About this file
This is an Environmental Review and Plan Set document prepared by Carroll Engineering Corporation for the Township of Lower Merion, Pennsylvania, detailing a Community Development Block Grant (CDBG)-funded ADA Curb Cuts improvement project. The project involves the construction of ADA-compliant curb ramps at 11 intersections along Levering Mill Road and connecting streets, with a total of 32 curb cut locations throughout the township. The environmental review determination categorizes the project as categorically excluded under 24 CFR 58.35(a) based on the acquisition and improvement of existing public facilities without significant change in capacity. The project is funded with $144,000 in FY 2025 CDBG funds for the current year, with a five-year total project cost of $720,000. A related procurement opportunity (Contract Number 26-20-0073-0049-0050) for 2026 ADA Curb Cut Replacement was advertised with sealed proposals due July 9, 2026, at 11:00 a.m., with specifications developed by Carroll Engineering Corporation and detailed specifications available electronically through the PennBid Program at no cost.
The environmental review process included comprehensive compliance assessments with federal statutes, executive orders, and regulations, including evaluations for airport hazards, coastal barrier resources, flood insurance, air quality, contaminated sites, endangered species, explosive hazards, farmlands protection, floodplain management, historic preservation, noise abatement, sole source aquifers, wetlands protection, and wild and scenic rivers. Field inspections were completed on October 9, 2025, by the Township of Lower Merion, and the Pennsylvania State Historic Preservation Office (PA SHPO) concurred on October 10, 2025, that the proposed undertaking would have "No Effect" on historic structures and archaeological resources. No mitigation measures were required due to the absence of anticipated impacts or adverse effects. The project procurement specifies that a Performance Bond and Labor and Materials Bond in the amount of 100% are required, a Maintenance Bond in the amount of 25% is required, and the township encourages Minority Business Enterprise (MBE) and Women Business Enterprise (WBE) participation with documentation of solicitation and commitments subject to township review.

Summary of Findings and Conclusions:
The proposed construction of ADA-compliant curb ramps will be confined to previously disturbed areas as all related work will be conducted within the existing public rights-of-way.
In a letter dated 10 OCT 2025, the PA SHPO concurred with the Township’s determination that the proposed undertaking will have “No Effect” on historic structures and have “No Effect” on archeological resources. Because no impact or adverse effects are anticipated by the proposed action, no mitigation measures are required to comply with the statutes, executive orders, and regulations listed at 24 CFR 58.5. Accordingly, this CEST project converts to Exempt per 24 CFR 58.34(a)(12).
Mitigation Measures and Conditions [40 CFR 1505.2(c)] Summarize below all mitigation measures adopted by the Responsible Entity to reduce, avoid, or eliminate adverse environmental impacts and to avoid non-compliance or non-conformance with the above-listed authorities and factors. These measures/conditions must be incorporated into project contracts, development agreements, and other relevant documents. The staff responsible for implementing and monitoring mitigation measures should be clearly identified in the mitigation plan.

Project Code: 2025-0147010 Project Name: CD-25-17 ADA Curb Cuts (multi-year)
Subject: List of threatened and endangered species that may occur in your proposed project location or may be affected by your proposed project
To Whom It May Concern:
The enclosed species list identifies threatened, endangered, proposed and candidate species, as well as proposed and final designated critical habitat, that may occur within the boundary of your proposed project and/or may be affected by your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended (16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of species, changed habitat conditions, or other factors could change this list. Please feel free to contact us if you need more current information or assistance regarding the potential impacts to federally proposed, listed, and candidate species and federally designated and proposed critical habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the Act, the accuracy of this species list should be verified after 90 days. This verification can be completed formally or informally as desired. The Service recommends that verification be completed by visiting the IPaC website at regular intervals during project planning and implementation for updates to species lists and information. An updated list may be requested through the IPaC system by completing the same process used to receive the enclosed list.
The purpose of the Act is to provide a means whereby threatened and endangered species and the ecosystems upon which they depend may be conserved. Under sections 7(a)(1) and 7(a)(2) of the Act and its implementing regulations (50 CFR 402 et seq.), Federal agencies are required to utilize their authorities to carry out programs for the conservation of threatened and endangered species and to determine whether projects may affect threatened and endangered species and/or designated critical habitat.
A Biological Assessment is required for construction projects (or other undertakings having similar physical impacts) that are major Federal actions significantly affecting the quality of the human environment as defined in the National Environmental Policy Act (42 U.S.C. 4332(2) (c)). For projects other than major construction activities, the Service suggests that a biological
Project code: 2025-0147010 09/09/2025 18:55:47 UTC evaluation similar to a Biological Assessment be prepared to determine whether the project may affect listed or proposed species and/or designated or proposed critical habitat. Recommended contents of a Biological Assessment are described at 50 CFR 402.12.
If a Federal agency determines, based on the Biological Assessment or biological evaluation, that listed species and/or designated critical habitat may be affected by the proposed project, the agency is required to consult with the Service pursuant to 50 CFR 402. In addition, the Service recommends that candidate species, proposed species and proposed critical habitat be addressed within the consultation.
