Definitions
Definitions. The following definitions apply to this contract:
Construction Limits — The limits on each side of the project that establish the area disturbed by operations and beyond which no disturbance is permitted. The construction limits are from the toe of the fill slope to the top of the cut slope.
Contract — The written agreement between the Government and the Contractor setting forth the obligations of the parties for the performance of and payment for the prescribed work.
Contracting Officer (CO) — An official of the Government with the authority to enter into, administer, and terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the CO acting within the limits of their authority as delegated by the CO.
Free Draining — A slope that will drain water without pooling or causing erosion of the slope.
Material — Any substances specified or necessary to satisfactorily complete the contract work.
Measurement — The process of identifying the dimensions, quantity, or capacity of an item.
Pay Item — A specific item of work for which a unit and price is provided in the contract.
Plans/Drawings — The contract plans and drawings furnished by the Government showing the location, type, dimensions, and details of the work.
Roadway — In general, the portion of a road, including shoulders, for vehicular use.
Schedule of Items--A schedule in the contract that contains a listing and description of work items, quantities, units of measure, methods of measurement, unit price, and amount.
Slope notation (vertical : horizontal). For slopes flatter than 1V:1H, express the slope as the ratio of one unit vertical to a number of units horizontal. For slopes steeper than 1V:1H, express the slope as the ratio of a number of units vertical to one unit horizontal. Slopes can be expressed as percentages.
Specifications — The written requirements for performing work.
Work — The furnishing of all labor, material, equipment, and other incidentals necessary to successfully complete the project according to the contract.
Responsibilities of the Contractor
Intent of Contract The intent of the contract is to provide for the completion of the work described. The precise details of performing the work are not stipulated except as considered essential for the successful completion of the work. Furnish all labor, material, equipment, tools, transportation, and supplies necessary to complete the work according to the contract.
Laws to be Observed Comply with all permits and agreements obtained by the Government for performing the work that is included in the contract. Obtain all additional permits or agreements and modifications to Government-obtained permits or agreements that are required by the Contractor's methods of operation. Furnish copies of all permits and agreements.
Comply with all legal load restrictions when hauling material and equipment on public roads to and from the project. A special permit does not relieve the Contractor of liability for damage resulting from the moving of material or equipment.
The contractor shall be responsible for all damages to persons or properties that occur as a result of the contractor’s fault or negligence.
Contractor's Responsibility for Work Assume responsibility for all work until final acceptance. This includes periods of suspended work.
Protect the work against injury, loss, or damage from all causes whether arising from the execution or nonexecution of the work.
Rebuild, repair, restore, and make good all losses, injuries, or damages to any portion of the work.
This includes losses, injuries, or damages caused by vandalism, theft, accommodation of public traffic, and weather that occurs during the contract.
The Government will only be responsible for losses, injuries, and damages to work put in place that was caused by declared enemies and terrorists of the Government and cataclysmic natural phenomenon such as tornadoes, earthquakes, major floods, and other officially declared natural disasters. The Government will only be responsible for costs attributable to repairing or replacing damaged work. The Government will not be responsible for delay costs, impact costs, or extended overhead costs.
Material and Workmanship All equipment, material, and articles incorporated into the work covered by this contract shall be new and of the most suitable grade for the purpose intended, unless otherwise specifically provided in this contract. All material and articles that do not require prior approval shall be placeed or used at the risk of subsequent rejection if the material does not meet the specification in this contract.
All work under this contract shall be performed in a skillful and workmanlike manner. The CO may require, in writing, that the contractor remove from the work any employee the CO deems incompetent, careless, or otherwise objectionable.
Protection and Restoration of Property and Landscape Preserve public and private property, and protect monuments established for the purpose of perpetuating horizontal, vertical, cadastral, or boundary control. When necessary to destroy a monument, reestablish the monument according to applicable state statute or by the direction of the agency or individual who established the monument.
Do not excavate, remove, damage, alter, or deface any archeological or paleontological remains or specimens. Control the actions of employees and subcontractors on the project to ensure that protected sites are not disturbed or damaged. Should any of these items be encountered, suspend operations at the discovery site, notify the CO, and continue operations in other areas. The CO will inform the Contractor when operations may resume at the discovery site.
Sanitation, Health, and Safety.
Observe rules and regulations of Federal, State, and local health officials. The contractor shall provide and maintain work environments and procedures which will safeguard the public and Government personnel, property, materials, supplies, and equipment exposed to contractor operations and activities. Do not permit any worker to work in surroundings or under conditions that are unsanitary, hazardous, or dangerous.
Admit any OSHA inspector or other legally responsible official involved in safety and health administration to the project work site upon presentation of proper credentials.
Report accidents on forms furnished by the Government or, with prior approval, on forms used to report accidents to other agencies or insurance carriers. Maintain a "Log of Work Related Injuries and Illnesses," OSHA Form 300, and make it available for inspection.
Place a reverse signal alarm audible above the surrounding noise level on all motorized vehicles having an obstructed view and on all earth-moving and compaction equipment.
Measurement and Payment
Measurement of Work Take and record measurements and perform calculations to determine pay quantities for invoicing for work performed. Take or convert all measurements of work according to United States customary measure.
Unless otherwise specified, measure when the work is in place, complete, and accepted. Measure the actual work performed within the construction limits.
Submit measurement notes bi-weekly to the CO for approval and payment. For lump sum items submit documentation to support invoiced progress payment. When work is not complete, identify the measurement as being an interim measurement. Submit the final measurement when all work completed.
Measurement Terms and Definitions.
The Measurement Subsection of each Section of work designates the type of measurement for the work. The Schedule of Items relates the type of measurement and the estimated quantity of work.
The following defines the terms used:
(a) Acre. 43,560 square feet. Make longitudinal and transverse measurements for area computations horizontally unless specified on the ground surface.
(b) Each. One entire unit. The quantity is the actual number of units completed and accepted.
(c) Cubic yard. Compute the quantity using the average end areas multiplied by the horizontal distance along a centerline or reference line between the end areas. Deduct any quantity outside the designed or staked limits.
(d) Linear foot. As applicable, measure the work along its length from end-to-end; parallel to the base or foundation; along the top; along the front face; or along the invert. Do not measure overlaps.
(e) Hour. Measure the actual number of hours ordered by the CO and performed by the Contractor.
(f) Lump sum. Do not measure directly. The bid amount is complete payment for all work described in the contract necessary to complete the work for that item. The quantity is designated as "All."
(g) Mile. 5,280 linear feet. Measure horizontally along the centerline of each roadway.
Scope of Payment. Payment for all contract work is provided, either directly or indirectly, under the pay items shown in the schedule of items.
(a) Direct payment. Payment is provided directly under a pay item shown in the schedule of items.
(b) Indirect payment. Work for which direct payment is not provided is a subsidiary obligation of the Contractor. Payment for such work is indirectly included under other pay items shown in the schedule of items.
Work measured and paid for under one pay item will not be paid for under any other pay item.
All quantities shown in the contract are approximate unless otherwise stated in that section. Limit pay quantities to the quantities staked, ordered, or otherwise authorized before performing the work. Payment will be made for the actual quantities of work performed and accepted or material furnished according to the contract. No payment will be made for work performed in excess of that staked, ordered, or non-authorized.
Mobilization
Description This work consists of moving personnel, equipment, material, and incidentals to the project and performing all work necessary before beginning work at the project site. Mobilization includes the obtaining of permits, insurance, and bonds.
All temporary or portable signs shall be included as a subsidiary item to section 151. Signs and sign placement shall meet the requirements of the Section H of this contract and the “MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES” (MUTCD). Work on the project shall not be started until all required signs are in place and approved by the C.O.
Removal and replacement of road closure devices such as concrete barriers or earth barriers to gain access to the project shall be included as incidental to Mobilization.
Work also includes cleaning of all equipment used at the project site. Clean all equipment prior to entry on the project site. Remove all dirt, plant parts and material that may carry noxious weed seeds into the area. Only equipment inspected by the Forest Service will be allowed to operate within the project area. Treat subsequent move-ins of equipment the same as the initial move-in.
Clean truck beds and dump boxes hauling to the project site prior to entering the work area.
Measurement Measure mobilization according the items listed in the schedule of items and the Measurement and Payment Section.
Payment The accepted quantity, measured as provided in the Measurement and Payment Section, will be paid at the contract price per unit of measurement for Mobilization pay item shown in the schedule of items. Payment will be full compensation for the work prescribed in this Section.
Progress payments for mobilization lump sum will be paid as follows:
(a) Bond premiums will be reimbursed according to FAR Clause 52.232-5 Payments Under Fixed-Price Construction Contracts, after receipt of the evidence of payment.
(b) When 5 percent of the original contract amount is earned from other bid items, 50 percent of the mobilization item, or 5 percent of the original contract amount, whichever is less, will be paid.
(c) When 10 percent of the original contract amount is earned from other bid items, 100 percent of the mobilization item, or 10 percent of the original contract amount, whichever is less, will be paid.
(d) Any portion of the mobilization item in excess of 10 percent of the original contract amount will be paid after final acceptance.
Roadway Obliteration
Description This work consists of the reclamation of roadways by the removal of culverts; decompaction and outsloping of subgrade; placeation of waterbars and leadoff ditches; restoration of stream channels;
and seeding, revegetation, and mulching of all disturbed areas. In addition work includes diverting of live streams, pumping, bailing, draining, sheeting, bracing, and other miscellaneous items required for execution of the work.
Roadway reclamation methods are designated as follows:
(a) Method 1. Obliterate the roadway by restoring to approximate original ground contours.
Decompact road surfaces. Remove all pipes, bridges, and other structures and all associated fill material, down to “natural ground” or as shown on the drawings. Keep excavated material within the original roadway construction limits. Finish slopes to provide gradual transitions in slope adjustments without noticeable breaks. Effectively close access to area by recontouring or placement of slash.
Work Requirements Conform to the following when obliterating roads by either method.
ACCESS: All roads used for access to work shall be maintained to prevent any erosion or roadway degradation using inslope/outslope, waterbars, closures or as described in the Work Lists or as directed by the C.O.
EXCAVATION: After required decompaction of the roadway the fill material shall be pulled up and placed on roadbed between the top of cut and original ground forming a slope approximating natural contours or 20% as designated. No ditches, water traps, or berms shall remain. Finish to the lines shown on the plans blending to the surrounding terrain.
DECOMPACTION: Any hardened road segment or surface area shall be decompacted to promote water infiltration and establish vegetation. This work shall consist of loosening all of the soil in the existing roadbed or landing surface to a depth of 18 inches and a clod size no larger than 10 inches or as shown on the plans.
OUTSLOPING: Roads and landings shall be outsloped by decompacting the surface as specified above and by pulling the fill shoulder towards the cut bank as shown in the plans.
Excavated material shall be spread over the roadbed or landing. The finished grade shall be a sloping surface across the existing roadway to the grade specified on the drawings and shall be a free draining. Any existing ditches at the toe of the cutslope shall be ripped and filled with the material excavated during outsloping. Any berms remaining along the upper or lower edges of this work shall be blended with the surrounding terrain. All other berms, tracks, and other surface irregularities shall be reshaped to allow a free draining surface.
DRAINAGE EXCAVATION: Drainage excavation shall include the removal of all fill and bedding material, the restoration of the natural channel and blending of sideslopes. Stream channel width and dimensions after drainage structures have been removed shall be the same as the undisturbed width and dimensions above or below the crossing. An approximately uniform grade shall be created from natural ground above the inlet to natural ground below the outlet to facilitate a free draining channel for the entire length unless otherwise noted on the worklists.
Excavated material shall be incorporated in the adjacent areas while maintaining “natural slopes”. If live water is encountered a stream grade channel or a cross drain channel is needed.
REMOVAL OF STRUCTURES: Remove all drainage structures (culverts, downpipe, anchors, drop inlets, and trash racks, log culverts etc.). Remove all existing gates and barriers on the project road also. All items removed, except log culverts, shall become the property of the contractor and be removed from government land and recycled or disposed of in a legal manner. The material or structure designated for removal shall include it and all of its appurtenances and hardware. Material from log drainage structures can be used as slash placement on recontoured roadway outside of channels.
VEGETATION REMOVAL: This work shall consist of clearing, grubbing, removing and disposing of vegetation. Vegetation includes dead woody debris, trees, stumps, roots and other vegetation within the limits of the project area necessary to be cleared for access to the project sites, covering areas designated for excavation or embankment, and woody material generated from excavations. Vegetation shall be preserved and placed on top of recontoured road segments and completed channel side slopes in stable positions not interfering with stream channel flow. The disturbed area shall be 50% to 75% covered with natural slash when available from roadway. Excess material will be windrowed along the bottom edge of the original roadway construction limits with breaks for game passage every 200’. A walkable trail shall be left along the upper edge. Disturbed vegetation shall not be left "hung-up" in remaining live vegetation.
CLUMP PLANTING: Clump planting from available vegetation along the clearing limits shall be completed throughout the recontouring at a minimum of 6 plantings per 100 lineal feet.
This will be accomplished with an excavator and the clump shall be of sufficient size to maintain all the root system and contain adequate soil to enhance favorable growth. Duff material shall be scraped from above the top of the cutslope and scattered along the completed recontoured road. This duff material may consist of a combination of needles, organic material, plants, decomposing stumps and logs.
Channels and Structures.
Place the following as shown in the drawings when noted on the work lists or directed by the C.O.
STREAM GRADE CHANNELS (SGC): These are either live stream channels or draw crossings. Removal of all fill material and recontouring to the original natural contours is required.
A pipe will be required for crossing live streams while accessing the project. If there is no existing culvert a temporary one will be required before proceeding.
Stream Diversions or dewatering is required while work is being done in the channel. These may be done with pipes, open ditches or check dams. The intent is to minimize the amount of erosion during work.
Place temporary sediment dams instream below all work using straw bales. Place bales in channel below high water, breaking bales if necessary to provide a tight fit. After channel restoration, remove trapped sediment from stream and place above high water. Break bales and spread wet straw on the adjacent slopes.
Live streams will require a minimum of two grade control structures. Wider crossings may require more, using a 20’ maximum spacing. These are usually formed with rocks as shown on the plans. Logs may be substituted as long as shape and elevation can be maintained.
Channel slopes shall be stabilized with slash, straw mulch. Transplant forbs and sedges along the channel slopes.
No material will be placed in the channel bottom that would divert stream and cause erosion.
DRIVEABLE WATERBAR: Place temporary driveable waterbars as shown on the drawings.
Place on all cleared access roads and as described in work lists or as directed by the CO to prevent surface erosion during the working period. When the access road is to remain the waterbars are to be placed as permanent.
CROSS DRAIN CHANNELS (CDC): These are areas where springs or seeps in the cutslope are evident or noted. Remove the fill material below the slope but do not place the excavated material in seep or spring. Create a channel to provide drainage onto natural ground as shown on the drawings. The slope of the banks shall be a minimum of 3:1. Transplant forbs and sedges along the channel slopes and in the channel bottom. Place wetland vegetation in strips across the bottom of the CDC at 4-8’ spacing to encourage subsurface flow.
Vegetation mats consist of spongy wetland plants and vegetation collected in long strips with the excavator bucket from nearby wetlands or ditchlines and spread in bucket wide widths perpendicular across the CDC or drainage at 4’ to 8’ spacing. These encourage percolation and subsurface flow.
GRADE CONTROL STRUCTURES: Place Grade Control Structures at live water crossings as shown on the drawings. Place as directed above and when noted on the work lists or as directed by the C.O.
Soil Erosion Control.
This work consists of furnishing, placeing, and maintaining permanent and temporary erosion and sediment control measures to minimize erosion and sedimentation during and after work according to the contract permits and this Section.
When working adjacent to live water or streams a buffer of vegetation, a brush barrier, or straw dike will be maintained to prevent direct sedimentation to the stream.
Store and handle material to preserve its quality and fitness for the work. The Contractor is responsible for the security of all stored material.
Straw bales. Provide 10 straw bales from a certified noxious weed free source. Furnish bales tied with either commercial quality baling wire or string. Conform to the following:
(1) Approximate length 3.5 feet
(2) Shape rectangular
(3) Approximate mass 70 pounds
Use straw bales and brush barriers for filtering sediment from runoff and reducing the velocity of sheet flow. Conserve brush from clearing operations to form brush barriers.
Maintain temporary erosion control measures in working condition until the project is complete.
Restore the ground to its natural or intended condition and provide permanent erosion control measures when temporary measures are no longer needed. Clean erosion control measures when half full of sediment. As work in the area is completed the bales shall be broken and the straw spread as a mulch.
Soil erosion control measures will be evaluated by visual inspection of the work for compliance with the contract. Contractor must provide certification of weed free materials. Work may be rejected at any time if it does not to comply with the contract.
Seed and Mulch This work consists of seeding the full length and width of the decompacted roadway and all other disturbed areas. Hand-operated seeding methods are satisfactory on areas inaccessible to mechanical equipment.
Store and handle material to preserve its quality and fitness for the work. The Contractor is responsible for the security of all stored material.
Conform to the Federal Seed Act, the Federal Noxious Weed Act, and applicable State and local seed and noxious weed laws. Do not use wet, moldy, or otherwise contaminated or damaged seed.
Apply seed to all disturbed areas within 10 calendar days of soil disturbance.
"Furnish the kinds of seed and the amounts to be applied in terms of pure live seed as follows:

Determine the pounds of seed to be furnished per acre by dividing the pounds of pure live seed required per acre by the product of the percent purity and percent germination.
Example: 5 lbs. pure live seed/acre = 6.5 lbs. commercial seed per acre
0.90 x 0.85 purity = 90% and germination = 85%
Seed is estimated using a standard average of 4 acres/mile (or 140 lbs/mile). This project has estimated about 5 acres to seed. This is an estimate only and Contractor is responsible for full coverage and any additional mileage.
Apply seed by the dry method. No fertilizer shall be used.
Acceptance Roadway obliteration will be evaluated based on visual inspection of the work for compliance with the contract. Work may be rejected at any time if it does not comply with the contract.
Measurement Measure the Roadway Obliteration items as listed in the schedule of items according to the Measurement and Payment Section.
Payment The accepted quantities will be paid at the contract price per unit measurement for the Road Obliteration pay items listed in the schedule of items. Payment will be full compensation for the work prescribed in this Section.
Rental Equipment
Description This work consists of furnishing and operating equipment for work ordered by the CO not otherwise provided for under the contract.
Rental Equipment.
Hydraulic Excavator with Thumb. Provide a track mounted hydraulic excavator, 1990 model year or newer. Bucket must be equipped with a hydraulic "thumb". An excavator of a size equivalent to a CAT 320 is required for the project. Contractor shall get approval for use of each excavator from the Contracting Officer prior to any work taking place.
Dump Truck. Provide a dump truck with a minimum capacity of 10 cubic yards.
Make equipment available for inspection and approval before use. Furnish and operate equipment with such auxiliary attachments, oilers, etc., as are usually needed for efficient operation of the equipment. Keep the equipment in good repair and capable of operating 90 percent of the working time.
Obtain approval of the length of workday and workweek before beginning work. Keep daily records of the number of unit-hours of operation. Submit the records along with certified copies of the payroll.
Acceptance.
Rental equipment work will be evaluated based on visual inspection of the work for compliance with the contract. Work may be rejected at any time if it does not comply with the contract.
Measurement Measure the Rental Equipment items as listed in the schedule of items according to the Measurement and Payment Section and the following as applicable.
Round portions of an hour up to the next half hour. Measure time in excess of 40 hours per week at the same rate as the first 40 hours.
Do not measure time for moving equipment between project work sites. Do not measure nonoperable equipment or equipment dependent upon another piece of nonoperable equipment.
Payment Only quantities approved by the CO shall be accepted under this contract. The accepted quantities will be paid at the contract price per unit of measurement for the Rental Equipment pay item listed in the schedule of items. Payment will be full compensation for the work done in this Section.
