About this file

This document establishes professional conduct standards and procedural guidance for a USDA Forest Service contract acquisition.

The USDA Forest Service maintains a zero-tolerance policy for harassment and unprofessional conduct directed toward contracting personnel. Offerors and contractors must communicate professionally and respectfully, focusing exclusively on procurement-related issues. Repeated accusatory, hostile, or harassing language is unacceptable and will be documented and referred for review under USDA policy and the Agriculture Acquisition Regulation (AGAR) system. Violations can result in removal from vendor lists and exclusion from future contracting opportunities, consistent with applicable law, the Federal Acquisition Regulation (FAR), and Department policy. The acquisition uses Simplified Acquisition Procedures (SAP) under FAR Part 13 for supplies and services not exceeding the Simplified Acquisition Threshold (SAT), implemented and supplemented by USDA policy and AGAR guidance. Authority for Department-wide regulations and guidance is issued by the Senior Procurement Executive consistent with FAR 1.301 and AGAR 401.103, with the USDA Contracting Desk Book serving as the primary resource available on the USDA procurement website.

Professional Conduct – Zero Tolerance for Harassment

USDA Forest Service expects all offerors and contractors to maintain professional, respectful communications with contracting personnel. Repeated accusatory, hostile, or harassing language toward contracting personnel is unacceptable and will not be tolerated.

Such behavior will be documented and referred for review under applicable USDA policy and the Agriculture Acquisition Regulation (AGAR) system of internal guidance and oversight (see AGAR system/maintenance authorities, including the Senior Procurement Executive’s authority to issue Department-wide guidance consistent with FAR 1.301 and AGAR 401.103, and the USDA Contracting Desk Book availability on the USDA procurement website). Continued harassment can result in removal from vendor lists and exclusion from future opportunities, consistent with applicable law, the FAR, and Departmental policy. All communications must remain professional and focused on procurement-related issues.

This acquisition uses Simplified Acquisition Procedures (SAP) under the Simplified Acquisition Threshold and will follow the methods prescribed in FAR part 13, as implemented and supplemented by USDA policy and the AGAR. USDA follows the policies and procedures set forth in the FAR as supplemented by the AGAR.

USDA AGAR/Policy References
