About this file
This is a Public Notice of Proposed Waiver issued by Park City Municipal Corporation (PCMC) on August 31, 2026, regarding a procurement exemption for HVAC system repairs and modifications at the 3Kings Water Treatment Plant. The proposed service involves engineering and construction work to correct design deficiencies identified in the original HVAC system installation. PCMC intends to award the contract to Envision Mechanical, Inc., the incumbent contractor that originally installed the existing HVAC system and has completed related corrective work at the facility. The waiver request seeks to bypass the standard competitive procurement process based on justification that continuing with Envision provides necessary continuity, minimizes schedule delays, reduces technical risk, and avoids the costs and coordination challenges associated with onboarding a new contractor unfamiliar with the existing system configuration and Building Management System integration requirements. The work is part of corrective actions defined in a Settlement Agreement between PCMC and Jacobs Engineering Group Inc., which was responsible for the original HVAC design deficiencies.
The contract value is $259,353.36, with full reimbursement to be provided by Jacobs Engineering Group Inc. under the terms of the Settlement Agreement, along with reimbursement for any mutually agreed change orders associated with the corrective work. The Procurement Official determined that the waiver is appropriate under PCMC Procurement Rule 5-3, which permits competitive procurement waivers when reasonable justification exists and the waiver is in the best interest of PCMC. Timely completion of the work is emphasized as critical due to the essential nature of the 3Kings Water Treatment Plant as an active water treatment facility serving the community; delays could prolong existing system deficiencies and increase risk of equipment or operational failures that could impact PCMC's ability to safely and effectively treat water. Comments regarding the proposed waiver were solicited within seven days of the notice posting date.

PUBLIC NOTICE OF PROPOSED WAIVER
DATE ISSUED: August 31, 2026
PROPOSED SERVICE: 3Kings Water Treatment Plant – HVAC System Repairs and Modifications
PROPOSED PROVIDER: Envision Mechanical, Inc.
REQUESTING DEPARTMENT: Public Utilities - Water
Please take notice of Park City Municipal Corporation’s (PCMC’s) intent to waive a competitive procurement process. PCMC Procurement Rule 5-3 provides that the competitive procurement requirements may be waived under circumstances where there is a reasonable justification and the waiver is in the best interests of PCMC. The Procurement Official has determined that a waiver is appropriate for a contract for construction services to complete HVAC system repairs and modifications at the 3Kings Water Treatment Plant in the amount of $259,353.36 to Envision Mechanical, Inc. based on the information below:
Waiver Justification:
Awarding this contract without engaging in a Standard Procurement Process is in the best interest of PCMC under PCMC Procurement Policy 5-because Envision Mechanical, Inc. installed the existing HVAC system at the 3Kings Water Treatment Plant and has specific knowledge of the existing mechanical equipment, controls, programming, and overall system configuration. The proposed work is necessary to correct deficiencies in Jacobs Engineering Group Inc.'s original HVAC design and is part of the corrective work defined in the proposed Settlement Agreement between PCMC and Jacobs. Envision has also already completed related corrective work at the facility.
Continuing with Envision provides continuity between the original installation, previously completed repairs, and the remaining work. Bringing on a new contractor would require additional time to become familiar with the existing system and would introduce unnecessary schedule impacts, coordination requirements, costs, and technical risk. This is particularly important because the proposed work includes modifications and programming that must be integrated with the existing Building Management System.
Timely completion is important because these modifications are necessary for a properly functioning HVAC system at an active water treatment facility. Delays in completing the corrective work could prolong the existing deficiencies and increase the risk of equipment or operational failures that could affect PCMC's ability to safely and effectively treat water for the community.
Under the Settlement Agreement, Jacobs will reimburse PCMC $259,353.36 for the construction services to be performed by Envision and will also reimburse PCMC for mutually agreed change orders

For these reasons, continuing with Envision minimizes transition and operational risk, allows the corrective work to proceed efficiently, and is in the best interest of PCMC.
