About this file

Summary

This is a bid attachments document for the Monroe County Transit Authority (MCTA) General Trades Construction (GTC) rebid project located in Swiftwater, Pennsylvania. The project encompasses renovation of an existing maintenance building containing six repair bays, construction of a pre-engineered bus storage addition, and expansion of the fuel island with associated site improvements to accommodate Fixed-Route buses, Paratransit shared-ride vehicles, Microtransit buses, and non-revenue vehicles. The rebid is due electronically via the PennBid Program by February 4, 2026 at 3:00 PM, with a virtual pre-bid meeting scheduled for January 14, 2026 at 10:00 AM. The document requires submission of multiple certifications and compliance forms with bid proposals, including certification of receipt of addenda, non-collusion affidavits, Buy America certifications, debarment certifications for primary and lower-tier participants, disadvantaged business enterprise (DBE) documentation, non-discrimination clauses, Americans with Disabilities Act compliance, Title VI Civil Rights Act compliance, lobbying certificates, environmental requirements acknowledgment, Pennsylvania Steel Products Procurement Act certification, hold harmless agreements, contractor integrity affidavits, Public Works Employment Verification Act forms, prohibited telecommunications equipment certifications, Build America Buy America certifications, and a comprehensive warranty log detailing manufacturer and installer warranty requirements across 80+ specification sections.

The procurement requires bidders to demonstrate good faith efforts to achieve DBE participation goals through documented outreach, solicitation of certified DBE firms, and submission of detailed explanations if the stated goal cannot be met. Failure to properly complete and submit any of the required certification forms, particularly Attachments A through R and U, will render bids non-responsive and subject to rejection. Warranty requirements span multiple years depending on product type, ranging from one year for general work and equipment to 25 years for certain telecommunications cabling systems, 20 years for roofing systems and some exterior finishes, and lifetime coverage for specific components such as guide rollers on vehicle lifts. The document is dated August 29, 2025 with Addendum 04 issued November 21, 2025, and all bidders must acknowledge receipt of all applicable addenda as a prerequisite for bid acceptance.

DEMONSTRATION OF GOOD FAITH EFFORTS FORM

(Submit this form if the Bidder is unable to achieve the DBE goal.)

Should a Bidder be unable to achieve the identified DBE goal of 0%, the Bidder must, in order to be considered responsive, demonstrate that all necessary and reasonable steps were taken to secure participation by certified DBE firms. In order to demonstrate that a good faith effort was made to achieve the DBE goal, the Bidder must employ efforts that one would reasonably expect a Bidder to take if the Bidder were actively and aggressively trying to obtain DBE participation in order to meet or exceed the contract goal. Mere pro forma efforts will not be considered as a good faith effort, and the ability or desire of the Bidder to perform the work within its own organization does not relieve the Bidder of the responsibility to make a good faith effort. Actions constituting evidence of good faith efforts are described in Appendix A to 49 CFR Part 26 and may include, but are not limited to, the actions identified on this form. The following is not intended to be a mandatory checklist, nor is it intended to be exclusive or exhaustive; however, failure to provide the information requested herein may result in the bid being deemed nonresponsive to the DBE requirements.

It shall be no defense to a finding of noncompliance with the Contract Compliance Regulations issued by the Pennsylvania Human Relations Commission or this non-discrimination clause that Contractor has delegated some of its employment practices to any union, training program or other source of recruitment which prevents it from meeting its obligations. However, if the evi-dence indicates that the Contractor was not on notice of the third-party discrimination or made a good faith effort to correct it, such factor shall be considered in mitigation in determining ap-propriate sanctions.

5. Where the practices of a union or of any training program or other source of recruitment will result in the exclusion of minority group persons, so that Contractor will be unable to meet its obligations under the Contractor Compliance Regulations issued by Pennsylvania Human Re-lations Commission, or this non-discrimination clause.
