BID POLICY
RIGHT OF REJECTION: The County reserves the right to reject any and all bids. No bidder shall have any right, legal or equitable, or claims against the County for any expenses or costs incurred by him in the preparation or submission of his bid, which is rejected, regardless of the reason of rejection.
MINOR IRREGULARITIES MAY BE WAIVED: The County expressly reserves the right to waive minor or slight irregularities in a bid which in the County’s judgment are in the best interest of the public. The County’s decision on irregularities in a bid shall be final and conclusive and shall create no right for any bidder. Bids may be rejected which are not submitted into the U3P portal on the forms furnished to the bidder by the County.
No alterations in bids will be accepted unless each alteration is signed or initialed by the bidder. If initialed, the County may require the bidder to identify any alterations so initialed. A bid may be rejected in which omissions occur or which has been conditioned by the bidder or wherein any alterations are unacceptable to the County. A bid may be rejected if addenda are not acknowledged.
BID TO BE PROPERLY POSTED: In order for Bids to be considered compliant and complete they shall be properly posted into the U3P portal prior to the deadline indicated for the posting of Bids. An Abstract of Bids will be prepared and will be available to Bidders on Request.
PREPARATION: The bid shall be legible, written in ink or typed on the forms furnished by the County and shall be completely executed by the bidder in ink in his full signature. Any omission of the prices on such items as shown on the bid forms with any addition in writing to the form of the bid or any condition, limitation or provision will render the proposal informal and may cause its rejection.
INTERPRETATION: If any prospective bidder is in doubt as to the true meaning of any of the parts of the invitation to bid, they may request an interpretation by the County.
Interpretation will be made only by addendum duly mailed and delivered to each prospective bidder who received a copy of the invitation to bid. In order to have a request for interpretation considered, the bidder must deliver the request to the County no less than five days prior to the bid opening date.
BIDDER’S WARRANTIES: By submission of the bid, the bidder represents that they have carefully examined the specifications and all other contract documents and that the bidder is fully informed concerning the requirements of the contract, the physical conditions to be encountered and the character, quality and quantities of service to be performed and of materials and equipment to be furnished. The Contractor will not be entitled to additional compensation if he subsequently finds that conditions require
002113 - 2 methods or equipment other than anticipated by him in making his bid. Negligence or inattention of the contractor in determining site conditions prior to filing his bid shall be grounds for a refusal by the County to agree to additional compensation for additional work caused by such negligence or inattention.
RESPONSIBILITY FOR DELIVERY OF PROPOSAL: It is the sole responsibility of the bidder to properly post their Bid in the U3P portal prior to the posted deadline Date noted in the U3P portal. The Bid shall be accompanied by the bid bond, any other necessary guarantees, and noted Documents that are required in the specifications or invitation to Bid. Any bid received after the scheduled closing for the receiving of bids may be rejected, regardless of the cause of the late receipt.
WITHDRAWAL OF REVISION: A bidder may, without prejudice to himself, withdraw, modify, or correct his bid after it has been deposited with the County, provided his request is made in writing to the County and prior to the closing time set for receiving bids. All modifications or corrections made by written communications received on time will be opened in public and read aloud prior to the opening of the bids when such modifications or corrections are in order and acceptable to the County, changes will be made in the respective bid in accordance with the communication. Bids not accompanied by the bid bond (if required by the specifications or invitation to bid) will not be accepted.
ACCEPTANCE OR REJECTION OF PROPOSALS: The County reserves the right to accept the bid which in the judgment of the County is the lowest responsible bid and to reject any and all bids and to waive irregularities in the bid. Any or all bids will be rejected if there is reason to believe that collusion exists among the bidders. The County may reject bids from bidders who are in default on a previous contract with the County.
Implicit in this right is the right to award such contract to other than the lowest bidder.
For bids containing more than one schedule of dissimilar work or for separate types or kinds of equipment or supplies, the County reserves the right to award contracts for individual schedules or items to individual contractors, to combine schedules or items, or to delete items or schedules.
SANCTIONS: The County reserves the right to reject any bids, or to rescind any contracts resulting from any bid, which; (1) results from a conflict of interest under County Ordinances, State Statute or other applicable laws; (2) results from a person or firm trying to influence the award of such contract by offering some thing of value to any County employee.
