About this file

This document is a Request for Response (RFR) issued by the Massachusetts Department of Mental Health (DMH) seeking to establish a Master List of approved camps to which DMH can refer children as needed during the summer and other times they are not in school. DMH is seeking to include a wide range of camps, from highly specialized ones for youth with particular behavioral health needs to community organization camps, with the ability to plan and coordinate services with DMH. The RFR has an open enrollment process, with responses accepted until December 31, 2024, though new camps must be submitted by January 31st each year to be included for the upcoming summer. DMH will enter into a contract with each approved camp provider, with an initial 4 year and 7 month contract term and up to 5 one-year renewal options.

The RFR outlines pricing requirements, with DMH recommending a weekly rate structure but open to alternative unit-based pricing as well. Payment will be on a fee-for-service basis, with no guaranteed minimum expenditures but an estimated annual spend of $1 million and total over the life of the procurement of $10 million. DMH will make referrals to approved camps based on factors such as the child's needs, camp availability and location, and best value to DMH.

This Bid has been released on COMMBUYS. COMMBUYS is the official source of information for this Bid and is publicly accessible at no charge at_www.COMMBUYS.com. For more information on COMMBUYS, please see Attachment A to this Bid, Information on COMMBUY and the Supplier Diversity Program. In COMMBUYS, a “bid” refers to the solicitation, Request For Response (RFR) or procurement. All Attachments are included in the Attachment Section of the Bid on COMMBUY.

An individual or organization submitting a response to this Bid (Bidder) may not alter (manually or electronically) the Bid language or any Bid component files, except as directed in the Bid. Modifications to the body of the Bid, specifications, terms and conditions, or which change the intent of this Bid are prohibited and may disqualify a Response.

1.2 Procurement Scope and Description

The Department of Mental Health (DMH) seeks to establish a Master List of approved camps to which the Department can send children as needed during the summer (June through Labor Day) and/or other times children are not in school.

A camp for this purpose is defined as follows:

A day or residential summer camp program, after school or school vacation program that operates on a permanent site; conducted for recreation or recreational instruction; operates for four or more days or nights; for profit or charitable purposes; and serves at least five children unrelated to the operator. Refer to the DPH regulation 105 CMR 430.000. A camp includes all programs operated under the same DPH license.

DMH seeks to include on the Master List a wide range of camps, from highly specialized camps for youth with particular behavioral health needs to camps operated by community organizations that all children can access but are also able to meet the needs of youth with behavioral health challenges. Camps must have the capability to plan and coordinate services with DMH. DMH also seeks to include on the Master List camps from across the Commonwealth. Out-of-State camps may also be included.

DMH will use the camps as needed for: (1) DMH Clients living in the community; (2) children and adolescents receiving services via Children’s Behavioral Health Initiative (CBHI) through their local Community Service Agency (CSA), and (3) siblings of DMH Clients. DMH may consider using camps for other DMH Clients as is appropriate.

DMH reserves the right to make contract changes and/or amendments during the term of the procurement as a result of new knowledge of best or promising practice.

Camp reguirements and use of camps by DMH are more fully described in Section 3 of this RFR.

1.3 Number of Awards

DMH is seeking to maximize the number of approved camps on the Master List to meet the demand for services; address the wide variety of service needs; and to provide children and families with more choices. DMH will enter into a contract with each provider of an approved camp.

DMH Area Offices will purchase camp services on an as needed basis from the approved camps on the Master List (see Subsection 3.4).

1.4 Filing Responses; Adding Camps and Contractors After Initial Approval Period

The Bid has an open enrollment process. This means that Bidders may seek to qualify a camp at any time during the period which this RFR is open (see Section 2).

It is expected that the Bid will remain open for responses for the full duration of the RFR, which is until December 31, 2024; however, DMH, at its discretion, may close and reopen the RFR at any time it deems it beneficial to the children it serves. Bidders should always check for updates on COMMBUY.

As long as the RFR is open, Bidders may submit responses. However, to ensure review and possible approval in time to be included on the Master List for the summer of 2015, responses must be submitted on or before March 31 2015, at 12 pm EST. This shall be known as the Initial Approval Period. Similarly, after the Initial Approval Period, Bidders seeking to add camps to the Master List in time for summer referrals are advised to submit their responses on or before January 31st of the year in question.

Once approved, a camp remains approved and on the Master List, unless DMH or the provider of the camp terminates the contract between the provider (contractor) and DMH or amends the contract to remove the camp from the Master List. Contractors are required to timely notify DMH of changes affecting the status of any of their camps included on the Master List, see Subsection 3.5.

1.5 Eligible Entities

The contracts resulting from this Bid will be open for use by other Agencies of the Executive Office of Health and Human Services. DMH reserves the right to add or remove additional eligible entities during the contract term. Each eligible entity is responsible for executing its own purchase orders/contracts with providers of approved camps and paying its own invoices for goods and/or services.

1.6 Acquisition Method

The acquisition method to acquire camp services from this Bid is fee for service. The number of units to be purchased is unknown. Referrals made to camps on the Master List will be done using a Purchase Order, which will specify the names of the individual(s) that will be attending, the camp they will be attending, number of days; applicable rate and units of service, etc.

Federal funds ___ WILL be used to fund part/all of Contract(s) Federal funds X_ WILL NOT be used to fund part/all of Contract(s)

1.7 Contract Duration

DMH will award contracts to providers of camps, as their camps are approved and added to the Master List. A provider will only have one contract, regardless of the number of approved camps the provider has on the Master List. The expected duration of a contract will depend on when the contract is awarded. The chart below sets forth the expected duration of contracts awarded during the Initial Approval Period. The duration of contracts awarded after the Initial Approval Period, will be aligned with the remaining duration of the contracts awarded during the Initial Approval Period, so that all contracts awarded under this RFR will be scheduled to terminate at the same time.

Expected Duration For Contracts Awarded During The Initial Approval Period

Contract Duration
Number of Options
Number of Years/Months
Instructions

Initial Duration

4 Years and 7 Months
It is expected that the Contract will be executed for this Initial Duration to run from May 1, 2015 until December 31, 2019
Renewal Options
5
Each option is for one year
There will be five options to renew for one year each. DMH reserves the right to exercise more than one renewal option at any given time.

Total Maximum Contract Duration

9 Years and 7 Months

1.8 Estimated Expenditures, Funding or Compensation for Expected Duration

Anticipated Expenditures made under contracts awarded through this RFR are subject to appropriation and funding. The total estimated expenditure to be made during a single year of this procurement is $1,000,000. For the life of this procurement, it is $10,000,000.

Payment is based on the provision of a unit of service. DMH recommends that providers develop a rate that is based on a weekly unit. However, DMH will consider an alternative pricing option based on a different unit, such as a daily rate. This requires sufficient documentation and reasoning for considering the option.

Bidders whose proposed rate is set by another agency in the Commonwealth must indicate the agency and governing regulations on the pricing statement. Prior to referring a youth to one of these camps, DMH reserves the right to seek additional information from other the other state agency regarding the camp.

To reduce the number of redundant or duplicate questions, Bidders are asked to review all questions previously submitted to determine whether the Bidder’s question has already been posted.

Bidders are responsible for entering content suitable for public viewing, since all of the questions are accessible to the public. Bidders must not include any information that could be considered personal, security sensitive, inflammatory, incorrect, collusory, or otherwise objectionable, including information about the Bidder’s company or other companies. DMH reserves the right to make amendments to the Bid after initial publication. It is each Bidder’s responsibility to check COMMBUYS for any amendments, addenda or modifications to this Bid, and any Bid Q&A records related to this Bid. DMH and the Commonwealth accept no responsibility and will provide no accommodation to Bidders who submit a response based on an out-of-date Bid or on information received from a source other than COMMBUYS.

2.4 Physical Bidders’ Conference (in person)

DMH does not anticipate offering a Bidder’s Conference.

3. SPECIFICATIONS

3.1 Meets Definition of Camp and Has A Current State License

A camp must meet the definition of a Camp set forth in Subsection 1.2 and have a current valid DPH camp license, or if the camp is located outside of Massachusetts, it must have a comparable license for the State where the camp is located. A copy of the camp’s current license must be submitted with the response and annually thereafter if the camp is approved and added to the Master List.

3.2 Fiscal Requirements

A Camp Provider must meet the financial requirements set forth in this Subsection 3.2.

a. Financial Qualification. To be approved and retained on the Master List, a camp provider must be in good financial standing, up to date on taxes, and fiscally able to provide the camp services set forth in the RFR and the response to the RFR. In addition, the camp must have proof of liability insurance.

b. Debarment. DMH cannot contract with a provider subject to a Massachusetts or federal debarment order.

c. Electronic Funds Transfer (EFT). A provider of an approved camp must participate in the Commonwealth Electronic Funds Transfer (EFT) program for receiving payments. EFT is a benefit to both contractors and the Commonwealth because it ensures fast, safe and reliable payment directly to contractors and saves both parties the cost of processing checks. Contractors are able to track and verify payments made electronically through the Comptroller’s Vendor Web system. A link to the EFT application can be found on the OSD Forms page (www.mass.gov/osd). Additional information about EFT is available on the VendorWeb site (www.mass.gov/osc). Click on MASSfinance.

The requirement to use EFT may be waived by DMH on a case-by-case basis if participation in the program would be unduly burdensome on the bidder. If a Bidder is claiming that this requirement is a hardship or unduly burdensome, the specific reason must be documented in its response.

3.3 Service Standards

A camp must meet the service standards set forth in this Subsection 3.3.

a. DPH Regulations. A camp must comply with the Minimum Standards For Recreational Camps For Children set forth in the DPH regulation 105 CMR 430.000 (see Attachment B).

b. DMH and EOHHS Regulations. Services must meet all applicable DMH and Executive Office of Health and Human Services regulations and policies. This includes, but is not limited to, DMH’s Commissioner’s Directive #23 Critical Incident Reporting Protocol and Criteria, the EOHHS Criminal Offender Record Checks regulation 101 CMR 15.00.

3.4 Referrals To Camps

DMH Area Offices will refer youth to approved camps on the Master List using a Purchase Order. The Purchase Order will include the following information: names of youth attending, name of the camp they will attend and its location, the start and end date of attendance, and the applicable rate, units of service, and the total cost per youth. A Contractor may bill DMH for services only as described in the Purchase Order and at the rates set forth in the Purchase Order.

The decision to make referrals to an approved camp on the Master List will be based on the DMH service needs and best value to DMH. The decision to make referrals will be made by DMH Site Offices. In determining the best value, the following may be considered:

· Nature of the camp program

· The needs of the child

· The availability of the camp

· The location of the camp in relation to the child

· Individual family and child choice

· Cost to DMH

· Supplier Diversity Plan

· performance

DMH Areas are the geographic subdivisions within the state that are responsible for providing access to comprehensive mental health services for individuals within their boundaries. There are five (5) DMH Areas. Each Area is administered by an Area Director who is supported by an Area Office. Areas are further divided into Sites that are managed by Site Directors at Site Offices.

3.5 Notice of Change in Status

If at any time 1) a camp’s DPH license (or similar license if not a Massachusetts camp) is expires, revoked or otherwise terminated; (2) a camp becomes subject to DPH Order to Correct violations; or (3) a camp or the camp’s provider is subject to a DCF Supported Investigation of Child Abuse and/or Neglect, the Provider must notify DMH immediately.

3.6 Communication with DMH

A Contractor must engage in communications with DMH, as requested, in the coordination of camp services for DMH youth. This can include, but is not limited to, e-mail, phone, or face-to-face meetings, as appropriate.

4 COMPENSATION STRUCTURE/PRICING

4.1 Pricing Statement

DMH will compensate providers at the rate specified in their pricing statement (see Subsection 5.2) subject to DMH approval. Costs which are not specifically identified in the Bidders’ responses, and accepted by DMH as part of a contract, will not be compensated under any contract awarded pursuant to this RFR. DMH will not be responsible for any costs or expenses incurred by Bidders responding to this RFR.

Payment is based on the provision of a unit of service. DMH recommends that providers develop a rate that is based on a weekly unit. However, DMH will consider an alternative pricing option based on a different unit, such as a daily rate. This requires sufficient documentation and reasoning for considering the option.

4.2 Pricing Limitation

Contractors agrees that no other public entity or customer within the United States purchasing similar services (subject to similar terms and conditions) shall receive a lower price for the service during the contract period, unless the same lower price is immediately effective for DMH. If DMH believes that it is not receiving this lower price as required by this language, the contractor agree upon notice to provide current or historical pricing offered or negotiated with such other customer at any time during the contract period in the absence of proprietary information being part of such contracts.

Costs which are not specifically identified in the Bidder’s response, and accepted by a department as part of a contract, will not be compensated under any contract awarded pursuant to this RFR. The Commonwealth will not be responsible for any costs or expenses incurred by Bidders responding to this RFR.

4.3 Purchase of Services

DMH makes no guarantee that any services will be purchased from a Contractor as a result of the Contractor entering into a contract as a result of this RFR. Selection of Contractors for referrals will be based on a variety of factors. See Subsection 3.4.

5 RESPONSE INSTRUCTIONS

A Bidder must submit a response for each camp it would like to have included on the Master List. If a Bidder has several camps it would like to have included on the Master List, the Bidder may submit one response that includes all of the camps, thus having to complete the Finacial Requirments, etc. only once. If a Bidder has an approved camp or camp(s) on the Master List and the Bidder wants to add an addtional camp or camps, it must file a new response for the camp(s) it wants to add. The final decisions will be based on a determination as to the best value to the Commonwealth.

The RFR review committee and the Deputy Commissioner or designee may use sources of information other than the Bidder’s written submission to evaluate proposed camps, such as other information known to DMH or another state agency.

6.2 Frequency of Reviews

The review committee and the Deputy Commissioner or designee will review responses at a minimum three times a year, in April, September and December. Reviews may be done more often at the discretion of the Deputy Commissioner or her designee.

7. TERMS AND REQUIREMENTS PERTAINING TO AWARDED CONTRACTS

7.1 Contract Contents and Subcontracting

A Contract awarded under this RFR will, at a minimum, consist of the following:

· This RFR, including all attachments;

· Bidder’s response to the RFR;

· Commonwealth Terms and Conditions;

· Standard Contract Form; and

· Other terms and conditions which both parties (Agency and Contractor) agree upon. These terms and conditions must be in writing.

Prior approval of DMH is required for any subcontracted service of the contract. Contractors are responsible for the satisfactory performance and adequate oversight of its subcontractors.

7.2 Contractor’s Contact Information

It is the Contractor’s responsibility to keep the Contractor’s Contract Manager Information current. The Contractor Contract Manager is the individual designated by the Contractor to interface with DMH. If this information changes, the Contractor must notify DMH immediately, using the address located in the Header Information of the Purchase Order or Master Blanket Purchase Order on COMMBUYS.

The Commonwealth assumes no responsibility if a Contractor’s designated email address is not current, or if technical problems, including those with the Contractor’s computer, network or internet service provider (ISP), cause e-mail communications between the Bidder and DMH to be lost or rejected by any means including email or spam filtering.

7.3 Publicity

Any Contractor awarded a contract under this Bid is prohibited from selling or distributing any information collected or derived from the Contract, including lists of participating Eligible Entities, Commonwealth employee names, telephone numbers or addresses, or any other information except as specifically authorized by DMH.

7.4 Restriction on the Use of the Commonwealth Seal

Bidders and contractors are not allowed to display the Commonwealth of Massachusetts Seal in their bid package or subsequent marketing materials if they are awarded a contract because use of the coat of arms and the Great Seal of the Commonwealth for advertising or commercial purposes is prohibited by law.
