No bid bond or performance bond is required. The successful bidder must be a contractor deriving major income from arboricultural work with highly-trained, skilled employees, and must provide a project crew leader and any additional crew leaders who are International Society of Arboriculture (ISA) Certified Arborists. Bidders must comply with ANSI Z-133.1 Standard for Tree Care Operations and ANSI A300 Pruning Standards. The contractor shall provide Liability and Property Damage Insurance of not less than $1,000,000 per person for bodily injury and $2,000,000 per accident, plus $1,000,000 for property damage per accident and $2,000,000 for all accidents, with the City named as additional insured. A Certificate of Insurance and current Worker's Compensation Certificate must be submitted prior to contract execution. Bidders must provide a list of at least four municipal tree work references from the past five years and supply daily updates on a shared electronic working list. The City reserves the right to award the contract for the Base Bid only or for the Base Bid plus any combination of Alternates to the lowest and best bidder. Materials may be purchased tax-free, and successful bidders must withhold all City income taxes for employees and approved subcontractors. Working hours are permitted between 8:00 a.m. and 8:00 p.m., Monday through Saturday, excluding state and federal holidays, with all debris and wood waste disposal the responsibility of the contractor at no additional expense to the City.

NOTICE TO BIDDERS

Bids for the 2026 Tree Pruning (Project No. 2026-202) will be received by the City of Westerville, Ohio until the closing date and time of 3:00 p.m. (local time) on Thursday, January 8, 2026, and will be publicly opened and read immediately thereafter.

The work per the Contract Documents and Specifications, dated December 9, 2025, and any addenda thereto, includes all labor, materials, supervision, equipment, services, and expertise required to accomplish the maintenance pruning of trees along City streets or growing on City property for clearance, risk reduction, and structural improvement. The Base Bid tree pruning list includes approximately 1,960 trees.

The Alt. No. 01 tree pruning list includes approximately 245 trees, the Alt. No. 02 tree pruning list includes approximately 375 trees, and the Alt. No. 03 tree pruning list includes approximately 510 trees.

The Contract Documents and Specifications are available at no cost via the City’s Bonfire Procurement Portal at: https://westerville.bonfirehub.com/opportunities/213276. Vendors new to the City’s Bonfire Procurement Portal will need to create a FREE Bonfire account.

No bidder may withdraw their bid for a period of 60 days after the actual bid closing date and time. The City reserves the right not to award a contract and to reject any or all bids and to waive any informalities and irregularities. Subject to the right of the City not to award a contract and to reject any or all bids, the City will award a contract to the bidder submitting the lowest and best bid, taking into consideration accepted alternates.

General Instructions for Electronic Bids

All bids must be submitted on the bid forms provided and receipt of any addenda should be indicated. All blank spaces shall be filled in, in ink or typed, in figures. The bidder shall provide unit prices and/or lump sum prices on the Bid Schedule form. Bidders must complete all Base Bid items and Alternates contained in the Bid Schedule. All bids not in conformity with this notice may be considered informal and may be rejected. Failure to furnish all information requested on the Bid Schedule or other documents requested may result in disqualification of the bid.

It is the sole responsibility of the bidder to see that their bid is received by the proper time. Bidders are urged to submit with their bid a completed Experience Record form.

Lump sum prices set forth shall include all trades, materials, supplies, tools, equipment, labor, supervision, vehicles, fuels, delivery, services, installation, overhead, profit, and any other cost or expense, in connection with or incidental to, the performance of the work to which the prices apply.

If alternative bid items are listed in the Bid Schedule, the City shall determine the Alternates so selected in determining the lowest and best bid. The City reserves the right to award a contract to the lowest and best bidder for the Base Bid only or for the Base Bid plus any combination of Alternates.

BONDS

No bonds, either a bid bond or performance bond will be required.

CONTRACT

The bidder to whom the award is made will be required to execute a written contract with the City of Westerville, Ohio as required by the City Manager.

NONDISCRIMINATION IN EMPLOYMENT

The contractor (successful bidder) agrees that in the hiring of employees for the performance of work under this contract or any subcontract, no contractor, subcontractor, or any person acting on their behalf shall, by reason of race, color, religion, sex, national origin, age, familial status, military status, disability, pregnancy, sexual orientation, gender identity, or gender expression, or any prohibition provided by federal or state law, discriminate against any citizen of the State in the employment of labor or workers who are qualified and available to perform the work to which the employment relates, nor shall the contractor, subcontractor, or any person acting on their behalf, in any manner, discriminate against or intimidate any employee hired for the performance of work under the City’s contract on account of race, color, religion, sex, national origin, age, familial status, military status, disability, pregnancy, sexual orientation, gender identity, or gender expression, or any prohibition provided by federal or state law.

INTERPRETATION

The Contract Documents and Specifications contain the provisions required for the 2026 Tree Pruning project. Information obtained from an officer, agent, or employee of the City or any other person shall not affect the risks or obligations assumed by the contractor or relieve the contractor from fulfilling any of the conditions of the contract.

If any person contemplating submitting a bid for the proposed project is in doubt as to the true meaning of any part of the Contract Documents and Specifications, they may submit a written request for an interpretation thereof to either the Point of Contact identified in the Contract Documents and Specifications or the Project Portal.

The Q&A period for this opportunity ends at 3:00 p.m. (local time) on Friday, December 19, 2025.

The person submitting the request will be responsible for its prompt delivery. Any interpretation of the Contract Documents and Specifications will be made only by Addendum duly issued, a minimum of 72 hours prior to the bid closing date and time. The City will endeavor to have a copy of such Addendum delivered to each person receiving a set of Contract Documents and Specifications; however, it is ultimately the bidder’s responsibility to check the CITY’s Bonfire Procurement Portal (https://westerville.bonfirehub.com/opportunities/213276) for verification of any issued addenda. The awarding authority will not be responsible for any other explanations or interpretations of the Contract Documents and Specifications.

PERSONAL PROPERTY TAX AFFIDAVIT AND NONCOLLUSION AFFIDAVIT

The successful bidder will be required to execute and submit a completed Noncollusion Affidavit and a completed Personal Property Tax Affidavit, as included in the Contract Documents and Specifications prior to the issuance of the Notice to Proceed. Bidders are urged to include these documents in their bid.

COMPLIANCE

In performing the work, the contractor shall comply with all applicable laws, rules, regulations, codes and ordinances, including but not limited to the U.S. Department of Labor “Safety and Health Regulations for Construction” identified as Chapter XVII of Title 29, Code of Federal Regulations (CFR) Part 1926 (formerly Part 1518) and subsequent amendments.

REJECTION OF BIDS

The City of Westerville, Ohio reserves the right not to award a contract and to reject any or all bids and to waive any irregularities in bidding.

TAXES

Materials to be incorporated in the work may be purchased by the contractor free of Ohio State sales tax.

The successful bidder will be required to withhold all City income taxes due or payable under the provisions of the Income Tax Ordinance, for wages, salaries, and commissions paid to its employees and further agrees that any of its subcontractors shall be required to agree to withhold any such City income taxes due under said chapter for services performed under this contract.

PRICE; TERM

Bids are to be good for sixty (60) days after the actual bid closing date and time. The City may hold the bids for sixty (60) days after the actual bid closing date and time, and may award the contract at any time during that period. Should there be reasons why the contract cannot be awarded within the specified period; the time may be extended by mutual agreement between the City and the bidder.

INDEMNITY

The Contractor shall indemnify and hold harmless the City of Westerville, Ohio, from all suits, claims, damages, losses and expense, including attorney fees, arising out of or resulting from the performance of the work including royalties or infringement of patents that may be involved in the use of equipment, machinery, supplies or material, and the Contractor shall undertake to defend, at their own expense, any and all suits brought against the City of Westerville, by reasons of the things above specified.

The Contractor and the Contractor’s subcontractors shall secure and maintain Liability and Property Damage Insurance (1) in an amount not less than One Million Dollars ($1,000,000) for bodily injuries, including wrongful death, to any one person, subject to the same limit for each person, in an amount not less than Two Million Dollars ($2,000,000) for bodily injury damages for any one accident; and (2) in an amount not less than One Million Dollars ($1,000,000) for property damages on account of one accident and in an amount of Two Million Dollars ($2,000,000) for damages for all accidents. Greater amounts shall apply, where required by law. If the Contractor and the Contractor’s subcontractors maintain higher limits than the minimums shown above, the City shall be entitled to coverage for the higher limits.

The Insurance policies secured in compliance with the above requirements shall bear endorsements extending automatic coverage on all operations of the Contractor incidental to the performance of the WORK to be done under this Contract, whether such operations are listed in the insurance contracts or not, and whether the work is being done at the site of the project or not. The City shall be named as an additional insured. The Contractor will be required to submit a Certificate of Insurance and a current Worker’s Compensation Certificate to the City prior to the execution of the Agreement.

PUBLIC OPENING OF BIDS

Bids will be publicly opened and read immediately after the deadline for the submission of Bids. Bidders, their authorized agents, other interested parties, and the general public are invited to be present. The public opening of bids will be held at the City’s Walnut Street administrative offices, located at 64 E. Walnut Street, Westerville, Ohio 43081. The public opening will also be shared online via Google Meet. Instructions for joining the Google Meet session will be posted to the City’s website in advance of the public opening.

DEMONSTRATIONS

The City has the right to inspect items and request demonstration before award of bid.

PUBLIC RECORDS

In entering into a contract with the City (or responding to a City solicitation), all Contractors are hereby notified that all bids, proposals, quotations, RFI responses, agreements, invoices, correspondence and any other documents submitted to the City become public property and are subject to public disclosure in accordance with Ohio Public Records Law. All public records will be made available upon request, at the earliest time permitted by law.

TERMINATION

The City reserves the right to terminate the contract in whole or in part for default (termination due to the Contractor’s failure to perform satisfactorily) or convenience (termination due to the best interests of the City). After 10 days from delivery of a written notice to the Contractor, the City may, without cause and without prejudice to any other right or remedy, elect to terminate the contract. In such case, the Contractor shall be paid for work executed, goods delivered and accepted, and any expense sustained plus reasonable profit, unless such termination was due to the act or conduct of the Contractor.

PARKS AND RECREATION DEPARTMENT

GENERAL REQUIREMENTS FOR

2026 TREE PRUNING

1.0 GENERAL SPECIFICATIONS:

These specifications describe the work to be performed to provide all labor, materials, supervision, equipment, services, and expertise by one contractor required to accomplish forestry maintenance work in the City of Westerville. This work is potentially hazardous, requires specific expertise and, therefore, is to be performed by a contractor who derives its major income from arboricultural work, and whose employees are highly-trained—skilled in all phases of tree service, including work in close proximity to utility lines. The project crew leader and any additional crew leaders are required to be a “Certified Arborist” with the International Society of Arboriculture (ISA).

● The contractor shall bid a price for pruning each list of trees per these contract specifications.

● Work Practices shall conform to the most recent ANSI. Z-133.1 Standard for Tree Care Operations and ANSI A300 Pruning Standards. The specific parts of A300 Pruning objectives expected for this contract are spelled out in section 7 of these specifications.

● Maintenance pruning includes trimming of trees along City streets or growing on City property for clearance, risk reduction, and structural improvement. See the lists accompanying these specifications for exact locations.

● Pruning should be done with an understanding of how the tree responds to each cut. Improper pruning can cause damage that will last for the life of the tree.

● Pruning cuts shall be made just outside the branch collar.

● The Contractor is responsible for furnishing all trades, materials, supplies, tools, equipment, labor, supervision, vehicles, fuels, delivery, services, and appurtenances necessary to perform contractual tree pruning. The City reserves the right to, at any time, use its own forces, equipment, tools, conveyances, and materials or those of another contractor to perform the work.

● The Contractor is responsible for daily updates of work completed on a “shared electronic working list.”

● Payment for tree pruning will be made only after acceptance of requested reports and quality check of the work is completed. If after work is inspected, corrections are needed, payment will be held until corrections have been made to the City’s satisfaction.

● Work is expected to be completed by March 31, 2026.

● Only trees designated by the Parks Forestry Manager (Manager) or their designee shall be pruned.

● The Contractor shall contact the Manager immediately of trees unable to prune because of parked cars. The City will contact the homeowner to have the vehicle moved so that the tree may be pruned as soon as possible.

● All re-work shall be done at the Contractor’s expense.

● Before any work begins, the City of Westerville will meet with the contractor’s representative to discuss the project. This meeting will occur at a place and time determined by the City and will cover the issues required by the City under this contract.

● All work shall be performed by the quoting vendor unless a sub-contractor has been requested, and approved prior to the awarding of this contract.

2.0 GENERAL REQUIREMENTS:

● The CONTRACTOR and the CONTRACTOR’S subcontractors shall secure and maintain Liability and Property Damage Insurance (1) in an amount not less than One Million Dollars ($1,000,000) for bodily injuries, including wrongful death, to any one person, subject to the same limit for each person, in an amount not less than Two Million Dollars ($2,000,000) for bodily injury damages for any one accident; and (2) in an amount not less than One Million Dollars ($1,000,000) for property damages on account of one accident and in an amount of Two Million Dollars ($2,000,000) for damages for all accidents. Greater amounts shall apply, where required by law. If the CONTRACTOR and the CONTRACTOR’S subcontractors maintain higher limits than the minimums shown above, the CITY shall be entitled to coverage for the higher limits.

● The Insurance policies secured in compliance with the above requirements shall bear endorsements extending automatic coverage on all operations of the CONTRACTOR incidental to the performance of the work to be done under this CONTRACT, whether such operations are listed in the insurance contracts or not, and whether the work is being done at the site of the project or not. The CITY shall be named as an additional insured. The CONTRACTOR will be required to submit a Certificate of Insurance and a current Worker’s Compensation Certificate to the City prior to the execution of the Agreement.

● The Contractor will be liable for damages to private property and facilities of the City, which includes but is not limited to flowers, plantings, fences, irrigation lines, and structures. Proper respect for private property is to be displayed by the Contractor’s employees at all times.

● The Contractor is to provide the City with a list of no less than four (4) references of parties where municipal tree work has been performed within the last five (5) years.

● Working hours may be between 8:00 a.m. and 8:00 p.m., Monday through Saturday, excluding state and federal holidays.

● The contractor will notify the Manager daily as to the work locations for the crews. This shall be done prior to the day’s work and whenever there is a change in location during the day.

● At no time shall the contractor or their employees enter into any agreements that may be held against the City. There shall be no solicitation to residents of the city during this contract.

3.0 EQUIPMENT REQUIREMENTS:

● Equipment utilized shall be appropriate for the work to be performed and in safe proper working condition meeting all state and federal requirements. All vehicles shall be clearly marked with the company name.

● At all times crew members shall wear approved safety gear (hard hats, safety glasses, etc).

4.0 MANPOWER REQUIREMENTS:

● The contractor shall supply the City with the name and contact phone number for the person that will be responsible for the day-to-day activities with the City.

● The appearance of the Contractor Work Force reflects on the City, a professional appearance complete with a company-issued uniform, in good condition will be required.

● On-site supervision by an ISA Certified Arborist is required for each crew.

5.0 CLEANUP, CHIPPING AND DUMPING:

● All brush, logs, and debris shall be removed from public Rights-of-way, private roads, or lawns at the conclusion of each workday unless arrangements have been made with a representative of the City and the property owner.

● All streets, sidewalks, or lawn areas will be swept clean of sawdust or wood fragments each day prior to leaving any job site.

● The Contractor shall be responsible for all wood waste disposals related to the tree removal at no additional expense to the City.

6.0 TRAFFIC CONTROL

● Contractor must take measures to expedite safe public passage through or around the work area.

● Contractor must give adequate warning to vehicles and pedestrians approaching the work zone.

● Whenever the work zone restricts traffic, the contractor must use the appropriate combination of safety devices as outlined in the “Manual on Uniform Traffic Control Devices”, published by the Federal Highway Administration.

● All traffic control and safety measures must meet industry standards (ANSI Z133) and will be the responsibility of the contractor.

7.0 PRUNING OBJECTIVES

● Ensure that trees growing in the right-of-way meet codified standards for clearance, where possible. Code calls for 10 feet over sidewalks, 12 feet over roadways, and 16 feet over thoroughfares. NOTE: Live crown ratio shall not be reduced to less than 50 percent.

Directional pruning of the canopy shall be utilized for trees that cannot be elevated to the codified standards.

● Bottom branches shall be reduced in length as necessary to prevent them from dropping low soon after the growing season begins.

● Remove any broken branches over 1-inch diameter, hazardous branches (any size), and dead branches over 1-inch diameter. Any water sprouts on the tree trunk or suckers at the base shall always be removed. Epicormic sprouts in the scaffold branches shall be selectively pruned when rejuvenation is needed.

● Young and medium-aged trees shall have a dominant leader selected as appropriate. Also, a strong properly spaced scaffold branch structure should be selected and maintained by reducing or removing others.

● Thinning is expected when elevation and structural needs are minimal. Thinning should result in an even distribution of branches on individual branches throughout the crown.

● Typically no more than 25% of live foliage should be removed from any one tree. In some cases, with young trees, it may be necessary to provide for a good structural pruning. Example:

TO THE CITY OF WESTERVILLE, OHIO, having carefully examined the site of the work, the Contract Documents and Specifications, General Requirements, Tree Pruning Contract Lists, and other documents for the proposed work, and being familiar with all of the conditions surrounding the 2026 Tree Pruning (Project No. 2026-202) including the availability of materials and labor, Bidder hereby agrees to perform all work in strict accordance with the Contract Documents and Specifications to the complete satisfaction of the City, within the time specified for the lump sum prices set forth below. The wording on the Bid Schedule shall be used throughout, without change, alteration, or addition. Bidders should complete their Bids in figures and in words. Words take precedence over figures in all items. All Bidders must complete all Base Bid items and Alternates.

The Base Bid items and Alternates are lump sum bids.
