1.0 GENERAL INFORMATION
1.1 Purpose: The Forest Service seeks to establish pumping services for vault toilet and septic systems and related debris removal at USDA Forest Service managed recreation sites located on the Rogue River Siskiyou Forest as identified in District Vault Site Information Sheet.
The Contractor is to provide services for the removal and disposal of sewage and foreign debris found in the septic/vault toilets that are not classified as sewage, and other incidentals necessary but not mentioned to perform toilet pumping.
1.1.2 Places of Performance:

Base Year January 1, 2026, through December 31, 2026

1.1.4 Contracting Officer’s Representative (COR): A COR may be assigned to this contract to monitor all technical aspects and assist in contract administration. The COR may be authorized to perform the following functions: ensure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communication with the Contractor concerning technical aspects of the contract;
issue written interpretations of technical requirements (without increasing or decreasing contract scope), including Government drawings, designs, and specifications; monitor Contractor's performance and notify both the CO and Contractor of deficiencies; and provide site entry of
Contractor personnel. The COR is not authorized to change any of the terms and conditions of the contract.
2.0 DEFINITIONS
2.1 Clean. “Clean” shall be defined as free of dirt, dust, odors, spots, streaks, stains, smudges, film, discoloration, litter, debris, foreign matter, and other residue or evidence of soil. Any maintenance solution or cleaning product residue that is not an air-dry product shall be removed.
2.2 Contracting Officer (CO). A person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the Contracting Officer acting within the limits of their authority as delegated by the Contracting Officer. "Administrative Contracting Officer (ACO)" refers to a
Contracting Officer who is administering contracts. A single Contracting Officer may be responsible for duties in any or all of these areas. In accordance with 48 CFR chapter 1, Administrative Contracting Officer does not-Require that a duty be performed at a particular office or activity; or Restrict in any way a contracting officer in the performance of any duty properly assigned.
2.3 Contracting Officer’s Representative (COR). The Government employee designated by the Contracting Officer to be responsible for monitoring the Contractor performance.
2.4 Contractor. The term Contractor as used herein refers to both the prime Contractor and any sub-contractor. The prime Contractor shall ensure that his/her sub-contractors comply with the provisions of the contract. The term in this contract refers to the prime.
2.5 GTM: Government Technical Monitor – person who surveys, monitors and inspects work and authorized to place service orders. (No other contract authority).
3.0 PROPERTY
3.1 Government Furnished Property: Not Applicable.
3.2 Contractor Furnished Property: The contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision, and other incidentals necessary to perform toilet pumping services.
3.3 Use of Roads: The Contractor is authorized to use all roads under the jurisdiction of the
Forest Service that are open and necessary for direct route access to the contract work sites for all activities necessary to complete the required services.
4.0 SCHEDULE OF SERVICES
4.1 Order Frequency: These pumping services are needed all year; however the highest needs are during the summer recreation operating season, which is between April 1 through
October 30 annually. Some locations also require services at the end of each season.
Additionally, some toilets are located at winter trailheads and may require winter pumping. Not all sites will be on double lane, paved roads and some could be on single lane, dirt or gravel roads.
The toilets vary in maximum capacity and will be pumped on a “call when needed” basis with
90% of the waste contents removed per standard commercial practices. The contractor shall be responsible for making disposal arrangements including disposal of all sewage and debris, and payment of all fees. All waste shall be disposed of at a commercial treatment facility off
National Forest Lands. Applicable OSHA, State and Local laws and regulations will be followed
The number of sites and frequency of service may be increased or decreased throughout the life of the contract and is subject to the change clause FAR 52.212-4(C) Changes.
4.2 Authorized Callers: Designated Forest Service employees will be identified after award for Only those on the list may place an order for pumping services and any others shall be denied.
5.0 QUALITY CONTROL
5.1 Government Quality Assurance Surveillance Plan: The Government may periodically evaluate the Contractor’s performance by appointing a representative(s) to monitor performance to ensure services are received. The Government representative will evaluate the Contractor’s performance through intermittent on-site inspections of the Contractor’s work.
5.1.1 Unsatisfactory Performance: Nonconformance with any of the specifications will require rework at the Contractor’s expense, to bring the work up to specification standards.
When inspection results are unsatisfactory and the deficiency is correctable, payment will not be made until the deficiency has been corrected.
5.1.2 Rework and Reinspection after Rework: When inspection results are unsatisfactory and the deficiency is correctable, payment will not be made until the deficiency has been corrected. Re-inspection after rework will be made in the same manner as the first inspection but may be at different locations. The Contractor shall pay for inspections necessitated by the rework.
5.1.3 Contractor Quality Control Inspection: The Contractor shall assure themselves that performance meets contract specifications, in accordance with FAR 52.212-4, Contract Terms and Conditions -- Commercial Items, paragraph (a), prior to requesting the Government to inspect for payment or acceptance. The Contractor shall contact the Contracting Officer upon completion of a work area. The Contracting Officer may observe the Contractor’s inspection at any time and shall otherwise have unlimited access to the inspection data.
5.1.4 Landscape Preservation: The Contractor shall give attention to the effect of contract operation upon the landscape, shall take care to maintain natural surroundings undamaged, and shall conduct the work at all times in compliance with the following requirements:
Prevention of the Landscape Defacement. The Contractor shall not remove, deface, injure, or destroy trees, shrubs, lawns, or natural features unless specifically authorized by the
Government. Unless otherwise provided, the Contractor shall confine contract operations to within the areas designated in contract documents. Unless otherwise provided in this contract, the Contractor shall gather rock, which falls outside the roadway due to contract operations and dispose of it as directed, by the Government.
Protection of Streams, Lakes, and Reservoirs. The Contractor shall take sufficient precautions to prevent pollution of streams, lakes, small ponds, and reservoirs with fuels, oils, bitumen, dust palliatives, silt, or other harmful materials. Mechanical equipment shall not be operated in live streams without written approval of the Government. If a petroleum spill should take place in the water, the Contractor shall immediately notify the COR and the Oregon Emergency Response
System (OERS), telephone 1-800-452-0311 or 1-503-378-4124.
5.1.4 Property and Personal Damage: The Contractor shall use every precaution necessary to prevent damage to public and private property. Land monuments and property markers shall not be disturbed until the Contracting Officer, or his/her representative, has witnessed or otherwise referenced their location and directed their removal.
The Contractor shall be responsible for all damage to property and to persons, including third parties, that occur as a result of his/her agent's or employee's fault or negligence. The term "third parties" is construed to include employees of the government.
5.1.5 Trash and Refuse Material: Contractor shall remove all its trash and refuse from the contract area. Material to be removed includes, but is not limited to: chemical containers, used engine oil, oil filters, oil cans, grease cartridges, camp refuse such as tin cans, paper garbage, etc.
All placement of sanitary facilities will require prior approval of the Contracting Officer.
5.1.6 Public Officials not Personally Liable: There shall be no personal liability upon the
Contracting Officer or officer in charge, their agents or employees, for any act performed in the discharge of any duty imposed or the exercise of any power or authority conferred upon them, by, or with the scope of the contract, it being understood that in all such matters they act solely as agents and representatives of the Government.
6.0 INVOICING
6.1 Invoices: A consolidated, detailed invoice shall be submitted monthly which includes all pumping calls/orders in the invoice period. Invoices shall itemize location serviced by date serviced to include gallons pumped, related fees, and total cost of service.
6.2 Invoice Submission: Invoices will be submitted through the department of Treasury’s electronic Invoice Processing Platform (IPP). This is a mandatory requirement initiated by USDA and the

2) Offers submitted in response to this solicitation shall include a technical proposal, a price proposal, and contractor representations and certifications.
a) Past Performance – provide a list of similar projects completed by your firm over the past three years. Include a brief description of the project, dollar amount, year completed, and project owner contact information (name, phone, and email). The government may use past performance information from any available source. If a company does not have past performance information available, information may be provided for predecessor companies, key personnel, or subcontractors. In the event that there is no past performance information available, the offeror will receive a neutral rating in this factor.
b) Price Proposal – Include the following: 1) the completed Schedule of Items of this solicitation, and 2) acknowledgement of any amendments to this solicitation by following the instructions that accompany the amendment(s).
c) The quote will be a fixed firm price and will include ALL fees associated with the service provided. Fixed Firm price rate includes Mileage, removal and disposal of sewage and foreign debris found in the septic systems that are not classified as sewage, charging dry tanks with water, and other incidentals necessary but not mentioned to perform toilet pumping.

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible, Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. (b) Options The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. 52.217-8 Option to Extend Services. (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days of contract expiration.

52.217-9 Option to Extend the Term of the Contract. (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within _30_ provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed _36 (months).

NOTICE FOR FILING AGENCY PROTESTS
United States Department of Agriculture (USDA) Ombudsman Program
The USDA is committed to issuing solicitations and awarding contracts in a fair and prompt manner. The Ombudsman Program for Agency Protests (OPAP) was established to address protest issues within the agency, providing an alternative to costly and time-consuming litigation. Operating independently, OPAP offers relief comparable to that granted by the Government Accountability Office (GAO). Interested parties are encouraged to resolve concerns through USDA’s internal Alternative Dispute Resolution (ADR) process before pursuing external forums such as the GAO. Concerns may be addressed informally or through a formal agency protest filed with either the Contracting Officer or the Ombudsman.
Informal Forum with the Ombudsman
1. Initial Point of Contact: Interested parties who believe a specific USDA procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer.
2. Escalation: If the Contracting Officer is unable to address their concerns, interested parties are encouraged to contact the USDA Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Utilization of the informal forum does not suspend any time requirement for filing a formal protest with the agency or other forums.
3. Required Information: To ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman
1. Effort to Resolve: Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions.
2. Independent Review: If the protester’s concerns remain unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest with either the Contracting Officer or, alternatively, with the Ombudsman under the OPAP program. Contract awards or performance will be suspended during the protest period unless justified in writing for urgent and compelling reasons or determined in writing to be in the best interest of the Government.
3. Resolution Timeline: The agency’s goal is to resolve protests within 35 calendar days from the date of filing.
4. Required Information: Protests shall include the information set forth in FAR 33.104(a)(3). Failure to submit the required information may result in a delay or dismissal of the protest.
5. Timeliness: Protests must be filed within the timeframes specified in FAR 33.104.
6. Submission: Formal protests under the OPAP program should be submitted electronically to SPE.inquiry@usda.gov and the Contracting Officer.
Election of Forum. By initiating a protest with the USDA, the protester agrees not to pursue the same matter with the Government Accountability Office (GAO) or any other external forum while the agency protest is pending. If a protest is filed externally, the agency protest will be dismissed.
