IMPORTANT – NOTICE TO ALL PROSPECTIVE QUOTERS
Quotes shall be emailed to the Contracting Officer, Gwen Boyle at Gwendolynn.Boyle@usda.gov, by the closing date and time stated on the SF-1449.
The Contractor shall complete/submit the following as part of its quote:
1. SF 1449, Blocks 17a (including Unique Entity ID (UEI)) and 30a-30c;
2. Fill in the appropriate information requested in B, Schedule of Item and C.14, Contractor Authorized Signatures; and
3. Provide supporting documents to Section E.1 - 52.212-1 Instructions to Offerors, in conjunction with Sections E.5 - 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment, E.6 - 52.204-26 Covered Telecommunications Equipment or Services-Representation, and E.8 - 52.212-3 Offeror Representations and Certifications – Commercial Products and Commercial Services.
This solicitation neither commits the Government to pay any cost incurred in the submission of the quote or in making necessary studies or designs for preparing the quote, nor to contract for services or supplies. Any cost incurred in anticipation of a task order shall be at the Contractor’s own risk.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

C.7 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

“Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to FAR Part 13.
(a) If unobligated funds in the amount of $1000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.
(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. (The CO may also request a Release of Claims be completed by the contractor, although not required for contract and orders using SAP.) If the bilateral modification and Release of Claims are not returned to the CO within 60 days, the CO shall release the modification as unilateral and proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.”
C.10 48 CFR 452.224-70 CONFIDENTIALITY OF INFORMATION (FEB 1988)
(a) Confidential information, as used in this clause, means -
(1) information or data of a personal nature, proprietary about an individual, or

(2) information or data submitted by or pertaining to an organization.
(b) In addition to the types of confidential information described in (a)(1) and (2) above, information which might require special consideration with regard to the timing of its disclosure may derive from studies or research, during which public disclosure of primarily invalidated findings could create an erroneous conclusion which might threaten public health or safety if acted upon.
(c) The Contracting Officer and the Contractor may, by mutual consent, identify elsewhere in this contract specific information and/or categories of information which the Government will furnish to the Contractor or that the Contractor is expected to generate which is confidential. Similarly, the Contracting Officer and the Contractor may, by mutual consent, identify such confidential information from time to time during the performance of the contract. Failure to agree will be settled pursuant to the “Disputes” clause.
(d) If it is established that information to be utilized under this contract is subject to the Privacy Act, the Contractor will follow the rules and procedures of disclosure set forth in the Privacy Act of 1974, 5 U.S.C. 552a, and implementing regulations and policies, with respect to systems of records determined to be subject to the Privacy Act.
(e) Confidential information, as defined in (a)(1) and (2) above, shall not be disclosed without the prior written consent of the individual, institution or organization.
(f) Written advance notice of at least 45 days will be provided to the Contracting Officer of the Contractor's intent to release findings of studies or research, which have the possibility of adverse effects on the public or the Federal agency, as described in (b) above. If the Contracting Officer does not pose any objections in writing within the 45 day period, the Contractor may proceed with disclosure. Disagreements not resolved by the Contractor and Contracting Officer will be settled pursuant to the “Disputes” clause.
(g) Whenever the Contractor is uncertain with regard to the proper handling of material under the contract, or if the material in question is subject to the Privacy Act or is confidential information subject to the provisions of this clause, the Contractor shall obtain a written determination from the Contracting Officer prior to any release, disclosure, dissemination, or publication.
(h) The provisions of paragraph (e) of this clause shall not apply when the information is subject to conflicting or overlapping provisions in other Federal, State or local laws.

C.12 WHISTLEBLOWER RIGHTS AND REPRISAL PROTECTION
Whistleblowers perform an important service to USDA and the public when they come forward with what they reasonably believe to be evidence of wrongdoing. They should never be subject to reprisal for doing so. Federal law protects federal employees as well as personal services contractors and employees of Federal contractors, subcontractors, grantees, and subgrantees against reprisal for whistleblowing. USDA bears the responsibility to ensure that nothing in a non-disclosure agreement which a contractor, subcontractor, grantee, or subgrantee requires their employees to sign should be interpreted as limiting their ability to provide information to the Office of Inspector General (OIG).
41 U.S.C. § 4712 requires the head of each executive agency to ensure that its contractors inform their workers in writing of the rights and remedies under the statute.
Accordingly, it is illegal for a personal services contractor or an employee of a Federal contractor, subcontractor, grantee, or subgrantee to be discharged, demoted, or otherwise discriminated against for making a protected whistleblower disclosure. In this context, these categories of individuals are whistleblowers who disclose information that the individual reasonably believes is evidence of one of the following:
• Gross mismanagement of a Federal contract or grant;
• A gross waste of Federal funds;
• An abuse of authority relating to a Federal contract or grant;
• A substantial and specific danger to public health or safety; or
• A violation of law, rule, or regulation related to a Federal contract (including the competition for or negotiation of a contract) or grant.

To be protected under 41 U.S.C. § 4712, the disclosure must be made to one of the following:
• A Member of Congress, or a representative of a committee of Congress;
• The OIG;
• The Government Accountability Office (GAO);
• A Federal employee responsible for contract or grant oversight or management at USDA;
• An otherwise authorized official at USDA or other law enforcement agency;
• A court or grand jury; or
• A management official or other employee of the contractor, subcontractor, or grantee who has the responsibility to investigate, discover, or address misconduct.
Under 41 U.S.C. § 4712, personal services contractors as well as employees of contractors, subcontractors, grantees, or subgrantees may file a complaint with OIG, who will investigate the matter unless they determine that the complaint is frivolous, fails to allege a violation of the prohibition against whistleblower reprisal, or has been addressed in another proceeding. OIG’s investigation is then presented to the head of the executive agency who evaluates the facts of the investigation and can order the contractor, subcontractor, grantee, or subgrantee to take remedial action, such as reinstatement or back pay.
Federal Acquisition Regulation (FAR) Subpart 3.903, Whistleblower Protections for Contractor Employees, Policy, prohibits government contractors from retaliating against a contract worker for making a protected disclosure related to the contract. FAR Subpart 3.909-1 prohibits the Government from using funds for a contract with an entity that requires its employees or subcontractors to sign internal confidentiality statements prohibiting or restricting disclosures of fraud, waste, or abuse to designated persons.
This prohibition does not contravene agreements pertaining to classified information.
The regulation also requires contracting officers to insert FAR clause 52.203-17, Contractor Employee Whistleblower Rights and Requirement to Inform Employees of Whistleblower Rights, in all solicitations and contracts that exceed the Simplified Acquisition Threshold as defined in FAR Subpart 3.908. This clause requires notification to contractor employees that they are subject to the whistleblower rights and remedies referenced in 41 U.S.C. § 4712.

EXTENSION OF BLOCK 20, SCHEDULE OF SUPPLIES/SERVICES.
(a) Background
Smokejumpers travel all over the United States, including Alaska, to provide highly trained, experienced firefighters and leadership for quick initial attack on wildland fires in remote areas. Firefighting tools, food, and water are dropped by parachute to the firefighters after they land near the fire making them self-sufficient for the first, forty-eight (48) hours.
The U.S. Forest Service (USFS) made the determination to convert from the mix of round parachutes and Ram-Air parachutes, in its smokejumper program, to one that consists solely of Ram-Air parachutes. In December 2011 and updated in 2015, the USFS adopted a Change Management and Implementation Guide.
The USFS completed a Change Management and Implementation Plan (V3) to guide this transition from the round parachute system to exclusive use of the USFS Ram-Air parachute system.
(b) Period of Performance
The anticipated term of the purchase order (PO) shall be from 1 October 2023 through 30 September 2024, and one, six-month option, in accordance with FAR 52.217-8, with an ultimate end date of 29 March 2025.
(c) Scope
(1) Complete an external review, analysis, and evaluation of the USFS Smokejumper Program’s change management and transition processes for the Ram-Air parachute transition and the current state of the program in the Ram-Air parachute transition to ensure future operational success. The Safety Management Systems (SMS) approach shall be utilized throughout the review, analysis, evaluation, and recommendation(s) of work performed under this purchase order. (i) Government-provided and Contractor-collected information and data pertaining to the direction and processes of the Ram-Air transition including, but not limited to, agency and program specific policy, manuals, guides, plans, and other documents.
(ii) Initial and recurring training programs for first year smokejumpers (rookies), round to Ram-Air transition, and Ram-Air only smokejumpers.
(iii) Site visits and field observations of program functional areas.

(iv) Meetings and interviews with key personnel to include, but not limited to: National Smokejumper Program Manager (PM), Ram Air Training Lead, Ram Air SMS Lead, Base Managers, Trainers, and Trainees.
(2) Provide technical advice and recommendation(s) to the agency to include, but not limited to:
(i) Operational procedures and equipment
(ii) Training practices and procedures
(iii) Policy, manuals, guides, and publications
(iv) Change management implementation guides, plans and documents
(v) Internal program reports and reporting
(3) The USFS Smokejumper Program had an interagency memorandum of understanding (MOU) agreement with the Bureau of Land Management (BLM) Smokejumpers during the early years of the transition. This may require the Contractor to interview BLM smokejumper personnel that were involved in training and consultation with the USFS Smokejumper Ram-Air Transition SME’s for broad context in the development of the Ram-Air program.
(4) The review will produce a final report with findings and recommendations to the Contracting Officer (CO), USFS Branch Chief Fixed Wing Operations, and Smokejumper PM.
(d) Document and Data Review
(1) Conduct an analysis of Government-provided or Contractor-collected smokejumper information and data as it pertains to the direction and processes of the Ram-Air transition.
(2) Evaluate Agency provided manuals, reports, USFS Ram-Air Transition Operations Plans, Ram-Air Change Management and Implementation Plan, Interagency Smokejumper Pilot Operations Guide (ISPOG), Interagency Smokejumper Operations Guide (ISMOG), and related information for gaps to identify and propose improvements or changes. Proposed improvements or changes shall:
(i) Detail the issue and provide reason for the change(s).
(ii) Organizational level responsible for the change(s).
(iii) Expected outcomes and performance measures of the change(s).
(3) Review all Facilitated Learning Analysis (FLA)/Accident reports related to the Smokejumper Program for the USFS, major accident reporting system (MARS) database, and Parachute Landing Injury database from 1992 to present. This
D-3 shall include both pre-Ram Air transition and Ram Air transitional periods of the USFS. Compile a summary of trends, findings, and identify commonalities.
(e) Meetings, Site Visits, and Field Observations
(1) Initial Program Review and Coordination
The Contractor shall attend a post-award meeting in Boise, Idaho (ID) no later than fourteen (14) days after purchase order award. This meeting shall establish points of contact, deliver initial program documentation, brief site and field visit protocols, ensure effective communication, and clarify scope and scale of the project. This meeting shall be coordinated with the CO and Smokejumper PM.
(2) Scheduled and Unscheduled Meetings
(i) The Contractor may be required to participate in or attend scheduled and unscheduled meetings, workshops, audits, inspections, and agency reviews. Bilateral, purchase order modifications shall be initiated for unplanned and unscheduled meetings.
(ii) Specific tasks may require workshops with Fire and Aviation Management (FAM) subject matter experts (SME) to develop and document the models, direction, analysis, and systems for use in the USFS Smokejumper Program.
(iii) Contractor may be requested to facilitate workshops, as deemed necessary by the Government. A bilaterally-signed, purchase order modification(s) shall be issued to account for this situation(s).
(3) Site Visits
(i) The intent of the site visits is to obtain information through observation, interaction and exposure to base operations and training events. Each base identified, below, is currently in different phases of the Ram-Air transition. A minimum of three (3) smokejumper bases and the National Technology and Development Program (NTDP) office shall be encompassed in the review:
(A) NTDP in Missoula, Montana. The intent is to understand the role and history of the parachute system transition as the NTDP specialists work towards next generation parachute systems, smokejumper equipment, and quality assurance of current systems.
(B) Missoula, Montana
(C) McCall, Idaho
(D) Redmond, Oregon

(ii) Up to two (2) site visits at each location is authorized for up to five (5) days per visit. Additional site visits may be authorized by the Government upon written request.
(4) Field Observations
(i) Field observations may take place in inclement weather, steep and or rugged terrain, or in the proximity of wildfires. The locations may require the Contractor to hike no more than two (2) miles in rugged terrain for observations.
(ii) Training and recurrency. Field observations may take place at or near smokejumper bases. Contractor to arrange own transportation.
