About this file

This document is a National Environmental Policy Act (NEPA) Checklist template for Local Public Agencies (LPAs) in Kentucky administering direct Federal-aid grant programs, prepared by the Federal Highway Administration (FHWA) Kentucky Division in coordination with the Planning, Environment, and System Performance Team. The checklist serves as a comprehensive guide for LPAs to determine NEPA requirements and documentation necessary for transportation projects, particularly those on the Statewide Transportation Improvement Program (STIP) or Transportation Improvement Program (TIP). The document provides a structured format for project sponsors to document project information, including federal and state project numbers, funding sources, estimated costs, purpose and need statements, project descriptions, alternatives analysis, and logical termini assessments. The checklist requires evaluation of environmental impacts across multiple resource categories including air quality, cultural resources, wetlands, waterway permits, floodplain impacts, threatened and endangered species, farmlands, Section 4(f) properties, and community impacts.

The NEPA process documentation must be completed and submitted to FHWA for approval prior to project authorization, with specific requirements for project mapping, photologs, pre-coordination letters with permitting agencies (including OEPA, Army Corps, and floodplain coordinators), and documentation of public involvement. All external resource agency coordination letters showing final concurrence from agencies such as SHPO, USFWS, OHPO, and ODNR must be obtained prior to NEPA approval. The applicant must select an appropriate Categorical Exclusion (CE) classification from 23 CFR 771.117, and certain CEs require additional scrutiny if circumstances involve right-of-way acquisition exceeding minor amounts, bridge permits, adverse effects to historic properties, traffic disruptions, access control changes, or floodplain encroachments. The document emphasizes that FHWA retains final decision-making authority on the level of NEPA documentation required and responsibility for coordination with federal resource agencies and tribal governments, while the applicant is responsible for completing all required technical studies to support the NEPA process and providing those documents to FHWA for agency coordination.

National Environmental Policy Act (NEPA) Checklist for Local Public Agencies

Kentucky Division

This document is intended to assist local public agencies (LPA) that are administering any direct Federal-aid grant program in determining requirements and documentation requirements under the National Environmental Policy Act (NEPA). FHWA’s NEPA regulations are codified in 23 CFR Part 771. Primary contact for LPAs is the Planning, Environment, and System Performance Team Leader (System Performance Team Leader) assisted by the Environmental Protection Specialist and acts as the Division LPA Program Coordinator. Throughout the development of your project, coordination with the Division Office is imperative as there are certain responsibilities for coordination that remain with FHWA and cannot be delegated to the LPA or it’s consultant (if applicable), such as coordination with the USFWS under Section 7 of the Endangered Species Act or coordination with the SHPO/THPO under Section 106 of the National Historic Preservation Act. FHWA retains responsibility for coordination with all resource and regulatory agencies and tribal governments. It is the expectation of FHWA that the applicant or grantee will be responsible for completing all required technical studies to support the NEPA process and will provide those documents to FHWA for coordination with the appropriate State or Federal agency.

FHWA has the final decision on level of NEPA documentation.
