104.06 Use of Roads by Contractor.

The Contractor is authorized to use roads under the jurisdiction of the Forest Service for all activities necessary to complete this contract, subject to the limitations and authorizations designated in the Road Order(s) or described in the contract, when such use will not damage the roads or national forest resources, and when traffic can be accommodated safely.

106 - Acceptance of Work

106.01_National_11_9_2016

Delete Subsection 106.01 and replace with the following:

106.01 Conformity with Contract Requirements.

Follow the requirements of FAR Clause 52.246-12 Inspection of Construction.

References to standard test methods of AASHTO, ASTM, GSA, and other recognized standard authorities refer to the methods in effect on the date of solicitation for bids.

Perform all work to the lines, grades, cross-sections, dimensions, and processes or material requirements shown on the plans or specified in the contract.

Incorporate manufactured materials into the work according to the manufacturer’s recommendations or to these specifications, whichever is more strict.

Plan dimensions and contract specification values are the values to be strived for and complied with as the design values from which any deviations are allowed. Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons.

When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be considered to be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted.

The Government may inspect, sample, or test all work at any time before final acceptance of the project. When the Government tests work, copies of test reports are furnished to the Contractor upon request. Government tests may or may not be performed at the work site. If Contractor testing and inspection is verified by the Government, the Contractor’s results may be used by the Government to evaluate work for acceptance. Do not rely on the availability of Government test results for process control.

Acceptable work conforming to the contract will be paid for at the contract unit bid price. Four methods of determining conformity and accepting work are described in Subsections 106.02 to 106.05 inclusive. The primary method of acceptance is specified in each Section of work. However, work may be rejected at any time it is found by any of the methods not to comply with the contract.

Remove, repair, or replace work that does not conform to the contract, or to prevailing industry standards where no specific contract requirements are noted. Removing, repairing, or replacing work; providing temporary traffic control; and any other related work to accomplish conformity will be at no cost to the Government.

(a) Disputing Government test results. If the accuracy of Government test results is disputed, promptly inform the CO. If the dispute is unresolved after reasonable steps are taken to resolve the dispute, further evaluation may be obtained by written request. Include a narrative describing the dispute and a proposed resolution protocol that addresses the following:

1. Sampling method;

2. Number of samples;

3. Sample transport;

4. Test procedures;

5. Testing laboratories;

6. Reporting;

7. Estimated time and costs; and

8. Validation process.

If the evaluation requires additional sampling or testing be performed, mutually agree with the Government on witnessing procedures and on sampling and testing by a third party laboratory. Use a third party laboratory accredited by the AASHTO accreditation program. Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed Government test results or that produced the test results used as a basis for the dispute.

The CO will review the proposed resolution protocol and may modify it before final approval and execution.

The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated, the

Government will be responsible for all costs associated with developing and performing the resolution protocol.

If the validity of the Government test results cannot be determined, the Contractor and Government will equally share all costs associated with developing and carrying out the resolution protocol.

(b) Alternatives to removing and replacing non-conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to:

1. Have the work accepted at a reduced price; or

2. Be given permission to perform corrective measures to bring the work into conformity.

The request must contain supporting rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. The CO will determine disposition of the nonconforming work.

106.02_National_11_9_2016

Delete Subsection 106.02 and replace with the following:

106.02 Visual Inspection.

Acceptance is based on visual inspection of the work for compliance with the specific contract requirements. Use prevailing industry standards in the absence of specific contract requirements or tolerances.

C-4 DAKOTA PRAIRIE GRASSLANDS SPECIAL PROJECT SPECIFICATIONS

301. — UNTREATED AGGREGATE COURSES

Description

301.01 This work consists of constructing one or more courses of aggregate on a prepared surface.

Material

301.02 Provide certified weed free aggregate surfacing conforming to NDDOT Class 13 specifications.

Construction Requirements

301.03 General. Prepare the surface on which the aggregate course is placed according to Section 303. Obtain written approval by the CO of the roadbeds a minimum of forty-eight (48) hours before placing aggregate.

301.04 Mixing and Spreading. Add water as necessary to obtain optimum moisture. Mix the aggregate and adjust the moisture content to obtain a uniform mixture. Spread and shape the mixture on the prepared surface in a uniform layer. Route hauling equipment uniformly over the full width of the surface to minimize rutting or uneven compaction.

301.05 Compacting. Compaction shall be carried out simultaneously with laydown operations. Blade the surface of each layer during the compaction operations to remove irregularities and produce a smooth, even surface. The compacted depth of a single course shall not exceed 6 inches. All equipment shall be operated to produce uniform density throughout the entire section. Pneumatic-tired rollers of the type specified below shall be used. The desired degree of compaction will be acceptable when the surface is tightly bound and shows no rutting or displacement under roller operation with no fewer than three passes. A pass shall consist of one complete coverage of the surface.

A. Pneumatic-Tired Rollers.

1. General.

Use rollers equipped with at least 7 wheels with pneumatic tires of equal size and ply. Arrange tires to provide complete coverage of the area the roller travels. Submit the data used to determine the contact pressures for the full range of the manufacturer’s recommended wheel loads and tire inflation pressures. Do not vary individual tire pressures more than 5 psi from the other tires on roller.

Use rollers that can be loaded to a gross weight of at least 225 pounds per inch of compaction width.

DPG SPS 301 (2/19)

Provide the empty and ballasted weights by:

– Weighing the roller if it has been modified from its original design or if the ballast weight is unknown; and

– Use manufacturers weight ratings if the roller has not been modified and ballast weight is known.

2. Tow-Type Pneumatic-Tired Rollers.

Operate rollers with tire inflation pressures and wheel loads as specified by manufacturer.

3. Self-Propelled Pneumatic-Tired Rollers.

Equip rollers with:

– Positive and accurate steering control;

– Smooth-tread tires;

– Close-fitting scrapers for each wheel; and

Start, stop, and reverse direction smoothly without jerking or backlash.

Do not use wobble-wheel rollers.

Operate rollers with contact pressure between 40 to 90 psi. Contact pressure is the average ground contact pressure, expressed in psi, obtained when the wheel load in pounds is divided by the gross contact area in square inches of the tire.

For the compaction method, blade the surfaces of each layer during the compaction operations to remove irregularities and produce a smooth surface.

301.06 Surface Tolerance

Shape the surface to the required template and check the surface with a 10-foot straightedge. Defective areas are surface deviations in excess of ½ inch in 10 feet between two contacts of the straightedge with the surface.

Correct defective areas by loosening the material, adding or removing material, reshaping, and compacting.

Thickness and Width requirements: The contractor shall be required to perform four (4) Quality Control thickness and width checks on the compacted aggregate per ½ mile. The results of thickness and width checks shall be provided to the COR no later than 48 hours from the completion of each mile. Any thickness and width checks falling below the requirements shall require additional thickness and width checks be taken to determine the area that needs additional material. The additional thickness and width checks and additional material to bring the compacted thickness or width into specification shall be the responsibility of the contractor with no additional cost to the government.

The maximum variation from the compacted specified thickness is ½ inch. The compacted thickness shall not be below the specified thickness. The compacted thickness is not consistently above or below the specified thickness and the average thickness of 4 random measurements for any ½ mile of road segment is within + ¼ inch of the specified thickness. The maximum variation from the specified width will not exceed

+12 inches at any point. The compacted width shall not be below the specified width. The compacted width is not consistently above the specified width and the average of any four random measurements along any

½ mile of road segment is within +4 inches of the specified width.

301.07 Maintenance. Maintain the aggregate course to the correct line, grade, and cross-section by blading, watering, rolling, or combination thereof until placement of the next course. Correct defects according to Subsection 301.06.

301.08 Acceptance. Submit test results of 3 Aggregate Gradation and Quality tests per 10,000 cubic yards of production and a Certificate of Compliance verifying that aggregate gradation meets contract requirements. The sampling shall not be considered a final acceptance and shall not preclude later sampling and testing after final processing of the material. Such sampling does not relieve the contractor of responsibility of providing quality control measures to ensure compliance with contract requirements.

Construction of untreated aggregate courses will be evaluated under Subsections 106.02 and 106.04. The COR shall approve the physical characteristics and quality of the materials before placing on the road.

Measurement

301.09 Measure the Section 301 pay items listed in the bid schedule according to Subsection 109.02 and the following as applicable: The quantity of 301 in the Schedule of Items is compacted in place on the road. Loose quantity loaded, hauled, placed and compacted shall include such additional material necessary to overcome the compaction effort.

Contractor shall take precautions in loading of aggregate from stockpiles to prevent segregation of material.

Payment

301.10 The accepted quantities will be paid at the contract price per unit of measurement adjusted according to

Subsection 106.05 for the Section 301 pay items listed in the bid schedule. Payment will be full compensation for the work prescribed in this Section. See Subsection 109.05.

303 – ROAD RECONDITIONING

303.01 This work consists of scarifying, or reshaping an existing roadway, finish blading the road including shoulders, compacting, and maintaining the subgrade, in order to obtain the original cross section and grade of the road before constructing a surface course.

Construction Requirements

303.02 Roadway Reconditioning. Mow the shoulders. Scarify the sod to a minimum of 6” depth. Disk, till or work the sod into particle sizes less than 3” in largest dimension and re compact on the road. Remove ruts, washes, slough, and other irregularities that prevent normal runoff from the road surface and shape to a uniform surface. Repair soft and unstable areas by placing backfill material in horizontal layers not exceeding 6 inches in compacted thickness. Compact the subgrade of the road according to Subsection 301.05. After finish blading, the road will have been bladed shoulder to shoulder and end to end and will be free of berms on both sides. The road will have ruts/potholes cut out, and will be crowned or graded to drain (2%-6% from centerline). Shape the road to the required typical section. Blade and shape the roads when moisture content is suitable for compaction.

303.03 Acceptance. Road reconditioning work will be evaluated under Subsections 106.02 and 106.04. Obtain approval of the final subgrade surface before placing base or surface material.

Measurement

303.04 Measure the Section 303 items listed in the Schedule of Items according to Subsection 109.02.

Payment

303.05 The accepted quantities will be paid at the contract price per unit of measurement for the Section 303 pay items listed in the bid schedule. Payment will be full compensation for the work prescribed in this Section. See
