SUBJECT: Request for Proposal (RFP) FA910125RB007, AAFB Local Telecommunications Services (LTS) Follow-on

This is a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with (IAW) the format in Federal Acquisition Regulation (FAR) subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested, and a written solicitation will not be issued.

This combined synopsis/solicitation is not an authorization to begin performance, and in no way obligates the Government for any costs incurred by the offeror associated with developing an offer. The Government reserves the right to cancel this solicitation prior to or after the closing date. The Government reserves the right not to award a contract in response to this RFP. The Government will not reimburse Offerors for any costs incurred in developing a proposal for this requirement or in the event the Government cancels this solicitation. Prior to commencement of any activities associated with performance of this requirement, the Government will issue a written directive or contractual document signed by the Contracting Officer with appropriate consideration established.

The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular, FAC 2024-07 dated 29 August 2024, Department of Defense Federal Acquisition Regulation Supplement (DFARS) Change 9/16/2024 effective 16 September 2024, and Department of the Air Force Federal Acquisition Regulation Supplement (DAFFARS) Change 10/16/2024, effective date 16 October 2024.

Request for Proposal FA910125RB007 is being competed full and open and is NOT set-aside.

SUBJECT TO THE TERMS AND CONDITIONS STATED HEREIN, THE OFFER AGREES TO HOLD ITS

PROPOSED PRICES FIRM FOR 120 DAYS.

The North American Industry Classification System (NAICS) code for this acquisition is 517810, All Other Telecommunications, with a size standard of $40,000,000.00. The Product Service Code (PSC) is DG11, Information Technology (IT) and Telecom-Network Access Services.

The purpose of this solicitation is for the Government to obtain a firm-fixed-price, five-year, indefinite delivery, indefinite quantity (ID/IQ) type contract for essential local area telecommunication services (LTS) and features supporting Arnold Engineering Development Complex (AEDC) and AAFB 24 hours a day, seven days a week, 365 days a year (24/7/365), in accordance with Attachment 1 – LTS Performance of Work (PWS). If an award results from this combined synopsis/solicitation, it is the intent of the Government to award an indefinite-delivery, indefinite quantity (IDIQ) basic contract. An initial task order will be issued under the basic IDIQ. The estimated ordering period is 23 January 2025 through 22 January 2030. The ordering period for the basic IDIQ will be negotiated at the time of award. The Period of Performance (PoP) for the initial task order and any subsequent task orders will be negotiated individually.

A list of contract line item numbers (CLINs), descriptions of requirements for the services to be acquired, quantities, units of measure, estimated ordering period dates, places of delivery, places of acceptance, and Free on Board (FOB) point are detailed below.

The offeror shall identify any exceptions to the RFP’s clauses, terms, and conditions with supporting rationale. The Government reserves the right to determine any such exceptions as unacceptable. Any exception determined unacceptable by the Government may result in the offer being determined unacceptable and ineligible for award. If no exceptions are taken, include a statement stating so with the offer.

Please provide the following with your offer:

1. Statement affirming all work will be performed, fulfilled, and completed in accordance with the PWS (RFP Attachment 1).

2. Completed “Staffing Approach Worksheet” (RFP Attachment 2).

3. Completed “Initial Task Order Pricing Worksheet” (RFP Attachment 3).

FAR Provision 52.212-1, Instructions to Offerors – Commercial Products and Commercial Services (Sep 2023) applies to this acquisition and the following addendum applies:

Paragraph (a) first sentence revised as follows: “The NAICS code and small business size standard for this acquisition appear above.”

Paragraph (c) first sentence revised as follows: “The offeror agrees to hold the prices in its proposal firm for 120 calendar days from the date specified for receipt of proposals, unless another time period is specified in an addendum to the proposal.”

The applicability of the provision at 52.212-2, Evaluation-Commercial Products and Commercial Services, and the specific evaluation criteria to be included in paragraph (a) of that provision.

In accordance with the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services, offerors are advised to include a completed copy of their Annual Representations and Certifications with their offer. All offerors must be registered in the System for Award Management (SAM) at https://www.sam.gov/portal/public/SAM/ to be eligible for award. The Government will not provide contract financing for this acquisition. Invoice instructions are provided in Clause 252.232-7006 Wide Area WorkFlow Payment Instructions below

FAR clause at 52.212-4, Contract Terms and Conditions-Commercial Products and Commercial Services (Nov 2023), applies to this acquisition with the following Addendum: Paragraph (c) of this clause is tailored as follows:

Note: The offeror acknowledges that should the quoted terms and conditions and/or agreement conflict with mandatory provisions of the Federal Acquisition Regulation (FAR) and other Federal law applicable to commercial acquisitions, to the extent of such conflict the FAR and Federal law govern and conflicting offeror terms and conditions and/or agreement are unenforceable and are not considered incorporated into any resultant contract.

FAR clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Products and Commercial Services (May 2024), is applicable to this acquisition. For the FAR clauses cited in FAR clause 52.212-5 that are applicable to this acquisition, refer to the pages below for Contract Clauses and Provisions.

While essential, these services are not rated in the Defense Priorities and Allocations System (DPAS).

Basis of Award:

The Government anticipates an IDIQ contract will be awarded in accordance with FAR Part 13 and its supplements.

The anticipated IDIQ will not be subject to FAR 15.3 procedures. Should a contract award be made under this RFP, the award will follow the procedures outlined in FAR Part 13, as supplemented.

Contract award may be made if an apparently successful offeror is determined responsible IAW FAR subpart 9.1 as supplemented and if the offeror’s proposal conforms to the RFP’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by the RFP instructions).

A. The following factors shall be used to evaluate offeror’s proposal: Factor 1 – Technical Acceptability, and Factor 2 – Price.

Factor 1: Technical Acceptability

Under this factor the Government will evaluate the offer’s Technical Acceptability based on the following measures of merit:

1. The Offeror provides a complete proposal with pricing for all CLINs.

2. The Offeror provides service specifications indicating compliance with Attachment 1 – Performance of Work.

Unacceptable The proposal does not meet all technical elements identified in the PWS for Factor 1.

Factor 2 – Price

Offeror’s proposed labor hour rates should be provided in Attachment 3 – Initial Task Order Pricing Worksheet and should support the proposed Factor 1 ‐ Technical Acceptability. Offeror’s proposed labor hour rates will be evaluated (but not rated).

Offeror’s Initial Total Evaluated Price (I‐TEP) will be calculated as the sum of the total price for each CLIN provided in Attachment 3 – Initial Task Order Pricing Worksheet. After any interchanges, if necessary, the

Government will evaluate the Final TEP (F‐TEP). If interchanges do not occur, the I‐TEP will become the F‐TEP.

The F-TEP be evaluated in terms of completeness and reasonableness.

Applicable definitions are outlined below:

Completeness – The offeror’s F-TEP will be reviewed to determine the extent to which all the price elements have been addressed. The offeror’s proposal will be evaluated to ensure continuity and traceability of prices to the technical proposal and between the initial offer and any revisions. The review will determine the adequacy of the offeror’s proposal in addressing and fulfilling the RFP requirements.

Reasonableness - For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. The Government will determine prices fair and reasonable through the use of one or more of the price analysis techniques at FAR 13.106-3(a)(2).

B. Information obtained from sources available to the Government will be used as part of the responsibility determination made IAW FAR 9.104-1. The Government reserves the right to obtain information relative to present and past performance on its own.

As prescribed in 232.7004(b), use the following clause:

WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (JAN 2023)

(a) Definitions. As used in this clause-

"Department of Defense Activity Address Code (DoDAAC)" is a six position code that uniquely identifies a unit, activity, or organization.

"Document type" means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

"Local processing office (LPO)" is the office responsible for payment certification when payment certification is done external to the entitlement system.

"Payment request" and "receiving report" are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall-

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the "Web Based Training" link on the WAWF home page at https://wawf.eb.mil/

(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:

(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.

(ii) For fixed price line items-

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. 52.216-18 Ordering. (Aug 2020)

As prescribed in 16.506(a), insert the following clause:

Ordering (Aug 2020)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 23 January 2025 through 22 January 2031[insert dates].

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) A delivery order or task order is considered "issued" when-

(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;

(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or

(3) If sent electronically, the Government either-

(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or

(ii) Distributes the delivery order or task order via email to the Contractor's email address.

(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.
