About this file

This is a Justification and Approval for Other Than Full and Open Competition document (Logbook Number 2026-006, PR Number 1301310627) prepared by Naval Supply Fleet Logistics Puget Sound (NAVSUP FLC PS) for the Ship Repair Facility & Japan Regional Maintenance Center in Yokosuka, Japan.

The procurement covers a single 36" x 38" -30# tilting disc check valve with flanged ends and Monel trim (Drawing/Item #2134-5) manufactured by OEM Flowserve Corporation. The valve specification is ASTM B369/B369M with a unit weight of 1,627 pounds, 30 PSI pressure class, and copper-nickel 70-30 body/cover/disc material. The estimated contract value is $500,000 with a firm-fixed-price structure. The required delivery date is 30 April 2027. The valve serves as a direct replacement part for the main condenser scoop injection system on the USS Blue Ridge. The Government is pursuing this procurement outside full and open competition using simplified procedures under FAR 12.102 based on brand-name justification, as Flowserve owns the proprietary designs and drawings and does not authorize Government release of these documents to competitors. Flowserve does not sell directly to the Government but only through authorized distributors. Market research conducted January-February 2026 confirmed the item is unavailable through mandatory sources (AbilityOne, GSA, UNICOR) and that other federal organizations, including the Department of the Navy, have previously procured Flowserve check valves through authorized distributors. The Contracting Officer will publish required notices per FAR 5.201, and fair and reasonable pricing will be determined using market research and prior purchase data. No plans currently exist to compete future procurements for these check valves unless alternative authorized sources emerge.

4. Authority: Simplified Procedures, 41 U.S.C. 1901.

5. Describe how the proposed contractor(s) unique qualifications or the nature of the acquisitions requires using the authority cited

The requested check valve is required for the repair of the main condenser scoop injection on the USS Blue Ridge. The requested OEM Flowserve Corporation check valve meets the Government’s needs in form, fit, and function.

OEM Flowserve Corporation owns the designs, characteristics, and proprietary data for the requested check valve (MFG DWG: 2134-5). Flowserve confirmed they were the owner of drawing 2134-5 from Anchor Valve Co. which is now a Flowserve brand. Flowserve did not authorize the Government to release this drawing but confirmed that distributors would not need access to the drawing itself to quote. There are no other manufacturers that offer an authorized alternative for this item and as the Government does not own the drawings they cannot be provided to any other manufacturers to design a replacement valve. The requested check valve are “direct replacements” for the existing equipment already installed/utilized on the vessel.

OEM Flowserve Corporation does not sell their products directly to the Government, only through their authorized distributors.

6. Describe the efforts made to ensure that offers are solicited from as many potential sources as possible

The Contracting Officer shall publish the notices required by FAR 5.201.

7. Fair and Reasonable Cost Determination:

I hereby determine that the anticipated cost or price to the Government for this contract will be fair and reasonable. It is anticipated that market research and prior purchases will be used among other methods to determine the price to be “fair and reasonable”.

8. Market Research:

Market research was conducted from JAN 2026 – FEB 2026.

The required mandatory sources were checked on 14 JAN 2026, and the requested check valve was not available via AbilityOne, GSA, nor UNICOR. The Contract Specialist confirmed that

For Official Use Only other federal organizations, including the Department of The Navy, have previously procured OEM Flowserve Corporation “check valve” of various types through the OEM’s authorized distributors per FPDS-NG.

Given the availability of procuring the requested supplies via the OEM’s authorized distributors/resellers, this requirement will be solicited as other than full and open competition for “Brand Name” OEM Flowserve Corporation procurement.

9. List any sources that expressed an interest in this acquisition in writing

N/A.

10. Actions to Remove Barriers to Future Competition

For the aforementioned reasons and justifications, NAVSUP FLCPS currently has no plans at this time to compete future procurements for these types of check valves as covered by this document.

If another authorized potential source(s) emerge, NAVSUP FLCPS will then re-assess whether competition for future requirements is feasible.

11. Any Other facts supporting the use of other than full and open competition.
