About this file

This is a Domestic Partnership Act Certification form required by Broward County, Florida for vendors bidding on contracts valued over $100,000. The certification serves dual purposes: establishing vendor responsiveness to the solicitation requirements and determining eligibility for a domestic partnership tiebreaker advantage in competitive bidding. Vendors must complete and return the form either with their initial bid submittal or within three business days of the County's request to avoid being deemed nonresponsive. For the related Port Everglades 2025 Air Emissions Inventory and Reduction Planning contract, this certification requirement applies given the anticipated contract value exceeds the $100,000 threshold.

The Domestic Partnership Act, codified in Broward County Code of Ordinances Sections 16-150 through 16-165, requires compliant vendors to provide benefits to registered domestic partners of employees on the same basis as spousal benefits, with limited exceptions. Vendors must certify one of four compliance positions: current compliance, future compliance by contract award, non-compliance, or eligibility for an exception based on employee count (fewer than five employees), lack of employee benefits, organizational type (governmental, nonprofit, or religious entities), or federal/state law conflicts. The certification form is dated September 9, 2024, and requires authorized vendor signature, printed name, title, and date to be considered valid for bid evaluation purposes.
