About this file

This is a Compensation Model exhibit for the Harris County Toll Road Authority (HCTRA) delinquent toll account recovery and management services contract, detailing the fee structure and payment terms for responding firms. The compensation model is organized into two stages: Early-Stage Administrative Hearings and Late-Stage Administrative Hearings, Litigation, and Post Judgment services. Early-stage services include collection letters at $1.55 per account (estimated 500,000 accounts), set hearings at $0.25 per account (500,000 accounts), and pre-hearing resolution and payment contingency at $500.00 per account (10,000 accounts). Late-stage services encompass prosecuted or settled hearings at $10.00 per hearing (estimated 10,000 hearings), lawsuits at $15.00 per lawsuit (3,000 lawsuits), and resolution and payment contingency at $500.00 per account (10,500 accounts).

All compensation is contingent upon the actual collection of delinquent accounts, with firms receiving only the fees actually accrued rather than the stated maximum amounts. Case expenses are reimbursable up to $50.00 per case for litigation support services including private servicers, skip-tracing, certified mail, and filing fees, subject to a standing agreement with HCTRA that may be modified at any time. Attorney's fees must be pre-approved by HCTRA before being pleaded in any filed case, and firms retain all awarded and paid attorney's fees including post-judgment accrued fees when collected. All fee sharing and accrual is subject to and limited by maximums established by Harris County Commissioners Court in the Toll Setting Policy approved in 2023.
