About this file

This is an E-Verify compliance requirement document issued by the Town of Palm Beach, Florida for contractors and vendors seeking to conduct business with the municipality. The document establishes mandatory employment eligibility verification procedures that align with Florida Statutes Section 448.095. All proposers must register with the E-Verify System (E-Verify.gov) and use it to verify employment eligibility for all newly hired workers beginning January 1, 2021. Proposers are required to ensure that all workers, subcontractors performing contract duties, and consultants are similarly registered and compliant with E-Verify requirements. The Town of Palm Beach reserves the right to terminate any contract if it has a good faith belief that a contractor has knowingly violated Section 448.09(1), Florida Statutes, with contractors being barred from future Town awards for one year following such termination and remaining liable for any additional costs incurred by the Town resulting from the termination.

Subcontractors must provide written affidavits confirming they do not employ, contract with, or subcontract with unauthorized aliens as defined by Florida law. Contractors must maintain copies of all subcontractor affidavits for the duration of the subcontract and any extensions, with retention periods potentially extending longer if required by other contract provisions. If the Town determines that a subcontractor has violated applicable statutes, the contractor must immediately terminate that subcontract upon notification. This compliance requirement applies to the Town of Palm Beach's Automotive Parts and Accessories procurement, which solicits qualified vendors to provide pricing for automotive parts and accessories on a one-year contract basis with Net 30 payment terms and F.O.B. Destination to West Palm Beach, Florida.
