About this file
This is a sample bid bond form required by the City of Owensboro, Kentucky for the Fence Replacement at Fisher Park project. The bid bond serves as a guarantee that a bidder will enter into a contract and provide required performance and payment bonds upon acceptance of their bid. Bidders must submit the executed bid bond with their proposal by the bid due date specified in the bidding documents. The bond remains in effect until the owner either accepts the bid and the contractor delivers the executed agreement and required bonds, rejects all bids, or fails to issue a Notice of Award within the specified timeframe in the bidding documents, not to exceed 120 days from the bid due date without surety consent.
The penal sum amount and specific bid due date are to be completed on the face of the bond form. Default occurs if the bidder fails to deliver the executed agreement and any required performance and payment bonds within the time required by the bidding documents. Upon default, the owner may recover the full penal sum as its sole remedy, with payment due within 30 calendar days of written notice of default. Any legal action must be commenced within one year of the bid due date and only in a court of competent jurisdiction in Kentucky. The surety must provide a current Power of Attorney evidencing the authority of the signatory to execute and bind the surety to the bond.

3. This obligation shall be null and void if:

5. Surety waives notice of any and all defenses based on or arising out of any time extension to issue Notice of Award agreed to in writing by Owner and Bidder, provided that the total time for issuing Notice of Award including extensions shall not in the aggregate exceed 120 days from Bid due date without Surety’s written consent.
6. No suit or action shall be commenced under this Bond prior to 30 calendar days after the notice of default required in Paragraph 4 above is received by Bidder and Surety and in no case later than one year after Bid due date.
