1. Submit quotes by email to Latisha.a.Hollman@usda.gov by the time specified in the solicitation.

A COMPLETE QUOTATION PACKAGE MUST CONTAIN THE FOLLOWING ITEMS:

� Signed Standard Form (SF) 1449 Schedule or Cover Page. Reference the solicitation number and include company name, address, DUNS number and point of contact information.

� Completed Pricing Schedule Provide a unit price for each line item specified in the Pricing Schedule. Alternative pricing schedules will not be considered.

� Past Performance Information. Provide at least three (3) past performance references for recent and relevant work performed by the quoter within the last three years. 2. STATEMENT OF WORK

1.0 Scope of Work

The work to be performed under this contract consists of furnishing all materials, equipment, supplies, labor and transportation as required by the Pricing Schedule of the contract, and in accordance with these specifications. All work materials and services not expressly called for in this performance work statement but are necessary for completion of the contract requirements shall be performed and furnished by the Contractor at no additional cost to the Government.

1.1 General Description of Work

The contractor shall perform regular and routine scheduled preventative quarterly maintenance on 4 autoclaves located USDA APHIS PPQ Science & Technology Mission Laboratories, at 22675 N.

Moorefield Rd, Edinburg, TX 78541. No work shall be conducted on Satrudays, Sundays, or Federal Holidays without the Contracting Officer’s approval.

1.1.2 Specifications

- Inspect all screens, filters, door seals and gaskets and replace as needed to prevent leakages, loss of service, and overall safely operation of the sterilizer system.

- Inspect all valves and valve kits and replace as needed to prevent leakages, loss of service, and overall safety in operating the sterilizer system.

- Inspect and replace as needed all piping, unions, fittings, solenoids, etc. to maintain seals and prevent leakages.

- The Services to the equipment will be performed Monday through Friday, 7:30 A.M. to 4:00 P.M., local time, excluding federal holidays (“Normal Working Hours”).

- Service should include periodic chamber cleaning as called for by the manufacturer, with chemicals used in the service provided by the service contractor.

- Regular preventative maintenance parts will be identified and kept in inventory by the service provider to ensure quick turnaround in case of emergency repairs are needed.

- After each preventative maintenance visit, a list of replaced parts and actions taken will be provided to the government facility.

- The service contractor will provide factory trained and qualified service technicians and provide copies of training certificates as evidence of training.

- The service contract covers labor and travel charges for routine maintenance as well as six

(6) unscheduled maintenance visits to troubleshoot and maintain operations of the sterilizer units within a calendar year. Unscheduled repairs will be made within 24-48 hours of the service call to minimize disruption of normal operations of the laboratory.

- At the service contractor’s discretion, they may provide troubleshooting advice via telephone to the government employees that routinely operate the equipment to improve on customer operability issues, possibly resolving the need for an unscheduled maintenance visit (mentioned above).

1.2

The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor’s failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.

1.3 Contact information

The contractor shall provide a primary and secondary point of contact, including telephone numbers (cell and office) and email addresses. The contractor shall notify the Government immediately if there is a change to the point of contacts.

1.4 Safety

The contractor shall comply with all applicable federal, state, and local safety and occupational health laws, rules, and regulations.

1.5 Bio Based Materials

The contractor shall utilize products and material from bio based materials to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user.

1.7 Secure Facility

The USDA APHIS Plant Protection Quarantine (PPQ) is a secure facility. Contractors must be escorted at all times while on site. Contractors must provide photo ID and sign in/sign out when entering/leaving the facilities at all times.

1.7.1 Safety and Security Requirements

During the performance of work herein, the contractor shall take all reasonable precautions to guard secrecy of the tenant’s records and information, shall limit access to records and information of the tenant to authorized employees or agents of the contractor only, and shall inform all such authorized personnel of the confidential nature of records and information of the tenant and of the applicable laws regarding security of communication.

SECURITY REQUIREMENTS AND CONTRACTOR IDENTITY PROOFING,

REGISTRATION, AND E-VERIFY PROCESS

1. The contract employee is responsible for safeguarding all government property provided for use. The contractor shall ensure that all card keys/keys issued are not lost or misplaced and are not used by unauthorized persons.

2. Contractors shall comply with the personal identity verification (PIV) policies and procedures established by the AGAR Advisory No. 81, Revision 03 dated July 12, 2010 – Common Identification Standard for Contractors and Departmental Regulation (DR) and Departmental Manual (DM) 4620-002. Copies of the DR and DM 4620-002 can be downloaded from the website at http://hspd12.usda.gov.

a. All applicable contractor employees requiring routine physical access to Federally-controlled facilities and/or routine access to Federally-controlled information systems must go through the identity proofing, registration, and e-verify process, and have a successful background investigation conducted by OPM. The level of investigation required is dependent on the duties and may require a low-risk non-sensitive National Agency Check with (Written) Inquiries, an Office of Personnel Management (OPM) Public Trust or an OPM National Security background investigation to serve on the contract. E-Verify is an electronic system which checks employee information obtained from the Employment Eligibility Verification form (I-9 form) against records maintained by both the Department of Homeland Security (DHS) and the Social Security Administration (SSA).

b. Contractor ID credentials will be issued after successful identity proofing of the contractor employee applicant and upon a successfully adjudicated background investigation.

The Contracting Officer is the only individual who can legally commit the Government to the expenditure of public funds. No person other than the Contracting Officer can make any changes to the terms, conditions, general provisions or other stipulations of this contract. Any other commitment, either explicit or implied, is invalid. The CO is the only person with authority to act as agent of the Government under this contract. Only the Contracting Officer has authority to: (1) direct or negotiate any changes in the statement of work; (2) modify or extend the period of performance; (3) change the delivery schedule; (4) authorize reimbursement to the Contractor for any costs incurred during the performance of this contract; (5) obligate or deobligate funds into the contract; or (6) otherwise change any terms and conditions of this contract. No information, other than that which may be contained in an authorized modification to this contract duly issued by the Contracting Officer, which may be received from any person employed by the United States Government, or otherwise, shall be considered grounds for deviation from any stipulation of this contract.

1.9 Invoicing Information

The contractor shall submit invoices and supporting documentation to the COR and submitted via www.ipp.gov. The COR must obtain approval for payment for all invoices.

A proper invoice must include:

(i) Name and address of the Contractor;

(ii) Invoice date and number;

(iii) Contract number, contract line item number and, if applicable, the order number;

(iv) Description, quantity, unit of measure, unit price and extended price of the items delivered;

(v) Shipping number and date of shipment, including the bill of lading number and weight of shipment if shipped on Government bill of lading;

(vi) Name, title, and phone number of person to notify in event of defective invoice; and

(vii) Taxpayer Identification Number (TIN).

The Government reserves the right to reject an invoice that does not include the information above

52.204-21 Basic Safeguarding of Covered Contractor Information Systems (Nov 2021)

(a) Definitions. As used in this clause— Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.

Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).

Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information ( 44 U.S.C. 3502).

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures.

(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial products or commercial services, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

(d) Comptroller General Examination of Record. 52.236-7 PERMITS AND RESPONSIBILITIES (Nov 1991) The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any Untied States Federal, State, and municipal laws, codes, and regulations applicable to the performance of the work. The Contractor shall also be responsible for all damages to persons or property that occur as a result of the Contractor's fault or negligence. AGAR 452.204-70 MODIFICATION FOR CONTRACT CLOSEOUTS (DEVIATION JULY 2022)

“Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to FAR Part 13.

(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a Release of Claims be completed by the contractor, although not required for contract and orders using SAP.) If the bilateral modification and Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.”

452.236-74 Control of Erosion, Sedimentation, and Pollution (Nov 1996)

(a) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).

(b) Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man-made channels. The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products or Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a)Definitions. (b)Prohibition.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to— (i)Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or (ii)Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2)Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
