About this file

This is a Claim of Business Confidentiality document related to Contract 256336 Amendment 4, a funds increase contract for the State of Utah Division of Purchasing. The document pertains to a non-competitive procurement award being sought by a Conducting Procurement Unit under the Utah Procurement Code, which allows contracts to be awarded without standard procurement processes under specific circumstances, including sole source situations, significant transitional costs, or other circumstances deemed impractical through standard processes. The filing establishes the procedural framework for the Division of Purchasing to evaluate and potentially approve the non-competitive award based on documented justifications submitted by the conducting unit.

The claim of business confidentiality indicates that proprietary or sensitive business information has been submitted as part of the justification for the non-competitive award. This confidentiality designation protects commercially sensitive details from public disclosure while allowing the Division of Purchasing to review the necessary documentation to determine whether the criteria for awarding a contract without competition have been met. The amendment involves a funds increase to the existing contract, suggesting this is a modification to expand the scope or extend funding rather than a new procurement action.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
