About this file
This is a sample Bid Bond Form for the City of Owensboro, Kentucky, related to the OPD Training Facility Asphalt Paving Project. The bid bond serves as a financial guarantee that a bidder will execute the required agreement and deliver any necessary performance and payment bonds within the timeframe specified in the bidding documents. The bond protects the City of Owensboro by ensuring bidder compliance and commitment to the project. The form provides space for the bidder and surety to identify themselves, specify the penal sum amount, and establish the project description and bid due date. Default occurs if the bidder fails to deliver the executed agreement and required bonds within the specified timeframe or any extension agreed to in writing by the City.
The bond obligations are joint and several between the bidder and surety, with payment of the penal sum representing the extent of liability and the City's sole remedy upon bidder default. The surety must provide a current Power of Attorney demonstrating the signatory's authority. Payment is due within 30 calendar days of written notice of default, and legal action must commence between 30 calendar days and one year after the bid due date in a Kentucky court of competent jurisdiction. The bond becomes null and void if the City accepts the bid and the bidder delivers all required documents, if all bids are rejected, or if the City fails to issue a Notice of Award within the specified timeframe. The surety waives defenses related to time extensions for issuing a Notice of Award, provided extensions do not exceed 120 days in aggregate from the bid due date without written consent.
