The Town recognizes that small businesses enterprises as well as businesses enterprises owned and operated by women and/or minority persons (collectively “disadvantaged business”) have historically faced challenges resulting in less than full participation in the free enterprise system to a degree disproportionate to other businesses. Therefore, the Town is committed to ensuring that such disadvantaged business enterprises are afforded every opportunity to fully and fairly participate in the Town’s procurement process for goods and services. In the event of a tie after the scoring of proposals involving a certified disadvantaged Offeror and a non-disadvantaged Offeror, the Town will award a contract or issue a purchase order to the certified disadvantaged Offeror. Tied proposals involving two certified disadvantaged Offerors will be settled by selecting the proposal having the lowest total cost to the Town. It is the obligation of the disadvantaged Offeror to submit proof of current certification from a governmental entity in the United States at the time they submit their proposal in order for the certification to be considered by the Town in determining an award as described above. Tied proposals involving two non-disadvantaged Offerors will be settled by selecting the proposal having the lowest total cost to the Town. In the case of identical costs, a random selection method of the Town’s choice will be used to determine contract award.
The Town is required under the South Carolina Freedom of Information Act, to upon request, make public and disclose all documents of, and documents incidental to, executed contractual arrangements. Therefore, Offerors, by submitting a proposal in response to this solicitation, are acknowledging that all materials submitted in their response may be subject to such disclosure, regardless of any labeling of materials as “confidential” or “proprietary” or other similar notations.
II. BACKGROUND
The Town of Hilton Head Island, incorporated in 1983, is a barrier island on the Atlantic coast of South Carolina. The Island is located about 30 miles from Savannah, Georgia, and about 90 miles from Charleston, South Carolina. Approximately 54 square miles in area, the Island is about 12 miles long and 5 miles wide. The Island is primarily accessed via US 278 from I-95.
Page | 5
A four-lane bridge over the Intercoastal Waterway connects the Island with the mainland.
The island has a regional airport which is operated by Beaufort County. The Town has jurisdiction over the entire Island except for Mariner's Cove, Blue Heron Point, and Windmill Harbor. The Town is empowered to levy a property tax on both real and personal property located within its boundaries.
The Town of Hilton Head Island operates under the council-manager form of government.
Policy-making and legislative authority are vested in a governing council (Council) consisting of a mayor and six (6) other members. The Council appoints the government’s manager, who in turn appoints the heads of the various departments. The mayor and each member of council shall be elected for a term of office of four (4) years.
The Island’s year-round population is approximately 40,000, although there are many secondary residences, time shares and hotels which attract more than 3,000,000 visitors a year. Much of the Island’s developed lands lie within Planned Unit Developments, or gated communities.
III. SCOPE OF SERVICES
The Town is seeking proposal responses from firms that are qualified, experienced, and knowledgeable in providing right-of-way easements, other permanent easements, or quit claim deeds in the State of South Carolina on various projects throughout the Town, including but not limited to drainage, roadway, lighting, and sidewalk work.
The Town’s staff and Town Attorney’s office will have identified the need for an easement or a quit claim deed, identified the property owner, prepared a title search, prepared the exhibit for the proposed easement or quit claim deed, prepared the easement of quit claim plat, ordered the appraisal, prepared the easement or quit claim document, and made a determination on just compensation.
The successful Contractor (s) of this RFQ will continue the process by:
• sending an initial letter of intent to the property owner;
• meeting with the property owners individually or in a neighborhood meeting as needed (note that neighborhood meetings are frequently scheduled for early evening to ensure attendance);
• follow up contacts with property owners up to four (4) times, documenting efforts each time;
• obtain one of the following results from each meeting:
o property owner donates the easement o property owner agrees to the easement with compensation o no response or rejection with documented efforts to reach agreement
• obtain signatures and W9s from agreeable property owners
• submit signed documents to Town staff
• provide weekly progress reports in format provided by the Town
Town staff and the Town Attorney’s office will finalize the process with approvals, recording the documents, and issuing checks as necessary.
Page | 6
Contractor should not anticipate having a workspace at any Town offices for the day-to-day work but may come in for in-person status meetings occasionally and for printing and postage. Contractor must supply their own equipment such as computer and phone, but the Town will provide letterhead and print capabilities at Town Hall, as well as postage.
Pricing for this service should be a unit cost for this scope of work. Feel free to document any assumptions that you build into your pricing. Please also provide hourly pricing for one or more different job categories, such as Easement Acquisition Specialist, Administrative, etc.
Per-hour service unit pricing will be used when the scope of acquisition services if found to be either smaller or larger than a typical project and will only be used when found agreeable by both the Town and the successful Contractor(s).
