Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed.

This procurement is a solicitation competed in accordance with FAR Part 13 Simplified Acquisition Procedures and FAR Part 36 Construction Contracts, 100% Small Business set aside. Solicitation documentation and any issued amendments will be posted to SAM.gov. This is the only official location where these documents can be obtained and where updates are posted. No ‘hard copy’ solicitation materials are available.

It is the Contractor’s responsibility to ensure the Government is in receipt of the offer by the deadline. Contractors shall not wait till the last minute and assume the email will be received by the Government before the time of closing.
Offerors shall provide all requested information referenced in this section. Failure to provide all requested information will result in the offer being found non-responsive, thus ineligible for award.

OFFER SUBMISSION DOCUMENTS:
1. Transmittal Summary Letter. A summary cover letter to the submission should provide at a minimum the following (i) Identification of the Point of Contact, current phone number, and email address. (ii) Unique Entity Identifier (UEI), CAGE Code, Tax Identification Number (ii) A list of the submission package contents.
2. Fully completed and Signed SF 1442. Original fully completed and signed SF 1442 Offer page, and acknowledgement of all amendments with via entering data in block 19 of the SF1442 or completing blocks 15a, 15b, and 15c of the Amendment and attaching to the SF 1442 offer page. Complete blocks 14, 15, 17, 20a, 20b and 20c. Failure to acknowledge all amendments will result in the offer to be found Non-Responsive and not eligible for award.
3. Bid Schedule Page 4. Complete page 4, B.3 Schedule of Items, filling in the Price for each CLIN.
4. SF 24 Bid Bond. Completed/signed SF 24 Bid Bond. A bid guarantee is required in an amount not less than 20 percent of the proposed price but shall not exceed $3,000,000 (for offers of $35,000 or more). Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening of offers, shall require rejection of the offer in all cases except those listed in Federal Acquisition Regulation (FAR) 28.101-4. Bid Bonds must be provided using Standard Form 24 (see FAR 28.106-1) and be from a corporate surety listed in Department of Treasury Circular 570. Individual sureties have to be acceptable to the Contracting Officer (see FAR 28.203) and be accompanied by Standard Form 28 Affidavit of Individual Surety. Other forms of offer security are acceptable as denoted in solicitation provision FAR Part 28.203-2. 5. Technical Proposal. The offeror shall describe is proposed approach through the use of narrative, in sufficient detail for the Government to understand and evaluate the nature of the approach regarding the contractor’s as required by the Statement of Work. The Technical Proposal shall incorporate the SOW timelines and the standard thresholds to ensure they understand the requirement. The offeror must clearly and concisely demonstrate the following: understanding of the tasks involved in the project; the technical and institutional elements which must be addressed; proposed systems and major pieces of equipment; and any special issues or problems likely to be encountered. The offeror shall also describe how they will manage the project to minimize errors and omissions and ensure incorporation of Government comments, concerns, and feedback. Technical proposal shall comply with SOW paragraph 4.0.
6. Past Performance documentation- Offerors shall provide at least (2) past performance references for federally awarded contracts awarded within the past 3 years. The references must include similar construction projects at a federal facility.

SECTION M - EVALUATION FACTORS FOR AWARD
M.1 EVALUATION METHODOLOGY
The Government shall conduct a source selection using Lowest Priced Technically Acceptable (LPTA). The Government shall award a contract to the responsible offeror who offers the lowest priced that is found to be technically acceptable, as set forth in the solicitation. In order to be considered acceptable, an offeror must conform to the material terms of the solicitation (e.g. contract clauses, specifications, etc). The Government shall not award any contract that does not propose a fair and reasonable price.
The Government intends to select a single contractor; however it reserves the right to award no contract at all, depending on availability of funds and other extenuating circumstances. Award shall be made on an all or none basis. Offerors proposing deviations or alternatives to the solicitation requirements shall be considered non-compliant and not considered for award.
Offer Compliance: Offers will be reviewed for timeliness. If the offer is received after the closing date and does not meet the criteria for “late submissions” in the solicitation, the offer will not be evaluated. The offer will be reviewed for compliance to the solicitation (i.e. submitted all documents required in Section L.9). If the offer is not compliant to the solicitation it will not be evaluated, and the offeror will be notified that they are found to be not-responsible.
1. Timely and compliant offers will be placed in order from lowest to highest price. A technical evaluation is then performed on lowest priced offeror. If the offeror is technically acceptable award is made, if the offeror is not technically acceptable then the next lowest is evaluated. This process is worked until the LPTA offeror is identified.
Offers that are priced higher than the LPTA offer will not be evaluated.
2. A “Technically Acceptable” evaluation will be conducted.
Technically Acceptable offer is defined as:
a. Meeting all requirements as defined in the solicitation, to include offer submission documents referenced in Section L.9 (Including required Bid Guarantee/Bond). Failure to submit ANY of the required document listed in Section L will render your quote non-responsive and thus not eligible for award. Failure to acknowledge any and all amendments will render your quote non-responsive and thus not eligible for award.
b. The Contractor shall provide a plan that address all the aspects identified in Submission Document #5 Technical Proposal. Offerors that fail to address any aspects or the proposed solution is not compatible with the SOW or laws will be found unacceptable. Offers that do not provide a technical proposal that is sufficient to convey to the Government complete understanding, will be found unacceptable. Offers that do not provide details and breakouts of their proposed har barn solution will be rated unacceptable.
c. Site Visit Attendance. Offerors shall attend the Government organized site visit of the construction site. Offerors that do not attend the site visit will be found non-responsive. Offerors must ensure they understand the orientation and layout of the construction site to ensure the offer is generated within reason and context of the worksite.
d. Acceptable rating in “Past Performance”.
Past Performance will be rated on an “acceptable” or “unacceptable” basis. The apparent successful, prospective contractor must have acceptable past performance. System for Award Management (SAM.gov) exclusions list, Federal Awardee Performance and Integrity Information System, and Contractor Performance Assessment Reporting System (CPARS) shall be considered as part of the past performance evaluation process. Any past performance that is found to be “negative”, shall result in the entire Past Performance rating as “Unacceptable”.
“Negative” is defined as any CPARS past performance evaluation rated less than “Satisfactory” for any rating category, any Terminations for Default/Cause, or any negative performance references will be rated as ‘Unacceptable’. Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the
Osvaldo.Rodriguez Cross-Out offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.” The Past Performance submitted under offer submission document L.9 (6) shall be similar to the requirements of this project in terms of type of work performed and level of complexity. Offers that do not meet this threshold for past performance will be rated “Unacceptable” in Past Performance.
The Government reserves the right to use past performance information obtained from sources other than those identified by the offeror, including but not limited to past performance information located in the Contractor Performance Assessment Reporting System (CPARS). Past performance is a measure of the degree to which an offeror satisfied its customers in the past, complied with contract schedule, and adherence to the contract specifications. Past performance is also a measure of the risk of performance associated with the offeror. The Government will assess the offeror’s record of past performance on similar contracts as an indicator of success under this requirement.
An individual evaluation rating of “Unacceptable” for any of the factors shall result in an overall “Unacceptable” rating for Technical Acceptability.
Price. The Government shall evaluate this factor for all CLINS to assess the offeror’s proposed price submitted in the Schedule B. (ROUND OFFER PRICE FOR EACH CLIN TO THE NEAREST DOLLAR AMOUNT, DO NOT PROVIDE CENTS). Price will not be assigned an adjectival rating. The Government will award a contract to an offeror whose technically acceptable offer represents the lowest price to the Government. The Government shall not award a contract that does not propose a fair and reasonable price.
