About this file
This is a vendor compliance document issued by the City of San Angelo, Texas Purchasing Division that establishes reciprocity requirements for non-resident vendors bidding on municipal contracts. The document addresses compliance with Texas Government Code Section 2252.002, which mandates that non-resident vendors (those with principal places of business outside Texas) must submit bids at lower prices than the lowest Texas resident vendor by the same percentage that Texas resident vendors would be required to underbid non-resident vendors in their home states. The document applies to contracts for construction, improvements, supplies, or services, though it explicitly excludes contracts involving federal funds. Non-resident vendors must complete Section A by identifying their state of principal business location and providing the applicable underbidding percentage required by that state's law, while Texas resident vendors must complete Section B to certify their Texas residency. Failure to complete the appropriate section results in automatic disqualification from contract consideration.
The compliance form requires authorized agents to provide vendor name, address, contact information, and signature. The document serves as a mandatory certification requirement for all bids submitted to the City of San Angelo and must be included with proposal submissions to meet specifications. No specific pricing amounts, set-asides, or funding sources are detailed in this compliance document, as it functions solely as a procedural requirement establishing the framework for fair competition between resident and non-resident vendors in accordance with Texas state law.

Vendor Compliance with Reciprocity on Non-Resident Vendors
Texas Government Code 2252.002 provides that, in order to be awarded a contract as low vendor, a non-resident vendor must bid projects for construction, improvements, supplies or services in Texas at an amount lower than the lowest Texas resident vendor by the same amount that a Texas resident vendor would be required to underbid a non-resident vendor in order to obtain a comparable contract in the state in which the non-resident’s principal place of business is located.
A non-resident vendor is a contractor whose corporate offices or principal place of business is outside of the state of Texas. This requirement does not apply to a contract involving Federal funds. The appropriate blanks in Section A must be filled out by all out-of-state or non-resident vendors for your submission to meet specifications. The failure of out-of-state or non-resident contractors to do so will automatically disqualify that vendor. Texas resident vendors must check the blank in Section B.
