1.0 STATEMENT OF WORK

JANITORIAL SERVICE Kentucky Area Office and Regional Laboratory USDA APHIS VS Kentucky 105 Corporate Drive, Suite E, F, G, and H Frankfort, KY 40601 502-848-2040 Kentucky Area Office and Kentucky Regional Laboratory 9,500 square feet

1.1 Hours of Service

Monday through Friday, excluding holidays, between the hours of 7:30a.m to 4:30p.m.

Services shall be performed during office hours with the least amount of disruption to personnel working. Saturday work is authorized for the annual cleaning of ALL floors only. Laboratory space is divided between an administrative section and working laboratory section which requires authorized access.

1.2 Daily Requirements (1st and 2nd Floors of area Office Space and Administrative section of Laboratory):

• Collect trash from all receptacles and deposit in the nearest outside trash collection container.

• Liners shall be replaced in receptacles free of dirt, residue, soil, and odor.

• Clean and disinfect restrooms and shower areas, including all fixtures such as toilet bowls, urinals, sinks, faucets, showers, floor drains, and dispensers. Refill dispensers with product supplied by the government agency. The fixtures shall be free of scale, dirt, stains, streaks, residues, rust, scum, debris, and odors. Sweep floors.

• Break room cleaning shall include sink, faucet and accessible counter top areas. The fixtures shall be free of scale, dirt, stains, streaks, residues, rust, scum, debris, and odors. Sweep floors.

• Sweep entrances, lobbies, corridors, stairs, and spot-sweep offices. Clean and polish drinking fountains.

1.3 ONCE WEEKLY (1st and 2nd Floors of Area Office Space and Administrative section of Laboratory):

Spot clean all washable surfaces (walls, doors, elevator, and floors). These surfaces are to be free of visible soil, debris, streaks, stains, and dust. All windows, mirrors, and interior/exterior sides of glass inserts in doors shall be free of visible streaks or soil. Spot clean all carpeted floor surfaces.

Damp mop all resilient floors in secondary corridors, entrance and lobbies. Damp mop hard and resilient floors in office space. Wet areas shall be marked to alert others of slippery surfaces.

All non-carpeted surfaces shall be free of dirt, debris, and soil.

Vacuum all carpeted areas to remove all dirt, debris, and soil from all accessible areas such as corners, carpet edges along walls and furniture, and under furniture such as tables, chairs, and desks.

Wash inside and out or steam clean, trash cans used for collection of food remnants from the break room.

1.4 EVERY TWO MONTHS (1st and 2nd Floors of Office Space and Administrative section of Laboratory):

Damp wipe restroom wastepaper receptacles, stall partitions walls, doors, windowsills and door frames ensuring the surfaces are free of dust, soil, stains, and streaks.

1.5 ONCE A QUARTER (working laboratory section)

Mop and wax resilient flooring in the working laboratory section.

1.6 TWICE A YEAR (1st and 2nd Floors of Office Space and Administrative section of Laboratory):

Clean interior and exterior building windows in the front of the building leaving no streaks, dirt, smudges, water and other foreign matter.

1.7 ANNUALLY (1st and 2nd Floors of Office Space and ALL Laboratory sections)

Shampoo all carpeted flooring, such as office space, conference rooms, training room, etc.

Strip and wax all resilient flooring.

Clean inside and outside of all light fixtures, such as emergency exit lights, lighted signs, fans and blades, canopy lights, and wall mounted lights ensuring the fixtures are free of streaks, bugs, dirt, dust, grease, and other foreign matter.

Dust, vacuum and damp wipe vertical blinds ensuring the window coverings are free of dust, soil, stains, and streaks.

1.8 Contractor Requirements:

The Contractor shall provide all personnel, equipment, and tools to perform janitorial services as defined in this Statement of Work. All Contractor employees shall be provided a security badge which shall be worn at all times while at the facility.

1.9 Chemical Supplies:

The contractor will follow applicable safety requirements and OSHA requirements for the storage and use of hazardous substances on KY AREA OFFICE and LABORATORY property.

The Contractor shall be provided space for storing equipment, cleaning supplies, and products to refill dispensers.

The Contractor is responsible for providing all cleaning solvents/products.

The Government will supply all trash liners, paper towels, toilet paper and hand soap.

1.10 Government Roles and Responsibilities:

CONTRACTING OFFICER (CO) RESPONSIBILITY

a. If the CO does not retain the COR responsibilities for a contract the CO shall issue, in writing, the “Delegation of COR” memo to the individual that will serve as the COR on the contract(s). The “Delegation of COR” memo will authorize the individual to serve as the COR for a specific contract and will outline the roles and responsibilities of the COR which include: monitoring the contractor’s performance; contract surveillance; performing inspections to ensure compliance with the contract terms, conditions, and specifications; and performing acceptance.

b. Issue the “Delegation of COR” memo only to those individuals with an active Federal Acquisition Certification-COR (FAC-COR) in the Federal Acquisition Institute Training Application System (FAITAS) at the appropriate level.

c. Alternate COR: Issue a “Delegation of Alternate COR” memo to an individual to serve as an alternate

COR.

(1) The primary COR will provide to the Contracting Officer the responsibilities that the contracting officer will delegate to an alternate COR.

(2) The alternate COR must comply with the experience and/or training of the appropriate level of the FAC-COR requirements. Depending on the specific task(s) performed an Alternate COR may only need the FAC-COR Level I certification.

(3) An Alternative Delegation may be issued to an individual to serve as an alternate COR in the absence of the primary COR or to serve as an alternate for very a specific task (e.g., on-site performance monitoring, inspection/acceptance) to support the responsibilities of the primary COR.

1.11 GREEN CLEANING

The USDA is mandated by legislation and executive order to purchase products that are good for the environment. Below are minimum requirements for paper products, industrial wipes, and trash liners that must be used by Contractors in a USDA service contract. The successful Contractor will be required to meet or exceed the below listed mandatory environmental-prefer ability criteria. The offered products must meet requirements as stated below:

a. Disposable paper products: The disposable paper products must contain at least 100% recovered materials and 30% post-consumer product and manufactured without the additional use of elemental chlorine or chlorine compounds.

b. Plastic trash bags: Plastic trash bags and other liners with a minimum of 30% post-consumer recycled content.

c. General purpose industrial wipes: The general purpose industrial wipes must contain at least 100% recovered materials and 40% post-consumer content.

d. Cleaning Fluids: Cleaning products shall have highest percentage of bio based products practicable.

The cleaning fluids must be in accordance with Colorado Code of Regulations low VOC cleaning products OR Green Seal Standard GS-37 approved.

2.0 PRICE SCHEDULE

This is a fixed price contract for a base year and four option years as indicated below. The contractor shall submit a firm-fixed price quote to perform all the work required in accordance with the Statement of Work. The contractor’s price shall be their fully burdened rate which includes all costs associated with the performance of any and all services ordered against this contract for the janitorial services in accordance with this “statement of work” (SOW), including but not limited to; all direct costs, such as salaries, fringe benefits, licenses, taxes, insurance costs, materials, supplies and equipment, start-up costs, indirect costs, overhead, general and administrative expense, training, etc., and profit to provide services for the USDA, APHIS, VS. In order to provide an accurate quote, we encourage a walk-through of the facility. Per FAR 52.222-41 the Service Contract Act applies to this contract. Contractors may be requested to provide proof that all contract employees are paid appropriately.

If the option period is exercised on the contract, each year a new wage determination will be obtained and provided to the contractor with the modification to exercise the option. In accordance with FAR 52.222-43, the contractor shall notify the contracting officer of any increase claimed under this clause within 30 days after receiving a new wage determination unless this notification period is extended in writing by the contracting officer.

3.0 BIOPREFERRED REQUIREMENTS AND SAFETY AND SECURITY REQUIREMENTS

3.1 Biopreferred Requirements

The Contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002 (FSRIA), Executive Order (EO) 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” and the Federal Acquisition Regulation to provide biobased products.

The Contractor shall comply with the provision at FAR 52.223-1, Biobased Product Certification and with the clause at FAR 52.223-2, Affirmative Procurement of Biobased Products Under Service and Construction Contracts.

3.2 Safety and Security Requirements

A. Contractors shall comply with the personal identity verification (PIV) policies and procedures established by the AGAR Advisory No. 81, Revision 03 dated July 19, 2010 – Common Identification Standard for Contractors.

B. In accordance with the USDA policy and directives, a Background Investigation of the (insert title of contractor personnel) personnel is required prior to starting work under this contract as well as maintaining it throughout the duration of the contract. The contractor shall, through their own internal background investigation protocol and preemployment investigation, ensure that each contractor employee submitted for a federal background investigation is reasonably expected to receive a favorable adjudication of their respective investigation.

C. The USDA, APHIS will pay for the required federal background investigation. The government shall have and exercise full and complete control over granting, denying, withholding, or termination the background investigation clearance for employees.

D. All contractor personnel that will have access to the APHIS facility will be required to have, a (insert type of BI required) with no less than favorably adjudicated results. Once approved and working at the facility, the contractor personnel shall not be removed or diverted from the site without prior notification to the Contracting Officer, Contracting Officer Representative or the designated point of contact.

E. The contractor shall not employ persons for work on this contract if such employee is considered by the USDA to be a potential threat to health, safety, general well-being or operational mission of USDA and its employees and property. If the USDA finds a prospective employee to be unsuitable for his or her assigned duties, the contractor will be advised immediately that such employee cannot continue to work or be assigned to work under the contract.

F. The Contracting Officer Representative or other designated point of contact will assist the contractor, where practical, with the background investigation process and the associated paperwork.

G. The Contractor shall provide to the USDA Personal Identity Verification Sponsor and the Personnel Security Specialist the information required to initiate the background investigation, including information on previous Office of Personnel Management background investigations or clearances conducted by the contractor. The Contractor shall ensure that prime and subcontractor employees requiring background investigations complete and submit the proper https://www.dm.usda.gov/procurement/policy/advisories.htm paperwork and forms. 4.0 QUALITY ASSURANCE

The contractor shall appoint a competent, experienced, and knowledgeable point-of-contact (POC), Supervisor, who shall independently manage, supervise, and act as a representative of the contractor for coordination of all work assignments required under this contract.

The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. See FAR clause 52.246--4 -- Inspection of Services -- Fixed-Price.

Should the contractor fail to successfully perform any of the cleaning deliverables outlined in this SOW, the contractor shall re-clean at no-cost to the government. If failure to perform continues, and the contractor does not maintain a consistent corrective action, the Government may require the personnel to be removed from the site or termination of the contract.

5.0 EVALUATION FACTORS AND SUBMISSION REQUIREMENTS

5.1 Evaluation Factors

This solicitation is for the acquisition of commercial services and is being conducted in accordance with FAR Subpart 13.5 Simplified procedures for Certain Commercial Items. Simplified acquisition procedures will be followed.

The offeror that offers value to the Government, price and other non-price factors considered, will receive the award.

The following factors will be considered when evaluating quotes:

1. Price

2. Personnel Experience/Management Plan/Quality Assurance Plan – The individuals identified to perform the work on-site and their recent experience in similar spaces.

A higher rating will be given to those individuals identified that have recent experience working in similar facilities and has a clear plan for managing and ensuring quality work.

3. Past Performance – The contractor has complied with contract requirements as well as local, state and federal laws.

5.2 Submission Requirements

The following items are required to be submitted by the solicitation due date in order to be eligible for award:

1) A signed copy of the SF 1449 Form. Please complete Block 17a including vendor name, address, phone number, Federal Tax ID number, and DUNS number. Then, sign in block 30a.

2) Completed price schedule for each year of the contract as organized in Section 2.0 of the Solicitation.

3) Identify the individuals that will be performing the work on-site and briefly describe at least two examples of work the individual(s) performed in the area in the last five years. Please provide a point of contact for this work, phone number, email address, length of work performed, square footage of space cleaned. Further, briefly describe how quality assurance will be managed and maintained throughout the contract.

4) Provide at least two past performance references, if using a subcontractor, at least one of these must be for work performed by the subcontractor, including a point of contact name, phone number, email, and location. These can be the same references identified in #3 above.

5) SYSTEM for AWARD MANAGEMENT (SAM) REGISTRATION: SAM Registration is required of all federal contractors. SAM registration enables electronic funds transfer of contract payments. If your company is not already registered, please register in the SAM database at https://www.sam.gov/portal/public/SAM/.

a) A DUNS number is required for SAM registration. If your company does not have DUNS #, obtain one by calling 800-333-0505.

b) If the prospective awardee for this request for proposals is not registered in the SAM database within 7 calendar days of the solicitation close date, depending on mission requirements, the government reserves the right to proceed to award to the next otherwise successful registered offeror.

5.3 Quote Due Date

Quotes must be submitted to Margaux Nenichka margaux.g.nenichka@aphis.usda.gov by September 21, 2018 by 1:00 PM Eastern Time.

5.4 Questions

All questions must be submitted in writing to Margaux Nenichka at margaux.g.nenichka@aphis.usda.gov by September 17, 2017.

6.0 CONTRACT ADMIMINSTRATION

6.1 Invoicing Information

Invoices may be issued upon USDA acceptance of monthly services rendered. Invoices shall be submitted to the Invoice Processing Platform (IPP) at www.ipp.gov.

A proper invoice must include:

(i) Name and address of the Contractor;

(ii) Invoice date and number;

(iii) Contract number, contract line item number and, if applicable, the order number;

(iv) Description, quantity, unit of measure, unit price and extended price of the services delivered;

(vi) Name, title, and phone number of person to notify in event of defective invoice; and

The Government may reject an invoice that does not include the information above.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. 52.216-18 – Ordering (Oct 1995)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from October 1, 2018 through September 30, 2023.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) If mailed, a delivery order or task order is considered “issued” when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.

52.216-19 - Order Limitations

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $1000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor --

(1) Any order for a single item in excess of $15,000.00;

(2) Any order for a combination of items in excess of $15,000.00; or

(3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 30 days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22 - Indefinite Quantity (Oct 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the “maximum.” The Government shall order at least the quantity of supplies or services designated in the Schedule as the “minimum.”

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after September 30, 2023.

(a) Definition: “Services,” as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.

(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.

(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.

(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may --

(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and

(2) Reduce the contract price to reflect the reduced value of the services performed.

(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may --

(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or

(2) Terminate the contract for default.
