About this file

This document is an Information Technology Terms and Conditions exhibit applicable to the County of Bucks, Pennsylvania for contracts involving data management and system services. The exhibit establishes comprehensive requirements for vendors handling county data, including provisions for data ownership, security safeguards, encryption standards, backup systems, and compliance with federal and state privacy regulations. Vendors are required to maintain SOC-2 certifications for hosted systems, implement multi-factor authentication for system access, provide Single-Sign-On capabilities through the county's Active Directory, encrypt all county data both in storage and in transit, and establish secondary backup sites to protect against data loss or system unavailability. The terms mandate that vendors report any security breaches in compliance with the Pennsylvania Breach of Personal Information Notification Act and ensure all web content and applications meet ADA accessibility standards at WCAG 2.1 Level AA specifications minimum. Additionally, vendors must comply with the Secure Networks Act by avoiding introduction of prohibited technologies onto county networks and obtain written authorization before using county logos in marketing materials.

The document imposes strict data governance requirements, including county ownership of all data created under the agreement with vendor provision of data copies at no additional cost upon termination. Vendors are prohibited from using or disclosing county data beyond the scope of the underlying Statement of Work and must maintain commercially reasonable safeguards to protect data security and confidentiality. The terms require compliance with HIPAA Privacy Rule, HITECH Act, Pennsylvania Social Security Number Privacy Act, and applicable federal regulations under 42 CFR Part 2. Vendors must establish written agreements with all agents and subcontractors to ensure compliance with Bucks County Privacy Policy and restrictions. County retains access to modify county data at any time during the contract term, and vendors must cooperate on mutually agreeable system maintenance schedules while assuming full responsibility for network connectivity maintenance and support.
