(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6 of the Federal Acquisition Regulation, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
(ii) This solicitation is issued as a Request for Quotation (RFQ).
(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-03.
(iv) This procurement is set aside for Set Aside. The NAICS code is 238190/Other Foundation, Structure, and Building Exterior Contractors and the Small Business Size Standard is $19M.

Addenda to provision 52.212-1:
1) Quoters must have an active entity registration in the System for Award Management in order to submit an offer. https://www.sam.gov/SAM/
2) The quoter shall complete the schedule of items/price schedule and Quote that must be submitted by Email Only to: shanita.rankin@usda.gov no later than August 2, 2024, 3:00PM, Eastern Time. Pricing for all line items must be included for a quote to be considered. Emails should contain 3 separate attachments (Technical Proposal, Price Proposal, and Representations and Certifications) in Microsoft Word, Excel, or Adobe PDF format. Be aware that large attachments may increase the time required to deliver an email. It is the offerors responsibility to confirm receipt of the offer from Shanita Rankin or Erin Kirchoff.
3) Modifications, amendments or withdrawals of quotes and other communications should also be made to the e-mail addresses listed above. Hard copies of quotes will not be accepted. Any quotes received after the exact time specified for receipt shall be treated as a late submission in accordance with Federal Acquisition Regulation (FAR) 52.215-1, “Instructions to Offerors – Competitive Acquisition”.
4) The Government will award a single contract award resulting from this solicitation to the responsible quoter having submitted the Best Value to Government offer that satisfies all terms and conditions of this solicitation.
The vendors shall address the factors below in their technical proposal:
Factor I – Past Performance
The Vendors shall provide past performance information on three (3) prior contracts, subcontracts, agreements, or other relevant work for services similar in scope, size, magnitude, and complexity to the requirements in this PWS.
1. Recency: Similar contracts completed or worked on within the past three (3) years.
2. Relevancy: The vendor shall submit past performance information that demonstrates their history of successful completion of projects; history of producing high-quality reports and other deliverables; history of staying on schedule and within budget. The vendor shall demonstrate the quality of cooperation (with each other) of key individuals within the company, and quality of cooperation and performance between the company and its clients. Each referenced prior contract should meet or exceed the scope, size, magnitude, and complexity of this requirement in order to be considered relevant.

The Government intends to make an overall determination of Past Performance based on a review of the following:
Contract Performance Assessment Reporting System (CPARS) Previous contract history
So that the Government may efficiently evaluate and verify the past performance information the quoter should utilize the past performance questionnaire (Attachment 4) to satisfy this requirement.
Points of Contact with correct phone numbers, titles, and e-mail addresses to allow the Government to verify information submitted. Provide at least one (1) verifiable contracting or technical point of contact. If possible, provide both contracting and technical points of contact. The Quoter shall ensure that information presented for points of contact is accurate and current (i.e., current phone numbers, email addresses).
Factor II – Price/Cost
The vendors shall fill out the Schedule of Items shown above to satisfy this requirement.
(ix) 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) (Provision)
Evaluations will be made on the Quoters following factors:
Factor I – Past Performance. Past performance will be evaluated on the basis of the following sub-factors of equal importance:
Subfactor 1 – Recency
Subfactor 2 - Relevance
Recency Assessment. An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past three (3) years from the solicitation issuance date.
Recent past performance is defined as not more than 3 years from the RFQ release date; relevant in terms of similar scope, size, magnitude, and complexity.
Relevancy Assessment. To be relevant, the effort must be similar in nature of work, size, and complexity. The Government will conduct an in-depth evaluation of all recent performance information obtained to determine if it is the same or similar in scope, size, magnitude, and complexity to the services being procured under this solicitation.
Assigning Rating. The Past Performance Factor will be assigned one of the ratings defined below:

Rating Definition
High Confidence The Government has high confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful in performing the contract with little or no Government intervention.
Some Confidence The Government has some confidence that the Quoter understands the requirement, proposes a sound approach, and will be successful in performing the contract with some Government intervention.
Low Confidence The Government has low confidence that the Quoter understands the requirement, proposes a sound approach, or will be successful in performing the contract.
An offer will be determined to be acceptable under Factor I Past Performance in accordance with the following procedures:
1) Past Performance Questionnaires. (see Attachment 4, Past Performance
Questionnaire) The Offeror will be required to have these sent to the Contracting Officer/Contract Specialist directly from the organization completing the questionnaire.
2) Offerors without a record of relevant past performance or for whom information on past performance is not available or so sparse that there is no meaningful past performance rating can be reasonably assigned; the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.
Factor II. Price/Cost
A Price analysis will be performed to determine the extent, to which it is adequate, reasonable, and realistic in accordance with FAR 15.404-1(b). Through these techniques the government will determine whether prices are fair, reasonable, complete, and balanced. Unreasonably high proposed prices may be grounds for eliminating a quote from the competitive range.
The Government reserves the right to not award this contract to a contractor whose price is unrealistic.
Note 1: To be determined responsible, a prospective contractor must meet FAR 9.104-1 General standards.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. 452.204-70 Modification for Contract Closeout (DEVIATION JUL 2022)
Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to FAR 13:
(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.
(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a Release of Claims be completed by the contractor, although not required for contract and orders using SAP procedures.) If the bilateral modification and Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.

452.228-71 Insurance Coverage (NOV 1996) (Alternate I)
Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:
(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.
(b) General Liability. (1) The Contractor shall have bodily injury liability coverage written on a comprehensive form of policy of at least $500,000 per occurrence. (2) The Contractor shall have property damage liability insurance shall be required in the amount of _______.
(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and 500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.
(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.
Personal Identity Verification of Contractor Employees
(a) The contractor shall comply with the personal identity verification (PIV) policies and procedures established by the Department of Agriculture (USDA) Directives 4620-002 series.
(b) Should the results of the PIV process require the exclusion of a contractor's employee;
the Contracting Officer will notify the contractor in writing.
(c) The contractor must appoint a representative to manage compliance with the PIV policies established by the USDA Directives 4620-002 series and to maintain a list of employees eligible for a USDA LincPass required for performance of the work.
(d) The responsibility of maintaining a sufficient workforce remains with the contractor.
Contractor employees may be barred by the Government from performance of work should they be found ineligible or to have lost eligibility for a USDA LincPass. Failure to maintain a sufficient workforce of employees eligible for a USDA LincPass may be grounds for termination of the contract.
(e) The contractor shall insert this clause in all subcontracts when the subcontractor is required to have routine unaccompanied physical access to a Federally-controlled facility and/or routine unaccompanied access to a Federally-controlled information system.
(f) The PIV Sponsor for this contract is a designated program point of contact, which in most cases is the COR, unless otherwise specified in this contract. The PIV Sponsor will be available to receive contractor identity information from Monday – Friday (07:30AM – 4:30PM), excluding holidays at 444 E. Bonita Avenue, San Dimas, CA 91773. The Government will notify the contractor if there is a change in the PIV Sponsor, the office address, or the office hours for registration; however, it is the contractor's responsibility to meet all aspects of paragraphs (c), (d), and (e).
