About this file
This document set comprises the bidding requirements and contract forms for the City of Orem, Utah's Well #1R Development Project, with Hansen, Allen & Luce, Inc. serving as the project engineer and geologist. The project involves dual swab development and test pumping of a production well using a cable tool rig, with simultaneous swabbing and pumping to maximize well efficiency while recording static water level, pumping water level, flow rate, and sand production. The well features anticipated 20-inch diameter casing with approximately 300 feet of screen to an anticipated depth of 800 feet. The pre-bid conference is scheduled for 3:00 PM on October 8, 2026, at the City of Orem Public Works Building located at 1450 West 550 North, Orem, Utah 84057, with attendance strongly recommended. Bids will be received via the Utah Public Procurement Portal (U3P/Bonfire) until 3:00 PM local time on October 22, 2026. The contract specifies substantial completion within 90 days and final completion within 120 days of the notice to proceed.
Evaluation criteria weight qualifications, experience, and references at 60 percent; cost at 15 percent; and scheduling and availability at 25 percent. The bid schedule includes seven line items: mobilization/demobilization, dual swab well development (300 hours at hourly rate), furnish and install test pump equipment with 5,000 gpm capacity set at 350-foot depth, well development and pump testing (160 hours at hourly rate), well disinfection, well bailing (8 hours at hourly rate), and video well log, all submitted on a unit price basis. Liquidated damages are assessed at $200 per day for delays beyond substantial completion and final payment dates. No bid security is required, though a 5 percent bid bond was initially referenced in the advertisement. A 95 percent progress payment with 5 percent retainage applies during construction, increasing to 97.5 percent upon substantial completion. The City of Orem reserves the right to reject any or all bids submitted. Bidding documents are available in electronic PDF format from the engineer on or after September 30, 2026, with questions directed to Scott Greenhalgh, P.G., Project Geologist, at Hansen, Allen & Luce, Inc.

16.02 If within 24 hours after Bids are opened any Bidder files a duly signed written notice with
Owner and promptly thereafter demonstrates to the reasonable satisfaction of Owner that there was a material and substantial mistake in the preparation of its Bid, that Bidder may withdraw its Bid, and the Bid security will be returned. Owner also reserves the right to waive all informalities not involving price, time, or changes in the Work and to negotiate contract terms with the Successful Bidder.
19.02 More than one Bid for the same Work from an individual or entity under the same or different names will not be considered. Reasonable grounds for believing that any Bidder has an interest in more than one Bid for the Work may be cause for disqualification of that Bidder and the rejection of all Bids in which that Bidder has an interest.
19.03 In evaluating Bids, Owner will consider whether or not the Bids comply with the prescribed requirements, and such alternates, unit prices and other data, as may be requested in the Bid Form or prior to the Notice of Award.

19.05 Owner may conduct such investigations as Owner deems necessary to establish the responsibility, qualifications, and financial ability of Bidders, proposed Subcontractors, Suppliers, individuals, or entities to perform the Work in accordance with the contract Documents.
19.06 If the Contract is to be awarded, Owner will award the Contract to the responsible Bidder whose Bid, conforming with all the material terms and conditions of the Instructions to Bidders, is lowest, price and other factors considered. If detailed in the bid form, factors such as discounts, transportation costs, and life cycle costs may be used to determine which bidder, if any, is to be offered the award.

Terms used in this Agreement have the meanings stated in the General Conditions and the Supplementary Conditions.

THE CONTRACT DOCUMENTS. THE WORK IS GENERALLY DESCRIBED AS

Description and Scope of Work: Dual Swab Development and Test Pumping of a production well (Well #1R) using a Cable Tool Rig. The well will be swabbed and pumped simultaneously to maximize the efficiency of the well while recording parameters such as:
static water level, pumping water level, flow rate while pumping and sand production. The anticipated construction of the well is 20-inch diameter casing, with approximately 300 feet of screen, to an anticipated depth of 800 feet. Figure 1 shows the location and site plan of the well. Figure 2 shows the anticipated well design, and Figure 3 shows the well-head completion.

3.02 The part of the Project that pertains to the Work has been designed by Engineer.

A. Contractor and Owner recognize that time is of the essence as stated in
Paragraph 4.01 above and that Owner will suffer financial and other losses if the Work is not completed and Milestones not achieved within the Contract Times, as duly modified. The parties also recognize the delays, expense, and difficulties involved in proving, in a legal or arbitration proceeding, the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty):
1. Substantial Completion: Contractor shall pay Owner $200.00 for each day that expires after the time (as duly adjusted pursuant to the Contract) specified above for Substantial Completion, until the Work is substantially complete.

Completion of Remaining Work: After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Times (as duly adjusted pursuant to the Contract) for completion and readiness for final payment, Contractor shall pay Owner $200.00 for each day that expires after such time until the Work is completed and ready for final payment.
3. Liquidated damages for failing to timely attain Milestones, Substantial Completion, and final completion are not additive, and will not be imposed concurrently.
B. If Owner recovers liquidated damages for a delay in completion by Contractor, then such liquidated damages are Owner’s sole and exclusive remedy for such delay, and Owner is precluded from recovering any other damages, whether actual, direct, excess, or consequential, for such delay, except for special damages (if any) specified in this Agreement.
