Hillsborough County Southeast County Landfill Industrial Pretreatment Permit No. 0022 Leachate Treatment and Reclamation Facility Expiration Date November 30, 2027

SECTION 1 - FACILITY DESCRIPTION & EFFLUENT LIMITATIONS

1.1 The Hillsborough County Southeast Landfill is run by the Solid Waste Management Division (SWMD). The Southeast County Landfill (SELF) facility is located 8.8 miles east of US Highway 301 on CR672 in Hillsborough County, Florida. The facility is a Class I Landfill, having approximately 196.9 total acres of total disposal area. The facility includes a landfill gas collection system, a leachate disposal system and a Leachate Treatment and Reclamation Facility. Southeast Leachate Treatment and Reclamation Facility treats raw leachate generated in the Southeast County Landfill. Raw leachate from the landfill is pumped into containment sumps which discharges to a holding tank. The raw leachate is pumped from the holding tank and processed through the onsite treatment facility. Treated leachate is held in the effluent storage tank. The treated effluent is spray-irrigated onto the landfill or is hauled off site for disposal. Raw leachate and effluent are transported off-site by hauling contractors to private disposal locations permitted by the Florida Department of Environmental Protection (FDEP). At the time of this permit issuance, the SELF facility has a contract in place to haul 118,000 GPD of leachate to approved off-site disposal locations. The off-site hauling contract capacity must be utilized before permission will be granted to discharge to Water Resources Division (WRD) facilities.

Emergency authorization may be granted to dispose of the leachate to WRD facilities upon written approval as detailed in Section 1.4 of this permit. The raw leachate and effluent may be transported by hauling contractors to the Hillsborough County Public Utilities wastewater pump station or the Hillsborough Heights connection, to be disposed of at either the Valrico or South County Advanced Wastewater Treatment Facility (AWWTF).

The Leachate Evaporator at the SELF facility was completed during August 2021, with a capacity of 48,000 GPD, the evaporator is expected to generate approximately 2,750 gallons per day of residual and SWMD disposes of this residual in the landfill.

The SELF facility includes a biosolids composting facility which uses the Modified Static Aerobic Pile (MSAP) process. The MSAP method involves forming windrows of the mixed feedstocks, adding the Harvest Quest catalyst to the surface of the pile and capping each windrow with a layer of ground green waste or unscreened finish compost. The composting operation covers approximately 15 acres is adjacent to the west-northwest of Section 7 through 9 landfill footprint. The active composting is kept within a covered building area and the contact stormwater runoff is pumped to on-site storage tanks and is hauled off to a private wastewater treatment facility. The 37,000 ton/year biosolids composting and yard trimmings facility operates on a covered building on-site.

The Ash Processing Area is located on top of the landfill on 4.6 acres surrounded by an earthen berm. This project began in October 2017. Ash generated from waste burning activities from the Hillsborough County Resource Recovery facility is delivered to the landfill to be screened and processed as construction material.

Contact stormwater generated from the Ash Processing Area is considered “raw leachate” for the purposes of this permit and is pumped to Pond B. This contact stormwater is pumped to the onsite leachate treatment plant and is either discharged through spray irrigation or hauled off.

This industry employs 16 employees at the time of this permit issuance.

(This space was intentionally left blank.)

The permittee shall also furnish, upon request, copies of records required to be kept by this permit.

4.12 DUTY TO RE-APPLY - If the permittee desires to continue to discharge after the expiration of this permit, the permittee shall re-apply on the application forms then in use at least sixty (60) days before this permit expires. Under no circumstances shall the permittee continue to discharge after the expiration of this permit.

4.13 DUTY TO REPORT CHANGED CONDITIONS - The permittee shall report to the Director prior to the introduction of new wastewater or pollutants or any substantial change in the volume or characteristics of the wastewater being discharged into the POTW from the Permittee’s industrial processes.

4.14 EXTENSIONS - This permit may be extended only with the written permission of the Director.

4.15 FALSIFYING INFORMATION - Knowingly making any false statement on any report or other document required by this permit or knowingly rendering any monitoring device or method inaccurate, is a crime and may result in the imposition of criminal sanction and/or civil penalties.

4.16 INSPECTION AND ENTRY - The permittee shall allow the EVSD or any authorized representative, upon the presentation of credentials and other documents as may be required by law, to:

1. Enter upon the permittee's premises where a regulated facility or activity is located or conducted, or where records must be kept under the conditions of this permit;

2. Have access to and copy, at reasonable times, any records that must be kept under the conditions of this permit;

3. Inspect at reasonable times any facilities, equipment (including monitoring and control equipment), practices, or operations regulated or required under this permit;

6. Enter upon a permittee's premise where an effluent source is located, during business and non-business hours, when a condition of emergency exists due to a process upset or discharge which may cause harm to the WRD's wastewater treatment facilities or process, or to the health or welfare of the community.

4.17 LIMITATION ON PERMIT TRANSFERS- Permits are issued to a specific permittee for a specific operation, or discharge at a specific location. A permit shall not be reassigned or transferred or sold to a new owner, new permittee, different premises, or a new or changed operation without the approval of the Director.

1. Permittees wishing to transfer their permits must give at least thirty (30) days advance notice to the

Director.

2. The notice must include a copy of a written agreement between the transferor and the transferee which:

a. States that the new owner has no immediate intent to change the facility's operations and processes;

b. Identifies the specific date on which the transfer is to occur;

c. Acknowledges full responsibility for complying with the existing permit.

3. The Director, within ten (10) working days of receiving the permit transfer request, will respond to the parties in writing. In the event the Director denies the request, the new owner/operator must submit a permit application in accordance with the County's Industrial Wastewater Discharge Regulation and may not introduce industrial wastewater into the POTW until the new final permit is received.

4.18 NON-COMPLIANCE - In the event the permittee is unable to comply with any of the conditions of this permit due to a breakdown of pretreatment facilities, process upset, emergency conditions or the occurrence of a spill, the permittee shall immediately notify the Director of such occurrence. In addition, the permittee shall provide the Director with the following information in writing within five (5) days after commencement of such occurrence:

1. Description of the discharge and the cause of noncompliance;

2. Anticipated time the condition of noncompliance is expected to continue, or if such conditions have been corrected, the duration of the period of noncompliance;

3. Steps taken by the permittee to reduce and eliminate the non-complying discharge;

4. Steps to be taken by the permittee to prevent recurrence of the condition of noncompliance.

The permittee shall give advance notice to the Director ninety (90) days prior to any planned changes in the permitted facility or activity which may result in noncompliance with permit requirements.

A documented and verified operating upset shall be an affirmative defense to any enforcement action brought against the permittee for violations attributable to the upset event. However, depending upon the nature and extent of the violation, fines may still be assessed.

4.19 NOTICE OF VIOLATION (NOV) – Any violation of pretreatment requirements, including but not limited to discharge limits, sampling, analysis, reporting, and meeting compliance schedules, and regulatory deadlines, shall be considered as noncompliance for which the permittee is liable for enforcement, including penalties.

4.20 NOTIFICATION OF CHANGED DISCHARGE - The permittee shall promptly notify the Director, in advance of any change in the volume or character of pollutants in their discharge that may result in pass through or interference to the POTW.

4.21 PERMIT ACTION - This permit may be modified, revoked and reissued, or terminated for good causes including, but not limited to, the following:

1. To incorporate any new or revised federal, state, or local pretreatment standards or requirements;

2. Material or substantial alterations or additions to the discharger's operational processes, or discharge volume or character which were not covered in the effective permit; Significant changes include, but are not limited to flow increases of 20% or greater, and the discharge of any previously unreported pollutants;

3. A change in any condition that requires either a temporary or permanent reduction or elimination of the authorized discharge;

4. Information indicating that the permitted discharge poses a threat to the WRD's collection and treatment systems, POTW personnel or the receiving waters;

5. Violation of any terms or conditions of this permit;

6. Misrepresentation or failure to disclose fully all relevant facts in the permit application or in any required reporting;

7. Revision of or a grant of variance from such Categorical Standards pursuant to 62-625.700 F.A.C.;

8. Upon request of the permittee, provided such request does not create a violation of any existing applicable requirements, standards, laws or rules and regulations;

9. To correct typographical or other errors in the permit;

10. To reflect transfer of the facility ownership and/or operation to a new owner/operator.

The filing of a request by the permittee for a permit modification, revocation and re-issuance, or termination, or a notification of planned changes or anticipated noncompliance, does not stay any permit condition.

4.22 PERMIT APPEALS - The permittee may petition to appeal the terms of this permit within thirty (30) days of receipt of the issued permit.

This petition must be in writing. Failure to submit a petition for review shall be deemed to be a waiver of the appeal. In the petition, the permittee must indicate the permit provisions objected to, the reasons for this objection, and the alternative condition, if any, the permittee seeks to be placed in the permit.

The effectiveness of this permit shall not be stayed pending reconsideration by the EVSD Permit Review Committee (Committee). If, after considering the petition and any arguments put forth by the Director, the Committee determines that reconsideration is proper, the Committee shall send the permit back to the Director for re-issuance. Those permit provisions being reconsidered by the Director shall be stayed pending re-issuance.

4.25 PROPER OPERATION AND MAINTENANCE - The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of this permit. Proper operation and maintenance includes but is not limited to: effective performance, adequate funding, adequate operator staffing and training and adequate laboratory and process controls, including appropriate quality assurance procedures.

This provision requires the operation of back-up or auxiliary facilities or similar systems only when necessary to achieve compliance with the conditions of the permit. Bypass of treatment facilities is prohibited except as provided for and in accordance with the requirements set forth by this permit.

4.26 PROPERTY RIGHTS - The issuance of this permit does not convey any property rights of any sort, or any exclusive privileges, nor does the permit authorize any injury to private property or any invasion of personal rights, nor any violation of federal, state or local laws or regulations.

4.27 PUBLIC NOTIFICATION OF VIOLATORS - The permittee is apprised that noncompliance with this permit may lead to an enforcement action and may result in publication of its name in an appropriate newspaper in accordance with this section. Permittees classified as being in Significant Noncompliance (SNC) shall be required to notify the public by publishing the violation in the largest newspaper with general circulation.

4.28 RECOVERY OF COSTS INCURRED - In the event the discharges from the permittee causes damage to the WRD's infrastructure or violates the WRD's discharge permits or contractual obligations, or causes injury to any person or property, the permittee shall indemnify the County the actual cost of the damage or other liabilities incurred by the County, including but not limited to fines levied against the County by the regulatory agencies. The County shall bill the permittee for the costs incurred for any cleaning, repair, or replacement work caused by the violation or discharge. Refusal to pay the assessed costs shall constitute a violation.

4.29 SEVERABILITY - The provisions of this permit are severable, and if any provision of this permit, or the application of any provision of this permit to any circumstance, is held invalid, the application of such provision to other circumstances, and the remainder of this permit, shall not be affected thereby.

4.30 SIGNATORY REQUIREMENTS - All applications, reports, or information submitted to the Hillsborough

County EVSD must contain the following certification statement and be signed as required in Section (a), (b),

(c) or (d) below:

"I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations."

c. the written authorization is submitted to the EVSD.

4. If an authorization under paragraph (c) of this section is no longer accurate because a different individual or position has responsibility for the overall operation of the facility, or overall responsibility for the environmental matters for the company, a new authorization satisfying the requirements of paragraph (c) of this section must be submitted to the EVSD prior to or together with any reports to be signed by an authorized representative.

4.31 SIGNIFICANT NONCOMPLIANCE (SNC) – Violations shall be identified as those violations or patterns of violations by the permittee that are instances of Significant Noncompliance (SNC). The determination of SNC is patterned after criteria used in the NPDES program (40 CFR 123.45). Instances of SNC are permittee violations which meet one or more of the following criteria:

1. Chronic violations of wastewater discharge limits, defined here as those in which sixty-six percent (66%) or more of all of the measurements taken for the same pollutant parameter taken during a six-month period exceed (by any magnitude) a numeric pretreatment standard or requirement, including instantaneous limits;

2. Technical review criteria (TRC) violations, defined here as those in which thirty-three percent (33%) or more of all of the wastewater measurement taken for each pollutant parameter during a six-month period equals or exceeds the product of the numeric pretreatment standard or requirement including instantaneous limit, multiplied by the applicable TRC (TRC = 1.4 for BOD, TSS, fats, oil and grease, and 1.2 for all other pollutants except pH);

3. Any other violations of a pretreatment standard or requirement (daily maximum or longer-term average, instantaneous limit, or narrative standard) that the EVSD determines has caused, alone or in combination with other discharges, interference or pass through (including endangering the health of POTW personnel or the general public);

4. Any discharge of a pollutant that has caused imminent endangerment to the public or to the environment, or has resulted in the Director’s exercise of its emergency authority to halt or prevent such a discharge;

5. Failure to meet, within 90 days after the schedule date, a compliance schedule milestone contained in an individual wastewater discharge permit or a general permit or enforcement order for starting construction, completing construction, or attaining final compliance;

6. Failure to provide, within forty-five (45) days after the due date, required reports such as baseline monitoring reports, 90-day compliance reports, periodic self-monitoring reports, and reports on compliance with compliance schedules;

7. Failure to accurately report noncompliance; or

8. Any other violation or group of violations that the EVSD considers to be significant, including a violation of Best Management Practices, which the EVSD determines will adversely affect the operation or implementation of the EVSD’s pretreatment program.

As part of its enforcement action, the EVSD shall notify the permittee of each incident of a SNC, and each notice shall include an order for the Permittee to come into compliance immediately, or to enter into a compliance agreement with the EVSD. The EVSD shall annually publish a newspaper list of permittees that were identified as being in SNC during the previous twelve (12) months. The notice shall also summarize any enforcement actions taken against the permittee.
