1. Background

The Texas Office of the Attorney General’s (OAG) Criminal Investigation Division (CID) is a statewide law enforcement branch composed of more than 100 Peace Officers who support local and county agencies with investigative and prosecutorial assistance. CID investigators routinely work in unpredictable, high‑risk, and potentially violent environments that demand modern tools and methods to ensure both officer and public safety.

To meet these operational needs, the OAG seeks to equip its investigators with contemporary, less‑lethal tools capable of safely managing dangerous or aggressive encounters, as well as improve the efficiency of digital evidence collection and management.

Establishing a conducted energy weapon (CEW) system program is essential to providing investigators with a reliable, safe, and less‑lethal option to gain compliance during critical incidents.

2. Overview

The Office of the Attorney General is issuing this Invitation for Bid to establish a 5-year blanket contract for the Axon Taser10 Certification Pro Plan for the Criminal Investigation Division (CID). The Axon Taser 10 Certification Pro plan includes the Axon Taser 10, associated accessories, training certifications, and extended warranties to support the start-up of a comprehensive Conducted Energy Weapon (CEW) Program.

• Prices quoted in response to this IFB shall be considered firm by the OAG. Bid prices may not be altered, amended or negotiated by the vendor after the bid opening, except to correct mathematical errors in extensions. The OAG is a tax-exempt government agency.

• The Respondent’s entire response is binding for 90 days from the response deadline as indicated in section

5.5, Procurement Schedule, of this IFB.

• Award(s), if any, shall be made to the bidder providing the best value conforming to the advertised specifications, in accordance with Texas Government Code, Title 10, Subtitle D, Section 2156.007.

The issuing office believes that the requested items may be proprietary to one vendor under Section

2155.067 of the Government Code; however, the issuing office strongly encourages offers from all qualified respondents that may be able to provide the requested items.

8.2 Acceptance

All equipment ordered will be subject to acceptance inspection and performance testing upon receipt. Acceptance inspection and performance testing will not take more than five (5) working days, weather permitting. Vendor will be notified within this time frame of any units not delivered in full compliance with the purchase order specifications.

• Price and Availability

• Compliance with OAG Terms and Conditions

• Acceptance and response to IFB Specifications

• Bidder’s Qualifications, Experience, and Past Performance

10. Award

The OAG has sole discretion and the absolute right to reject any and all offers, terminate, amend, or re-issue this IFB. The OAG reserves the right to remedy technical errors in the IFB process, waive any informalities and irregularities relating to any or all offers, and qualifications submitted in response to this request, and to negotiate modifications necessary to improve the quality or cost effectiveness of services resulting from this IFB. The issuance of this IFB does not constitute a commitment by the OAG to award any contract. The OAG intends to use any material provided in response to this IFB as a means of identifying, selecting, and contracting with an entity offering the best value to the OAG.

10.1 Partial Award

The OAG reserves the right to make a partial award to a vendor, including some, but not all, of the services and deliverables.

Handheld Conducted Energy Weapon: Axon Taser 10 IFB# 302-26-03025 Page 10 of 13

Contractor will provide evidence of insurance upon request by OAG. If any policy is determined by OAG to be deficient and does not comply with the terms of this Contract, Contractor will secure such additional coverage as required by OAG, law, regulation, or customary practice. If coverage expires during the term of this Contract, Contractor must produce renewal certificates for each type of coverage.

12. Authority

Any amendment to this procurement solicitation will be posted as an addendum on the Electronic State Business Daily (ESBD). It is the responsibility of interested parties to periodically check ESBD for updates to the procurement before submitting a bid. A Bidder’s failure to periodically check ESBD will in no way release selected Bidder from “addenda or additional information” resulting in additional costs to meet the requirements of the IFB.

The complete contract governing this procurement will consist of the provisions in this IFB, including any attachments and supplements, the vendor's bid response, and the Purchase Order (PO), including any addenda issued by the OAG. The provisions of this IFB and those of the PO shall control in the case of any conflict with any of the provisions in the vendor’s bid response, except as otherwise noted on the PO. 14. Historically Underutilized Business (VetHUB)

14.1 The Office of the Attorney General of Texas (OAG) is committed to promoting equal opportunity in state contracting and encouraging participation by certified Service-Disabled Veteran- Owned Businesses registered in the State of Texas Vendor HUB Directory (VetHUB) in compliance with Tex. Gov’t Code §§ 2161.001–.253 and 34 Tex. Admin. Code §§ 20.281-20.285 (as amended by the Texas Comptroller’s final emergency rules effective December 2, 2025). 14.6 Additionally, the Contractor must update the VetHUB HSP during the course of the Contract should any changes occur.

14.7 Helpful resources regarding the VetHUB HSP include:

* The VetHUB Subcontracting Plan on the Texas Comptroller of Public Accounts website guides the Respondent through the various fields and assists them in completing the HSB correctly: https://www.comptroller.texas.gov/purchasing/vendor/hub/forms.php

* The Centralized Master Bidders List – VetHUB Directory Search allows Respondents to search for certified VetHUB vendors by NIGP class and item:

https://mycpa.cpa.state.tx.us/tpasscmblsearch/index.jsp.

* NIGP codes can be found in the NIGP Commodity Book:

https://www.comptroller.texas.gov/purchasing/nigp/

14.8 As a condition for payment and to document compliance with the VetHUB HSP, the Contractor must include the Prime Contractor Progress Assessment Report (PAR) with each invoice submitted. At the same time, the PAR must be submitted to the OAG HUB Coordinator at texashubs@oag.texas.gov (See 34 Tex. Admin. Code § 20.285(g)).
