About this file

This document is a justification for other than full and open competition for a federal lease renewal. The General Services Administration seeks to renew an existing lease for 73,500 square feet of office space in Boyers, Pennsylvania on behalf of the tenant agency, which currently occupies the space under lease number GS-03B-79039 expiring on December 1, 2023. The agency requires continued occupancy at this location while undergoing a large-scale file digitization effort expected to substantially reduce its space needs but not be completed before the current lease expires. The renewal is for a five-year term at an estimated total contract value of $ with annual rental rates of $ per rentable square foot, deemed fair and reasonable compared to current market rates. Market research found no other facilities in the area meeting the square footage requirement.

U.S. General Services Administration GSA Region 3

<REDACTED>

Boyers, Pennsylvania

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

PROJECT NUMBER: 0PA2292

Agency Name: <REDACTED>

1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.

The General Services Administration currently leases 73,500 ANSI/BOMA Office Area Square Feet (ABOA SF), or 84,525 Rentable Square Feet (RSF), of office space and 83 parking spaces at 1137 Branchton Road, Boyers, Pennsylvania 16020 under lease number GS-03B-79039 for the <REDACTED>. The current lease expires December 1, 2023. Approval is requested to exercise a renewal option with the incumbent Lessor without full and open competition for continued occupancy at this leased location. The renewal option will be exercised in accordance with 41 U.S.C. 3304(a)(1) and the General Services Administration Acquisition Manual (GSAM), Renewal options, 570.401.

2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO

(INCLUDING ESTIMATED VALUE).

<REDACTED> submitted their continuing requirements on April 19, 2021, as confirmed on May 27, 2021, for 84,525 RSF of office and related space. The current lease was made effective January 1, 1988 and has been renewed five times. <REDACTED> is currently undergoing a file digitization effort and plans to substantially reduce their square footage, but this effort will not be completed before the lease expires. GSA is actively working with the agency to define their long-term requirements. In order to provide time for the digitization effort and long-term procurement, GSA proposes to exercise an existing 5-year renewal option.

The estimated cost of the 5-year renewal option is:

Years 1-5: <REDACTED>

Total Contract Value: <REDACTED>

3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION.

41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements.

4. TIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.

unique supplies or services available from only one responsible source and no other type of property or services will satisfy the needs of the agency. The agency has a mission-based reason to remain in the current location. <REDACTED> is undergoing a large-scale file digitization effort. Once finished, the footage requirement will be significantly reduced (from 73,500 to about 7,000 ABOA SF) and GSA will be able to conduct a long-term procurement. This is not expected to be completed before lease expiration.

The agency requires the ability to work un-interrupted while they finish digitizing their files and continue to serve the public.

5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS IS PRACTICABLE.

Per the requirements of GSAR 570.401, the GSA Realty Specialist placed an advertisement on SAM.gov on September 13, 2022, for 15 days. In response to the advertisement, two parties reached out to the GSA Realty Specialist, one on September 14, 2022 and the other on September 20, 2022. GSA answered questions from both parties, but neither submitted a formal expression of interest.

In addition, the GSA Realty Specialist conducted market research using CoStar and did not identify any office spaces within the delineated area that are able to offer the square footage required by the agency.

6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO

THE GOVERNMENT WILL BE FAIR AND REASONABLE.

REIS data is not available within the delineated area for this procurement. However, recent market research using CoStar showed that fully-serviced office space within the delineated area ranges between <REDACTED> with an average of <REDACTED>.

Repeated CoStar searches, the most recent taking place on February 15, 2023, revealed that there are no office spaces currently available within the delineated area that can meet the square footage requirement of the agency.

Therefore, the proposed fully-serviced rental rates for this renewal option of <REDACTED> are well below the current market range for this submarket and are deemed fair and reasonable by the GSA Lease Contracting Officer.

7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.

On December 21, 2021, and re-confirmed on February 15, 2023, the GSA Realty Specialist conducted market research using CoStar and identified no locations within the delineated area, other than the incumbent, that could square footage needs within the delineated area.

See CoStar Report for more information.

A Cost-Benefit Analysis (CBA) is not required for mission-based sole source requirements.

8. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION

The L expectation for quality performance. The GSA Property Manager confirmed that the Lessor has been responsive to building issues and that the agency is generally satisfied with the current location. The Lessor is currently replacing the paint/flooring throughout all GSA leased space. Additionally, the Lessor has consistently worked with GSA to find actionable solutions as the need arises. However, there are elements of the facility that cannot always be addressed through Lessor remediation.

See Lease Renewal Risk Assessment Memo for more information.

This renewal is part of a larger strategy to conduct a long term-procurement for <REDACTED>. The renewal is needed to provide time for<REDACTED> to complete its digitization efforts and for GSA to complete the notice to the Lessor) within the renewal term. The renewal will also provide the best value to the taxpayer given the extensive build out and replication costs that would be incurred if they were to move to an alternative location at this time.

9. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE

ACQUISITION.

No written expressions of interest were received.

10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME

ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.

There are no systemic barriers to competition. In advance of an existing considerations will be given to allow for sufficient time to conduct a full and open procurement. The Government will consider the time and cost of moving from the existing location and the time and cost to build out new space when deciding whether it is economically advantageous to stay at the existing building or to undergo a competitive action.

Additionally, consideration will be given to the customer agency mission and security requirements (if applicable) to include limiting any agency space requirements that may be deemed unduly restrictive and thus favor the incumbent. The Government will remain conscious of the effort to continuously encourage competition when practicable.

11. CONTRACTING OFFICER CERTIFICATION.

By signature on this Justification for Other than Full and Open Competition, the GSA Lease Contracting Officer certifies that the award of a renewal of 84,525 this Justification is accurate and complete to the best of the GSA and belief.
