(i) This combines the synopsis with the solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, FAR Part 13 and as supplemented with additional information included in this notice to solicit and award a firm fixed price (FFP) stand-alone purchase order. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued.
(ii) This solicitation is issued as a Request for Quotation (RFQ). Paper copies of the RFQ will not be made available. Quotations can be e-mailed to the following e-mail address:
lee.audet@usda.gov to the attention of Lee Drake. NOTE: Quotations must be received by September 17, 2021 0700 CT. Providers of quotes must be registered and have an active status in the System for Award Management (www.sam.gov) to be eligible for award.
(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-06, July 12, 2021.
(iv) This procurement is a 100% small business set-aside. The North American Industry Classification System (NAICS) code for this acquisition is 115310. For this procurement the small business size standard is $8.00

Due to environmental and slope limitations the work we are requesting can only be completed by a Cut to Length (CTL) Harvester and Forwarder. These maybe priced out as a separate line item.
(vi) Description of Requirement and list of attachments
A. The Willis Creek Service Purchase order is part of the 12 Mile NEPA Project located on the San Carlos Ranger District of the San Isabel National Forest, approximately 1.0 mile north of Lake Isabel, Colorado. Land management objectives for the project area are summarized as follows:
1. Improve Forest Health—Provide growing space for healthy trees and reduce fuel loadings.
2. Utilize Timber or other products—Provide fuelwood resources to the public.
3. Reduce hazardous fuels on National Forest System lands.

(viii) 52.212-1 Instructions to Quoters – Commercial Items (JUL 2021) (Provision) Addenda to provision 52.212-1:
Addenda to paragraph 52.212-1(b) Submission of Offers:
1) Quoters must have an active entity registration in the System for Award Management to submit an offer. https://www.sam.gov/SAM/
2) Offers submitted in response to this solicitation shall include a technical quote, a price quote, and contractor representations and certifications.
a) Technical Quote – The technical quote shall address the evaluation factors in 52.212-2. At a minimum technical quote shall include:
i) Past Performance – provide a list of similar projects completed by your firm over the past three years. Include a brief description of the project, dollar amount, year completed, and project owner contact information (name, phone, and email).
ii) Technical Capability – Include the following: Provide a list of equipment and key personnel (with qualifications) that will be used to complete this project.
b) Price Quote – Include the following: 1) the completed price schedule contained in section v of this solicitation, 2) Acknowledge any amendments issued on SAM.gov for this solicitation by completing and signing the posted SF-30,
c) Representations and Certifications – Fill in the check boxes for provisions 52.204-24, 52.212-3, and Employment of Eligible Workers-Workforce Certification found in this solicitation. Copy and paste the completed provisions onto your company letterhead and include your DUNS number.

3) Submit offer by email to lee.audet@usda.gov so that it is delivered into this inbox by the due date and time. Emails should contain 3 separate attachments (Technical Quote, Price Quote, and Representations and Certifications) in Microsoft Word or Adobe PDF format. Be aware that large attachments may increase the time required to deliver an email. (ix) 52.212-2 Evaluation – Commercial Items (OCT 2014) (Provision)
(a) The Government will award a purchase order resulting from this solicitation to the responsible Quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:
1. Technical
Provide a statement relative to your proposed methodology and approach relative to accomplishing the work.
2. Past Performance
Experience working with commercial or federal entities for this specialized survey. The quote must address past performance by providing a list of all major contracts and/or subcontracts completed during the past three (3) years and all contracts and subcontracts currently in process. The list should include, but is not limited to, contracts and subcontracts similar in nature and complexity to that required by this solicitation. Contracts listed should include those entered by the Federal Government, agencies of state and local governments, and commercial customers. Quoters that are newly formed entities, without prior contracts as an entity, should list contracts and subcontracts completed by all key personnel. Include the following information for each contract and subcontract:
a) Name of contracting activity/Firm
b) Contract Number
c) Total contract value
d) Completion date, or stage of completion if still in process
e) Description of Contract work
f) Contracting Officer/Owner with current contact information
3. Price
As contained in section (v) Schedule of Items/Price Schedule.

Technical and past performances, when combined, are approximately equal to Price.
(b) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful Quoter within the time for acceptance specified in the offer, shall result in a binding purchase order without further action by either party. Before the offer’s specified expiration time, the Government may accept a quote (or part of a quote), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

If Quoter Representations and Certifications are not complete in SAM the Quoter shall submit a completed copy of the provision at 52.212-3, Quoter Representations and Certifications- Commercial Items, with your offer. The full provision is available from http://www.acquisition.gov/far/.
If Quoter Representations and Certifications are complete in SAM, the Quoter shall complete the following:
(1) Annual Representations and Certifications. Any changes provided by the Quoter in paragraph (b)(2) of this provision do not automatically change the representations and certifications in SAM.
(2)The Quoter has completed the annual representations and certifications electronically in SAM accessed through http://www.sam.gov. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the dispute’s clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. The Quoter shall not complete the representation at paragraph (d)(1) of this provision if the Quoter has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Quoter Representations and Certifications- Commercial Items. The Quoter shall not complete the representation in paragraph (d)(2) of this provision if the Quoter has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision—
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Quoter shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".
(d) Representation. The Quoter represents that—
(1) It ☐will, ☐will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Quoter shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Quoter responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Quoter represents that—

(a) The Government is planning a pre-bid/pre-quote conference, during which potential Quoters may obtain a better understanding of the work required.
(b) Quoters are encouraged to submit all questions in writing at least five (5) days prior to the conference. Questions will be considered at any time prior to or during the conference;
however, Quoters will be asked to confirm verbal questions in writing. Subsequent to the conference, an amendment to the solicitation containing an abstract of the questions and answers, and a list of attendees, will be disseminated.

Project Title: Willis Creek Tree Thinning
Furnish all necessary materials, equipment, labor, supplies, and incidentals needed to perform the Willis Creek Service Purchase order. The project area is north of Lake Isabel, on NFSR 317. See attached project maps.

General Information
1.0 Background and Purpose
A. The intent of this project is to restore more resilient ecological conditions across the landscape; reduce the impacts of severe wildfires on property, infrastructure, and natural resources; and contribute towards the long-term sustainability of a full range of forest values including creating effective wildlife habitat and protecting aquatic resources.
B. Description of Work—The Willis Creek Service Purchase order is part of the 12 Mile NEPA Project located on the San Carlos Ranger District of the San Isabel National Forest, approximately 1.0 mile north of Lake Isabel, Colorado. Land management objectives for the project area are summarized as follows:
1. Improve Forest Health—Provide growing space for healthy trees and reduce fuel loadings.
2. Utilize Timber or other products—Provide fuelwood resources to the public.
3. Reduce hazardous fuels on National Forest System lands.
2.0 Definitions
Define any acronyms being used; provide both the acronym and the words represented by the acronym. Explain any special terms or phrases used.
(a) Acceptable Quality Level (AQL): The allowable leeway or variance from a standard before the Government will reject the specific service. As long as the percent of defective performance does not exceed the AQL, the service will not be rejected by the Government. The Contractor, however, must re-perform the defective service when possible.
(b) Basal Area: The cross-sectional area of a single stem, including the bark, measured at breast height (4.5
ft. or 1.37 m above the ground. Usually expressed per unit of land acre.
(c) Biobased Products: See Sustainable Acquisitions.
(d) Clean-up: Items may include—slash work, fall leaners and broken tops, seeding, landing obliteration and ripping, temp road obliteration and ripping, construction of cross ditches and water bars, road maintenance, removal of warning signs, removal of equipment from project area, return of Government Furnished Property, designated improvement repair, etc.
(e) CLIN: Purchase order Line Item.
(f) Contracting Officer (CO): Individual with authority to bind the Government with their signature on the Purchase order.
(g) Contracting Officer Representative (COR): Individual(s) designated to act on the behalf of the CO within the delegation given them in writing.
(h) Cut to Length (CTL) Harvesting: A system by which trees are processed into log lengths at the stump before they are carried to a road or landing.
(i) Deck: Pile of logs, typically on a landing. Decks are to be placed along and/or near to US Forest Service system roads as agreed to by USFS and contractor. Decks are not to exceed 5 feet in height in order to accommodate public fuelwood gathering.
(j) Designation by Prescription: A method of timber designation whereby a description of the final outcome of timber cutting is used to prescribe the outcome of stand treatments.
(k) Diameter at Breast Height (D.B.H): The diameter of the tree stem measured at a point 4 ½ feet above the ground level on the uphill side of the tree.
(l) Federal/National Holiday: New Year’s Day, Martin Luther King Jr. Day, Presidents’ Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day.
(m)Forward: To haul a log from the stump to a collection point by a forwarder.
(n) Forwarder: A self-propelled machine, usually self-loading, that transports trees or logs by carrying them completely off the ground.
(o) Forwarder Trail: An access cut through the forest to allow forwarding of logs.
(p) Lop and Scatter--Limbs and tops of cut trees are to be removed from the main trunk so that the material lies within 24" of the ground.
(q) NFSR: National Forest System Road.
(r) Period of performance (also PoP, Performance Period or Purchase order Time): All calendar days allowed for completion of the Purchase order work. Includes all days of the week including weekends and holidays.
(s) Quality Assurance: Those actions taken by the Government to check goods or services to determine that they meet the requirements found in the Purchase order and all attachments listed in Section J.
(t) Quality Assurance Surveillance Plan (QASP): An organized written document used for quality assurance surveillance. The document contains information about how the Government will assess performance, checklists, and may contain decision tables.
(u) Quality Control: Those actions taken by the Contractor to control the production of goods or services so that they will meet the requirements of the Purchase order and all attachments listed in Section J.
Refer to FAR clause(s) 52.246-4—Inspection of Services—Fixed Price and FAR 52.246-12—Inspection of Construction, and Contractors Quality Control Plan.
(v) Quality Control Plan (QCP): Contractor’s plan for self-monitoring work prior to the Government inspection and acceptance.
(w) Random Sampling: A method of looking at a few individual items in a lot to determine the quality of that lot against a standard.
(x) Sawtimber: Included timber meeting the Utilization Specifications.
(y) Slash: Debris created from work under this Purchase order including all cut trees and their tops, trunks, and branches.
(z) (Acceptable) Service: A job performed to the standard and within the AQL. The Contractor must do the specific job, and meet the standard, and meet the AQL before one can say that performance has been acceptable and that the Contractor should be paid.
(aa) Standard: An acknowledged measure of comparison.
(bb) Sustainable Acquisitions: (FAR Part 23.4—Use of recovered materials and biobased products)
(1) Biobased Products: Managed by the U.S. Department of Agriculture (USDA), the goal of the BioPreferred program is to increase the purchase and use of biobased products.
