About this file

This document is a Sole Source Justification (SSJ) for a simplified acquisition by FEMA to repair a satellite antenna on a Mobile Communications Operational Vehicle (MCOV 111). The antenna, model 1258K-15, was damaged during a disaster response operation under DR-4787-WV when a low-hanging tree struck the vehicle's roof. AVL Technologies, the original equipment manufacturer (OEM), is the sole source for repairing the antenna due to its proprietary design and specialized repair requirements.

The sole-source procurement is justified by AVL Technologies being the exclusive provider of repair services and replacement parts, with no authorized resellers or third-party providers. The repair is considered urgent, particularly in preparation for the upcoming hurricane season, and is critical to maintaining FEMA's disaster response capabilities. The contracting officer conducted market research, including outreach to potential alternative vendors through the SBA portal, but no alternative sources were identified. The procurement will be conducted under Purchase Order 70FBR325P00000010, with the total repair cost to be determined based on AVL Technologies' quote and evaluated against the Independent Government Cost Estimate.

SSJ No.: 25-0153

Date: April 29, 2025 PR Number: PN00481Y2025T

Purchase Order Number: 70FBR325P00000010

1. Nature and/or description of the item/service being procured and anticipated cost:

Sole Source Justification: Repair of Antenna on MCOV 111 This is a sole source procurement action with AVL Technologies for the repair of substantial structural and electromechanical damage to the antenna (Model 1258K-15) installed on FEMA's MCOV 111. The antenna was severely damaged while the vehicle was deployed in support of disaster response under DR-4787-WV. As MCOV 111 was departing the parking lot and proceeding down the street, the roof—along with the antenna—was struck by a low-hanging tree, resulting in visible structural damage and significant internal component failure.

The necessary repairs can only be performed by AVL Technologies, the original equipment manufacturer (OEM) of the 1258K-15 antenna. Market research has confirmed that AVL is the sole vendor capable of providing the specialized parts and repair services required to restore the antenna to full operational capability.

The anticipated total cost for the repair, as quoted by AVL Technologies, is $ . These repairs are considered urgent to ensure the vehicle’s readiness for future disaster response operations.

2. Sole Source Justification Rationale in accordance with FAR 13.106-1(b)(1)(i) and (ii).

(Check one and provide rationale below):

____X___Only one source reasonably available.

________ Urgent and compelling circumstances exists.

________ Exclusive licensing agreement exists.

_________ Brand name. If the brand name requirement applies to a portion of the procurement, please identify that portion.

_________ Industrial Mobilization ____X____Other. Explain:

(Provide rationale here)

In accordance with FAR 13.106-1(b)(1), this procurement is justified on a sole-source basis due to the proprietary nature of the required equipment and services. AVL Technologies is the Original Equipment Manufacturer (OEM) of the 1258K-15 antenna installed on FEMA's MCOV 111 and is the exclusive provider of the necessary repair services and replacement parts.

Sole Source Justification for Simplified Acquisitions (over $10,000 up to $250,000)

The satellite antenna sustained substantial structural and electromechanical damage while deployed during disaster response operations under DR-4787-WV. As the vehicle was departing the site, the antenna was struck by a low-hanging tree, rendering the unit non-operational. Until repairs are completed, MCOV 111 remains out of commission and cannot support mission-critical deployments.

The following declarations, provided by AVL Technologies on April 1, 2025, further support this sole-source determination:

AVL Technologies is the OEM for the 1258K-15 antenna.

AVL Technologies is the exclusive source for all repairs and replacement parts related to this antenna model.

There are no authorized resellers or third-party providers approved to perform repairs or supply components.

The specialized nature of the equipment requires proprietary knowledge, precision repair methods, and access to OEM-certified parts to ensure compatibility, functionality, and system performance. Any attempt to use a non-OEM source for repair could result in non-conforming equipment, compromising both safety and mission readiness.

To ensure the antenna is restored to full operational capability and to maintain system compatibility and performance standards, the repair must be conducted by AVL Technologies.

The anticipated cost for this repair is as quoted by AVL Technologies.

A sole-source award is essential to meet FEMA’s operational requirements and ensure the continued effectiveness of MCOV 111 in disaster response operations.

3. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR Part 13.106-3(a)(2). (Check one and provide short explanation and description of action taken):

___X_____ Market Research.

_________ Comparison of the proposed price with prices found reasonable on previous purchases.

________ Current price List.

________ Comparison with similar items in a related industry.

________ Comparison to IGCE.

________ Contracting Officer’s personal knowledge.

_________ Other.

(Provide short explanation and description of action taken here)

This procurement is being conducted on a sole-source basis in accordance with FAR 13.106- 1(b)(1)(i) and FAR 6.302-2 due to the proprietary nature of the required services and the urgent operational need for repairs to the MCOV 111 antenna. The satellite antenna (Model 1258K-15), which is critical to FEMA's disaster response communications, sustained substantial damage
