About this file
This is a Traffic and Safety Control attachment document for the Portsmouth Public Schools grounds maintenance contract in Virginia. The document establishes the contractor's responsibilities for accident prevention and safety management at the work site. The contractor must designate a qualified, responsible member of their organization, typically the superintendent unless otherwise designated in writing, to oversee accident prevention and safety protocols. The contractor assumes full responsibility for initiating, maintaining, and supervising all safety precautions and programs related to the work performance.
The contractor must take all reasonable precautions to protect employees, citizens, pedestrians, motorists, other contractors, and adjacent properties including trees, shrubs, lawns, walkways, pavements, fences, roadways, structures, and utilities. The contractor is responsible for preserving all public and private property along and adjacent to the work site and must exercise due caution to prevent damage or injury resulting from the contractor's operations. All trees, shrubs, groundcovers, fences, warning signals, and street signs require adequate protection and cannot be removed or disturbed without Portsmouth Public Schools permission. Should any damage or injury occur as a result of the contractor's act, omission, neglect, or misconduct, the contractor must restore the affected property to its pre-damage condition at the contractor's expense within ten days, or Portsmouth Public Schools may deduct repair costs from amounts owed to the contractor. The contractor is further required to indemnify the owner, agents, and employees against claims brought by the contractor's employees, subcontractors, or any parties directly or indirectly employed by them.
