ICE MACHINE MAINTENANCE AND REPAIR SERVICES FOR NAVAL CONSTRUCTION CENTER (NCTC)
1. General. This is a non-personal services contract to provide maintenance and repair services. Contractor management shall ensure that employees properly comply with the performance work standards outlined in this performance work statement. Contractor employees shall perform their duties independent of, and without the supervision of, any Government official or other Defense Contractor. The tasks, duties, and responsibilities set forth in this project may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriated funds of the United States Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will control access to the facility and will perform the inspection and acceptance of the completed work.
1.1. Background. The Naval Construction Training Center (NCTC), Gulfport is a naval shore activity in an active operating status. An Echelon V Command, NCTC's Commanding Officer reports to the Center for Seabees and Facilities Engineering (CSFE); the Naval Education and Training Command (NETC); and ultimately, to the Chief of Naval Operations (CNO), respectively. NCTC Gulfport is subject to the regional area coordination authority of the Commanding Officer, Naval Construction Battalion Center (NCBC) Gulfport.
1.2 Scope - This Performance Work Statement (PWS) describes contractor services requiring maintenance personnel to be experienced in servicing and repairing ice machines. Parts and labor are to be included as part of the contract. Contractor shall provide all labor, tools, and equipment required to perform specified work. There are EIGHT (8) MANITOWOC ice machines all located in different buildings within a one (1) mile radius.
1.3 Period of Performance. Period of performance shall be for one (1) base year of 12 months and four (4) option years as follows:

1.4 Hours of Operation.
Normal Work Hours. The Contractor is responsible for providing service, between the hours of 0700 to 1500, Monday through Friday, except on Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor shall at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.5 Federal Government Holidays.

-When one of the above designated legal holidays falls on a Sunday, the following Monday will be observed as a legal holiday. When a legal holiday falls on a Saturday, the proceeding Friday is observed as a legal holiday. This list of holidays relates to Government duty days and is not intended to supplement or otherwise alter the provisions of any Wage Determination regarding applicable paid holidays.
-It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not be a reason for an additional period of performance, or entitlement of compensation except as set forth within the contract. In the event the Contractor’s personnel work during the holiday, the Contractor may reimburse them; however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked, unless stipulated otherwise. This provision does not preclude reimbursement for authorized overtime work if applicable.
-When the Department of Defense grants excused absence to its employees, the Contractor agrees to continue to provide sufficient personnel to perform critical tasks already in operation or scheduled and shall be guided by the instructions issued by the Contracting Officer (KO) or the Technical Point of Contact (TPOC). Changes in employee work schedules shall comply with the terms and conditions of the contract, to include payment provisions.
-If Government personnel are furloughed, the Contractor shall contact the KO or the COR to receive direction. It is the Government’s decision as to whether the contract price/cost will be affected as a result of Government shutdown and/or furloughed Government employees. In the event of a government shutdown or furloughed Government employee(s) impacts contract price/cost, a negotiated settlement will be reached as deemed appropriate by the KO.
1.6 Place of Performance
The work to be performed under this contract will be performed at the following buildings located at Naval Construction Training Center (NCTC):

1.7 Quality Control.
Quality Control is the responsibility of the Contractor. The Contractor is responsible for the delivery of quality services to the Government in accordance with (IAW) the terms and conditions contained in Federal Acquisition Regulation (FAR) Subpart 52.212-4 entitled, “Contract Terms and Conditions - Commercial Items” and applicable sub-clauses pertaining to quality control.
Part 2
GOVERNMENT FURNISHED ITEMS AND SERVICES
2.0 Government Furnished Items and Services.
2.1. Materials. The Government will provide all parts and materials for the ice machines.
2.2. Services. The Government will provide services to facilitate Contractor access to NCTC Gulfport and NCTC buildings where the ice machines are located.
2.3. Facilities. The Government will provide access to facilities for the Contractor’s use in support of this contract. Any alterations to facilities shall be approved in writing and property shall be returned to its original condition prior to completion of this contract. Contractor shall be responsible for any damages or loss of use due to their negligence. Any signage shall conform to standard Navy/Installation signs/format, shall be approved by the KO and Government Representative in writing prior to placement, and may not be permanently affixed to any Government property or structure.
2.4. Utilities. The Government will provide all utilities in the facility and will be available for the Contractor’s use in performance of tasks outlined in this PWS. The Contractor shall instruct employees in utilities conservation practices. The Contractor shall be responsible for operating under conditions that preclude the waste of utilities.
Part 3
CONTRACTOR FURNISHED ITEMS AND SERVICES
3.0 Contractor Furnished Items and Responsibilities.
3.1. Contractor Furnished Items. Everything included in this paragraph and its subparagraphs is basic to the contract and should be included in the contract price.
3.1.1. The Contractor shall provide all labor, supervision, transportation, vehicles, supplies, equipment, materials, facilities and services required to perform work under this contract that are not listed under Section 2 of this PWS.
3.2. Responsibilities of the Contractor.
a. The Contractor shall provide a safe working environment for key consultants and all persons in his/her employ as prescribed by 29 CFR 1910 “Occupational Health and Safety.” The Contractor shall be responsible for all damages to persons and property that occur in connection with the work and service under this contract, without recourse against the Government.
b. Contractor shall be responsible for all loss or damage to Government property, while in the performance of these contract requirements, which result in whole or in part from the negligence or omissions of the Contractor, any of its Subcontractors, or any employee, agent, or representative of the Contractor or Subcontractor(s).
c. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract.
Part 4
SPECIFIC TASKS
4.0 General. The Contractor shall provide all skilled personnel, equipment, supplies, tools, materials, supervision, and other items necessary to perform this prescribed project as defined in this PWS to meet the performance requirements, except for those items specified as Government furnished items and services.
4.1. Maintenance and Repair Services. The Contractor shall provide maintenance, to include cleaning and sanitizing machines, and repair in accordance with (IAW) NAVMED P-5010 to the following ice machines:

4.2 Maintenance Services. The Contractor shall provide preventative maintenance services four (4) times a year to minimize major issues and costs associated with health and repairs.
Preventative maintenance visits shall be performed every 90 days to minimize major issues and costs associated with health and repairs. Maintenance personnel must check in and be escorted to each ice machine. Upon completion of service of each ice machine and a DGR visual inspection of work is done, maintenance personnel must provide a paper copy of ticket describing work performed to the DGR for signature. Visits should include cleaning, sanitizing IAW NAVMED P-5010 and general maintenance.

4-503.11 Maintenance of ice machines
(A) Ice machines shall be cleaned and sanitized as specified under Subparagraph 4-602.11(E)(4).
(B) The procedures and frequency for cleaning and SANITIZING ice machines shall be provided in a standing operating procedure (SOP) by the FOOD ESTABLISHMENT for FOOD
EMPLOYEES.
(C) Ice machine water and air filters shall be changed at a frequency recommended by the manufacturer or at least once every 6 months; and
(D) Filter changes shall be documented in a maintenance log or annotated on the filter using permanent marker, indicating the date and name of the person who replaced the filter.
Maintenance logs shall be available onsite for inspection by the REGULATORY AUTHORITY.
4-503.12 Operation, restrictions
(A) Except as specified in ¶ (B) of this section, the responsibility for packaging ice and cleaning and SANITIZING ice machines is restricted to EMPLOYEES who have received proper FOOD sanitation training as specified under § 2-501.11, Subpart 2-503, and § 2-504.13.
(B) Cleaning and SANITIZING of ice machines may be performed by the equipment manufacturer or qualified cleaning personnel, as specified in the facility’s service contract.
4-602.11(E)(4) (d) Ice machines and dispensers are emptied, drained, cleaned, and SANITIZED as often as necessary to prevent accumulation of mold, mildew, or other debris. The REGULATORY AUTHORITY based on local conditions may increase frequency.
4.3 Repair Services. The Contractor shall make a determination of the cost effectiveness of repair or replacement on a case-by-case basis and perform services upon Government approval.
The maintenance personnel shall make a determination of the cost effectiveness of repair or replacement on a case-by-case basis. If materials are required to complete service, the contractor SHALL prepare a list of the required equipment with descriptions and serial numbers so that the NCTC Designated Government Representative (DGR) can submit the appropriate Micro Purchase request form. All replacement parts will be provided to the contractor by the government, and all replaced parts removed from the machines will remain in the custody of NCTC. All filters will be purchased by the NCTC DGR. NCTC DGR will grant final approval for all repairs or replacement parts prior to service being performed. All irreparable ice machines and replacement parts remain as property of the U.S. Government.
4.4 Response Time. A 48-hour response time is required upon receipt of all service repair requests submitted during normal working hours.
Contract must be set up on a per call basis. A 48-hour response time is required upon receipt of all service requests submitted during normal working hours between 07:00 to 15:30 Monday through Friday. No repair work required after normal working hours, on weekends, or holidays.
4.5 Point of Contacts:

Part 5
CONTRACTOR ACCESS AND USE OF PREMISES
The contractor shall be responsible for securing the necessary permits and base access passes for contractor personnel, vehicles, and equipment for the duration of the contract. Naval Construction Training Center Gulfport Security Forces reserve the right to refuse issuance of a pass to an employee of the contractor for any reason deemed valid by the Government.
Contractors must identify themselves as either a U.S. Owned or a Foreign Owned, Controlled or Influenced (FOCI) entity.
Citizenship. Visitors must be U.S. citizens. Foreign nationals are rarely granted access unless certain arrangements have been made with Naval Construction Training Center Gulfport.
U.S. citizen personnel of a Foreign Owned, Controlled or Influenced (FOCI) entity will be required to provide the Naval Construction Training Center Gulfport security forces at the Pass and ID Office, located at their Main Gate, with vehicle registration, proof of insurance, driver’s license, and second form of picture ID. A Visit / Access Request on company letterhead is also required at least 48 hours (recommend at least five days) in advance of item(s) delivery.
U.S. Owned company personnel will be required to provide the security forces with vehicle registration, proof of insurance, and driver’s license.
Infrequent Access (<30 days/year): Unless the contractor/visitor is registered in the Defense Biometric Identification System (DBIDS), all infrequent visitors of less than 30 consecutive days will be required to stop at the Naval Construction Training Center Gulfport Pass Decal office every day to obtain a one-day pass until work is completed.
Part 6
DEFENSE BIOMETRIC IDENTIFICATION SYSTEM (DBIDS)
Defense Biometric Identification System (DBIDS). The Defense Biometric Identification System (DBIDS) is a DoD-owned and operated system developed by Defense Manpower Data Center as a force protection program to manage personnel identity and access at DoD installations. DBIDS is a network database system designed to easily verify access authorization of personnel entering military installations by using barcodes and fingerprint biometric identifications.
To improve management and force protection at Navy installations, the Navy is transitioning from using the Navy Commercial Access Control System (NCACS) to the Defense Biometric Identification System (DBIDS) for Contractors and vendors requiring access to an installation at no cost to them. The transition will begin 17 April 2017 and individuals will have up to 180 days to obtain the permanent card. After August 14, 2017, NCACs cards will no longer be accepted.
In order to obtain base access, an individual needs to acquire DoD sponsorship, have a thorough identity check, be properly vetted, and have a legitimate reason for base access. Identity checks require a passport or a Real ID Act-compliant state driver's license. Vetting occurs when the individual's background and ID are compared against authoritative criminal justice data bases, and the individual has a letter or official document from the sponsoring organization which articulates the reason for access. When the above criteria are satisfactorily met, DBIDs credentials are issued.
NCACS cardholders will have 120 days from April 17, 2017 to obtain a temporary DBIDS paper pass. After the applicant obtains their DBIDS paper pass, they will have an additional 180 days to obtain an actual DBIDS card at no cost. Those requesting new access onto installations will receive the DBIDS card at the same time they are initially approved for access. After August 14, 2017, NCACS cards will no longer be accepted for installation access.

Part 7
AUTHORIZED CHANGES ONLY BY THE CONTRACTING OFFICER
(a) Except as specified in paragraph (b) below, no order, statement, or conduct of government personnel who visit the contractor's facilities or in any other manner communicate with contractor personnel during the performance of this contract shall constitute a change under the "Changes" clause of this contract.
(b) The contractor shall not comply with any order, direction or request of government personnel unless it is issued in writing and signed by the Contracting Officer, or is pursuant to specific authority otherwise included as a part of this contract.
(c) The Contracting Officer is the only person authorized to approve changes in any of the requirements of this contract and notwithstanding provisions contained elsewhere in this contract, the said authority remains solely with the Contracting Officer. In the event the contractor effects any change at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in charges incurred as a result thereof.
