About this file
This document is a checklist for New York State farmers and certified pesticide applicators to comply with the Environmental Protection Agency's (EPA) Worker Protection Standard (WPS). The checklist covers requirements related to pesticide safety information, pesticide exposure incidents and emergency assistance, information exchange, pesticide safety training, training records, application restrictions, notification of applications, warning signs, oral warnings, handler employer requirements, decontamination sites, personal protective equipment (PPE), respirator use, closed systems, enclosed cabs, early entry workers, and anti-retaliation.
The related federal contract opportunity is for the Department of Agriculture Forest Service R9-Eastern Region to treat the non-native invasive plant Japanese stiltgrass in a hardwoods forest along Breakneck Creek on Finger Lakes National Forest and on adjoining private land. A contractor with a current Certified Pesticide Applicator license in New York is sought to perform herbicide treatments at specified stiltgrass infestations at least twice over the 2024 growing season.

This is not a comprehensive list and there may be additional requirements that go beyond this general checklist for pesticide applications in New York State. For example, there are posting, contracting, and permitting requirements for certain types of applications that are not included on this checklist.
It is necessary to review the ECL Article 33, Article 15, and the regulatory requirements of 6NYCRR
Part 320-329 to ensure compliance. Links to the ECL and regulations can be found on the New
York State Department of Environmental Conservation’s Website at:
