Maple Street Water Main Replacement Project Manual

This project manual contains the complete bidding documents and contract requirements for the Maple Street Water Main Replacement project for the McCONNELLSBURG BOROUGH MUNICIPAL AUTHORITY in McConnellsburg, Pennsylvania. The project consists of construction of ductile iron pipe water main and appurtenances including gate valves, fire hydrants, line stops, tapping sleeves with valves, combination air valves, and connections to the existing water system; abandonment of the existing water main; installation of new water services ranging from 2-inch to 3/4-inch diameter; and incidental work including temporary and permanent pavement replacement, concrete walk replacement, gravel driveway replacement, seeding, and traffic control. Sealed bids will be received online via the PennBid Program through November 18, 2026 at noon, with no pre-bid conference scheduled. The project includes multiple bid items with estimated quantities, including 877 linear feet of 8-inch ductile iron pipe in paved areas, 24 water services to be installed or reconnected, 2 fire hydrants, 6 gate valves of various sizes, and associated site restoration work. The successful bidder will be required to provide performance and payment bonds in the amount of 100 percent of the successful bid amount. Bidders must submit qualifications within 7 days after bid opening, including owned equipment statements, experience statements demonstrating a minimum of 2 years performing similar work, financial statements dated within 90 days, and certificates of qualification for foreign corporations.

The contract price is to be determined based on unit prices and lump sum amounts submitted by bidders, with estimated quantities provided for informational purposes only and actual final quantities to be determined by the engineer. Bid security of 10 percent of the total bid amount is required, submitted as a certified check, bank money order, or bid bond. The work is subject to the Pennsylvania Prevailing Wage Act and the Steel Products Procurement Act, requiring bidders to pay applicable prevailing wage rates and use specified or approved steel products, with wage predetermination rates included in the project manual. Progress payments will be made monthly during construction with 10 percent retainage until 50 percent completion, after which retainage may be reduced to 5 percent for satisfactory progress; upon substantial completion, retainage of 200 percent of estimated remaining work value will be withheld pending final completion. Liquidated damages are set at $1,500 per day for failure to achieve substantial completion and final completion by specified dates. The contract includes a one-year warranty period from the date of substantial completion acceptance, during which the contractor must remedy any defects at no cost to the owner. All contractors and subcontractors are required to comply with the Pennsylvania Public Works Employment Verification Act and verify employment eligibility through E-Verify for all newly hired employees.

11.02 Objection to Proposed Subcontractors, Suppliers, or Others:

A. If the OWNER or the ENGINEER, after due investigation, has reasonable objection to any proposed Subcontractor, Supplier, individual, or entity, the OWNER may, before the Notice of Award is given, request the apparently Successful Bidder to submit a substitute, without an increase in the Bid.

1. If the apparently Successful Bidder declines to make any such substitution, the

OWNER may award the Contract to the next lowest Bidder that proposes to use acceptable Subcontractors, Suppliers, individuals, or entities.

2. Declining to make requested substitutions will not constitute grounds for forfeiture of the Bid Security of any Bidder.

B. The CONTRACTOR shall not be required to employ any Subcontractor, Supplier, individual, or entity against whom the CONTRACTOR has reasonable objection.

2. The total of all estimated prices will be determined as the sum of the products of the estimated quantity of each item and the unit price Bid for that item.

3. In unit price bids, the extensions, if any, and the total are for informational purposes only, and the determination of the lowest bid will be based solely on the total results of computations of the estimated quantities and the prices bid including any combination of Substituted and/or Alternate Items authorized by the Bid Form.

4. The final quantities and Contract Price will be determined in accordance with paragraph 11.03 of the General Conditions.

B. Estimate of Quantities:

1. The Bidder's attention is directed to the fact that in contracts based on unit prices, the estimate of quantities of work to be done and materials to be furnished under these Specifications, as shown on the Bid Form and in the Contract, are approximate and are given only for the benefit of the OWNER to be used as a basis of calculation upon which to determine the lowest Bidder.

2. Neither the OWNER nor the ENGINEER assume any responsibility that the quantities indicated will be obtained in the construction of the Project, neither shall the CONTRACTOR plead misunderstanding or deception because of such estimate of quantities, or the character of the Work or location, or other conditions pertaining thereto.

C. OWNER's Changes:

1. The OWNER reserves the right to increase or diminish any or all of the above mentioned quantities of Work, or to omit any of them, as it determines necessary;

and any such increase or decrease of the quantities given for any of the items shall not be considered as sufficient ground for granting an increase in the unit prices bid, except as set forth in paragraph 11.03 of the General Conditions.
