About this file
This is a Terms and Conditions document for the Office of the Attorney General of Texas (OAG) establishing contractual requirements and vendor certifications for state procurement activities. The document outlines mandatory vendor eligibility criteria, including Texas Bidder certification, financial participation prohibitions, suspension and debarment compliance, and licensing requirements. Vendors must certify compliance with various state and federal laws, including antitrust statutes, E-Verify employment verification systems, child support obligations, and prohibitions related to human trafficking, foreign terrorist organizations, and boycotts of Israel and energy companies. The terms apply to the FY26 Concealable Body Armor solicitation issued by the OAG, which seeks qualified vendors for Police Protection body armor and carriers.
The document establishes comprehensive legal and regulatory frameworks governing vendor conduct throughout contract performance. Vendors must maintain compliance with cybersecurity training requirements, cloud computing state risk management programs, and data security controls where applicable. The OAG retains authority to terminate contracts for material breaches, false statements, or failure to update certifications within five business days of changes. Vendors assume full indemnification obligations for general liability, intellectual property infringement claims, and warranty breaches, with the State of Texas and OAG entitled to defense coordination and advance written approval of any settlements. Additionally, vendors must comply with the Texas Public Information Act by providing publicly accessible formats for contract-related materials at no additional cost, and accept authority of the State Auditor to conduct audits and investigations of contract performance and fund usage.
