abatement. For each fiscal year, fipronil treatments can start when conditions allow and in coordination with the COR, but all designated colonies must be completed by 30 September of the same fiscal year.

SECTION E -- INSPECTION AND ACCEPTANCE
E.1 FAR 52.246-4 Inspection of Services - Fixed-Price. (AUG 1996)
E.2 Contractor Self Inspection:
A. The contractor shall conduct self-inspections (QCP) on all aspects of work, collection of data, mapping, and data submittal. The field inspections shall be spread throughout the project area. For all submitted data, the contractor shall provide the Government with an acceptable method of self-inspection. This method shall be accepted and approved by the Government prior to the Notice to Proceed being issued.
At no time shall the contractor rely upon Government inspections to provide notification of unsatisfactory performance. The Contracting Officer may observe the Contractor's inspection at any time and shall otherwise have unlimited access to the inspection data.
The self-inspection process for treated areas shall be documented and submitted on a weekly basis after the Notice to Proceed occurs, and be representative of a treatment area.
The QCP shall specify:
1. How quality will be monitored to assure performance standards are met.
2. How the work will be supervised.
3. How results of the monitoring will result in quality performance.
4. Identify the personnel responsible for performing quality control.
B. Contractor Quality Control Inspection. The Contractor shall assure themselves that performance meets contract specifications, in accordance with clause FAR 52.212-4, Contract Terms and Conditions – Commercial Items, paragraph (a), Inspection/Acceptance prior to requesting the Government to inspect for payment or acceptance.
E.3 Government Inspection and Acceptance:
A. Government Quality Assurance Inspection. The Government will, at its convenience, make periodic inspections of the work to assure itself of contract compliance and to perform Quality Assurance Inspections to determine if the Contractor is performing quality control in accordance with its QCP and that the Contractor monitoring results in quality performance are within the contract objectives. The Government will assure quality is being met through plots and visual inspections as stated in Section 6.2 - PRS. Inspections will determine both the adequacy of coverage and rate of dust application. A determination of acceptance will be based on percent burrows dusted and dusting application rate meeting the AQL.
B. Acceptance. Acceptance of the work under the contract will be made after Government inspection and the Contracting Officer has made the determination of satisfactory compliance with the specifications. All required contract specifications shall be satisfactorily completed in each unit before acceptance will be made.
Acceptance will not be made for segments broken by unacceptable portions of work.
C. Rework and Reinspection after Rework. If the contractor fails to meet the minimum AQL, the contractor shall rework the area. The Government will conduct an inspection and up to one re-inspection for each area.
Anytime more than two inspections are required per area, the contractor will be accessed for additional inspections which will include mileage and hourly rate of Inspector or Inspectors. If follow-up inspections
Nebraska National Forest Page 7 of 31 indicate that the minimum AQL was not met, the work will be deemed unsatisfactory and a deduction in payment will result (Section G-6).

Whenever the Contracting Officer determines that the temperature, humidity, soil moisture, plant moisture stress, winds, or combination of these and other physical conditions have become unsuitable for project to continue in any area, the Contractor shall move the work force to another area(s) prescribed by the Contracting Officer. When no other area is available, the Contracting Officer will issue a suspend work order for the bid item and contract time will stop for that item. When conditions are again favorable, the Contracting Officer will issue a verbal resume work order and confirm the resumption in writing. Contract time will resume on the effective work resumption date. In all cases, the Contractor shall resume work within 3 calendar days after the effective work resumption date. It is the Contractor's responsibility to keep the Contracting Officer currently advised as to where the Contractor or the Contractor's Representative may be reached by telephone during periods of work suspension. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) above.
(d) Notwithstanding paragraphs (b) and (c) above, the Contractors shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 5 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
52.216-21 REQUIREMENTS (OCT 1995)
(a) This is a requirements contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. Except as this contract may otherwise provide, if the Government’s requirements do not result in orders in the quantities described as “estimated” or “maximum” in the Schedule, that fact shall not constitute the basis for an equitable price adjustment.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(c) Except as this contract otherwise provides, the Government shall order from the Contractor all the supplies or services specified in the Schedule that are required to be purchased by the Government activity or activities specified in the Schedule.
(d) The Government is not required to purchase from the Contractor requirements in excess of any limit on total orders under this contract.
(e) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source.

(End of clause)
FAR 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within ____30 days ____.
FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five years (and 6 months if 52.217-8 used). (End of clause)
