Summary: DeGol Industrial Center Rail Expansion Project - Phase III
This is a comprehensive project manual and construction contract document prepared by the Commonwealth of Pennsylvania's Commonwealth Financing Authority (CFA) in partnership with D. Holdings, Inc., for a railroad track expansion project in Blair County, Pennsylvania. The project involves the installation of approximately 2,483 track feet of new railroad track including ballast, ties, and rails; removal of 2,483 track feet of existing rails, timbers, and ballast; re-alignment and re-grading of 159 track feet; construction of a 744-square-foot cast-in-place concrete at-grade crossing with adjacent asphalt paving (1,000 square feet); and installation of an end-of-track earth mound. The location is the existing DeGol Industrial Center in Frankstown Township, Blair County, Pennsylvania. Sealed bids were due online via PennBid by 10:00 A.M. Eastern Standard Time on Friday, April 3rd, 2026, with public opening and posting following immediately thereafter. A pre-bid meeting was held on Wednesday, March 18, 2026, at 10:00 A.M. at D. Holdings, Inc.'s office in Hollidaysburg, Pennsylvania. The contract term spans 240 consecutive calendar days from the Notice to Proceed, with substantial completion required within 210 days.
The project is funded in part by a $500,000 grant from the Commonwealth Financing Authority's Multimodal Transportation Fund Program, with the grant activity period running from March 26, 2024, through June 30, 2027. Bidders are required to submit bid security equal to 10 percent of their maximum bid price, a statement of qualifications with equipment lists, a non-collusion affidavit, and compliance certifications including workers' compensation verification and proof of legal business authority. The contract includes payment on a unit price basis for designated line items and lump-sum pricing for other components, with progress payments made monthly at 90 percent of completed work and 10 percent retainage until substantial completion. Liquidated damages of $500 per day apply for failure to achieve substantial completion and final completion within the specified contract times. Prevailing wage rates as determined by Pennsylvania's Department of Labor and Industry apply to all work, and all steel products must comply with the Pennsylvania Steel Products Procurement Act, requiring 75 percent U.S. content by cost. The contractor must provide performance and payment bonds each equal to the contract price and maintain comprehensive insurance coverage including workers' compensation, commercial general liability with $4,000,000 limits, and pollution liability insurance.

Engineer is acceptable to Bidder;
I. determine that the Bidding Documents are generally sufficient to indicate and convey understanding of all terms and conditions for the performance and furnishing of the Work; and

ARTICLE 6 – PRE-BID CONFERENCE
6.01 A Pre-Bid Conference, if any, will be held at the time and location stated in the invitation or advertisement to bid. Representatives of Owner and Engineer will be present to discuss the Project.
Bidders are encouraged to attend and participate in the conference. Engineer will transmit to all prospective Bidders of record such Addenda as Engineer considers necessary in response to questions arising at the conference. Oral statements may not be relied upon and will not be binding or legally effective.
ARTICLE 7 – INTERPRETATIONS AND ADDENDA
7.01 All questions about the meaning or intent of the Bidding Documents are to be submitted to Engineer electronically via PennBid (https://pennbid.bonfirehub.com). Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda delivered to all parties recorded as having received the Bidding Documents. Questions received less than seven days prior to the date for opening of Bids may not be answered. Only questions answered by Addenda will be binding.
Oral and other interpretations or clarifications will be without legal effect.
7.02 Addenda may be issued to clarify, correct, supplement, or change the Bidding Documents.
ARTICLE 8 – BID SECURITY
8.01 A Bid must be accompanied by Bid security made payable to Owner in an amount of ten percent (10%) of
Bidder’s maximum Bid price (determined by adding the base bid and all alternates) and in the form of a certified check, bank money order, or a Bid bond (on the form included in the Bidding Documents) issued by a surety meeting the requirements of Paragraphs 6.01 and 6.02 of the General Conditions.
8.02 The Bid security of the apparent Successful Bidder will be retained until Owner awards the contract to such Bidder, and such Bidder has executed the Contract Documents, furnished the required contract security, and met the other conditions of the Notice of Award, whereupon the Bid security will be released. If the Successful Bidder fails to execute and deliver the Contract Documents and furnish the required contract security within 10 days after the Notice of Award, Owner may consider Bidder to be in default, annul the Notice of Award, and the Bid security of that Bidder will be forfeited. Such forfeiture shall be Owner’s exclusive remedy if Bidder defaults.
8.03 The Bid security of other Bidders that Owner believes to have a reasonable chance of receiving the award may be retained by Owner until the earlier of seven days after the Effective Date of the Contract or 61 days after the Bid opening with an additional 60 days if needed if the award is delayed by the required approval of another government agency, the sale of bonds, or the award of a grant, whereupon Bid security furnished by such Bidders will be released.
8.04 Bid security of other Bidders that Owner believes do not have a reasonable chance of receiving the award will be released within seven days after the Bid opening.

ARTICLE 9 – CONTRACT TIMES
9.01 The number of days within which, or the dates by which, the Work is to be substantially completed, and completed and ready for final payment, are set forth in the Agreement.
ARTICLE 10 – LIQUIDATED DAMAGES
10.01 Provisions for liquidated damages, if any, for failure to timely attain a Milestone, Substantial Completion, or completion of the Work in readiness for final payment, are set forth in the Agreement.
ARTICLE 11 – SUBSTITUTE AND “OR-EQUAL” ITEMS
11.01 The Contract for the Work, as awarded, will be on the basis of materials and equipment specified or described in the Bidding Documents with consideration during the bidding and Contract award process of possible substitute or “or-equal” items. In cases in which the Contract allows the Contractor to request that Engineer authorize the use of a substitute or “or-equal” item of material or equipment, application for such acceptance may be made to and may be considered by Engineer. The burden of proof rests with the prime bidders. Adequate supporting information must be submitted to the Engineer to enable the
Engineer to determine the equality of a product.
11.02 All prices that Bidder sets forth in its Bid shall be based on the presumption that the Contractor will furnish the materials and equipment specified or described in the Bidding Documents, as supplemented by Addenda. Any assumptions regarding the possibility of post-Bid approvals of “or-equal” or substitution requests are made at Bidder’s sole risk. Bidders are urged to submit any questions on the suitability of a product to the Engineer in writing during the bidding period.
ARTICLE 12 – SUBCONTRACTORS, SUPPLIERS AND OTHERS
12.01 A Bidder shall be prepared to retain specific Subcontractors, Suppliers, or other individuals or entities for the performance of the Work if required by the Bidding Documents (most commonly in the
Specifications) to do so. If a prospective Bidder objects to retaining any such Subcontractor, Supplier, or other individual or entity, and the concern is not relieved by an Addendum, then the prospective Bidder should refrain from submitting a Bid.
12.02 Subsequent to the submittal of the Bid, Owner may not require the Successful Bidder or Contractor to retain any Subcontractor, Supplier, or other individual or entity against which Contractor has reasonable objection.
12.03 The apparent Successful Bidder, and any other Bidder so requested, shall within five days after Bid opening, submit to Owner a list of the Subcontractors or Suppliers proposed for the Work.
If requested by Owner, such list shall be accompanied by an experience statement with pertinent information regarding similar projects and other evidence of qualification for each such Subcontractor, Supplier, or other individual or entity. If Owner or Engineer, after due investigation, has reasonable objection to any proposed Subcontractor, Supplier, individual, or entity, Owner may, before the Notice of
Award is given, request apparent Successful Bidder to submit an acceptable substitute, in which case apparent Successful Bidder shall submit a substitute, Bidder’s Bid price will be increased (or decreased) by the difference in cost occasioned by such substitution, and Owner may consider such price adjustment in evaluating Bids and making the Contract award.
12.04 If apparent Successful Bidder declines to make any such substitution, Owner may award the Contract to the next lowest Bidder that proposes to use acceptable Subcontractors, Suppliers, or other individuals or entities. Declining to make requested substitutions will constitute grounds for forfeiture of the Bid security of any Bidder. Any Subcontractor, Supplier, individual, or entity so listed and against which
Owner or Engineer makes no written objection prior to the giving of the Notice of Award will be deemed
