FEDERAL ACQUISITION REGULATION (48 CFR CHAPTER 1)

52.217-5 Evaluation of Options (JUL 1990)

Basis of Award and Evaluation of Task Order Proposal

Task Order Offerors shall enter a price for all sub-items. There will be one award from this solicitation.

The Government will issue a task order off the IDIQ Trail Construction and Services Contracts for the Colville National Forest as a result of this Request for Task Order proposals to the responsible task order offeror whose proposal is determined to be the “best value” to the Government considering both price, past performance and technical factors listed below:

The task order offeror will be evaluated on technical criteria to determine the strengths and weaknesses in the proposals and if the proposals meet the solicitation requirements. The information will be used to determine the best value (trade off value) for this requirement. The proposals will not be ranked. The technical submittal shall be incorporated by reference and become a binding part of the resulting task order. This criteria comprises the offeror’s:

Past Performance. The Government will review past performance on quality of service, customer satisfaction, timeliness of performance, cost control and business relations.

Technical Approach and Proposed Construction Schedule of Work and Mobilization Plan for the Project. Evidence of understanding the project requirements to include, but not limited to, proposed dates of ordering and receiving materials; coordinating with subcontractors; project milestones;

sequence of construction; what equipment the Contractor will use on the project and how it will meet the contract requirements; how the Contractor’s moblization plan will move equipment and other materials to the sites, and the realism of the construction schedule. The technical approach including the schedule of work and mobilizatiaon plan must provide evidence of understanding the project requirements.

Benefits to Local Community. The funding source for this project is retained receipts which states it is to benefit local economies by providing local employment or training opportunities through contracts for restoration planning, design, implementation or monitoring. The Government will look at how the

Contractor is commitment to recruiting, training and higher local residence (may also be done by subcontracting) or how award to the Contractor will benefit the local community (Stevens County).

Use of Biobased Items on this Task Order. The Government will look at how the Contractor will use Biobased products if any on this task order and the dollar value. If the Contractor doesn’t plan on using any, they should state a reason why.

Technical approach and construction schedule is the most important technical factors.

Past performance and technical factors are of equal importance.

Price and Cost:

The Government will also look at Cost and Price which includes considering the cost/price information entered in the schedule of items. It is the Government’s intent to determine reasonableness and the offeror’s understanding of the work and the ability to perform the contract / task order.

Note: The Government will be using the pricing information on this project for the award determination on the base IDIQ contracts.

Evaluation: FAR Part 15 will not be used in determining award; past performance and technical proposals will not be ranked.

The Contractor’s technical proposal will be reviewed to determine if it meets the Government’s requirement and to determine the strengths and weaknesses if any. After review of the technical proposals, the Government will do a comparative analysis in determining the best value (trade off value) to the Government.

Price is approximately equal to all technical factors combined. Award will be made to that offeror

(1) whose proposal meets the technical requirements of the solicitation and (2) whose technical/cost relationship is the most advantageous to the Government.

The critical factor in making any cost/technical trade-off is not the spread but, rather, the significance of the differences of the task order proposals. The significance of the spread will be determined on the basis of what the difference might mean in terms of performance, strenghts and weaknesses of the proposals, and what it would cost the Government to take advantage of it. Award may not necessarily be made for technical capabilities that would appear to exceed those needed for the successful performance of the work. The Government reserves the right to make cost/technical trade-offs that are in the best interest and advantageous to the Government.

The Government may reject any or all offerors, issue orders to other than the lowest offeror, and waive minor informalities or irregularities in offerors received, or elect to not award at all. If necessary, the Government may conduct discussions.

The Government may issue an order on the basis of task order proposal as received, without entering into discussions with any offeror(s). The initial proposal should contain the offeror’s best terms and must speak directly to the evaluation factors listed.

The Government will perform a price realism evaluation to review prices to determine whether the offeror lacks the technical understanding; task order proposals may be rejected on the basis of low prices.

The Government may request a price verification from any offeror. If the offeror fails to respond in two days to the notice, the Government may elect not to look at the proposal any further the task order proposal will not be considered for award.

Any work resulting from this Request for Task Order Proposals shall be covered by an Award Document.

Price Range: The Government's estimate is: between $25,000 and $100,000.
