About this file
This is a Justification and Approval (J&A) document for other than full and open competition from the FBI's Finance and Facilities Division, Procurement Section, for the acquisition of Golden Engineering portable x-ray generators at an estimated value of $60,660.00.
The J&A cites authority under 41 U.S.C. 3304(a)(1) for a brand name specification, as Golden Engineering is identified as the only manufacturer of the required portable x-ray generators that are compatible with the FBI's currently fielded systems. The procurement will be executed as a one-time buy with a firm fixed price contract through the National Acquisition Programs Unit (NAPU) on behalf of the Critical Incident Response Group (CIRG). While the RFQ will be posted on SAM.gov for authorized sellers to submit quotes, market research including government/industry consultation and open-source searches found no alternative sources that could meet the counter-IED/WMD mission requirements. The agency notes that informal quotes have been obtained and will be compared against prior purchase prices to ensure fair and reasonable pricing.

FEDERAL BUREAU OF INVESTIGATION
FINANCE and FACILITIES DIVISION | PROCUREMENT SECTION
JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND
OPEN COMPETITION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. 3304 (a) (1)
Requisition Number: SHOP-PR-25-000991
Date: 12/13/2024
Estimated Contract Dollar Value: $60,660.00
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), National Acquisition
Programs Unit (NAPU), has prepared this justification for other than full and open competition for Golden Engineering manufactured portable x-ray generators on behalf of the Critical
Incident Response Group (CIRG).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
It is the intent of NAPU to acquire a firm fixed price contract for Golden Engineering manufactured portable x-ray generators. This purchase is a one-time buy limiting competition.
3. A description of the supplies or services required to meet the agency’s needs.
The requirement is to provide Golden Engineering x-ray generators at an estimated cost of
$60,660.00. Technology is proprietary and specifically compatible with currently fielded portable x-ray systems.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only One
Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
(Brand Name Specification)
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
Golden Engineering is the only manufacturer of the portable X-ray generators. It is the only company that offers access to this equipment. Golden Engineering x-ray generators are already in use with the FBI. This purchase adds to capabilities already in place. Another brand of equipment would not be able function with the equipment already in use.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
A Request for Quotation will be open market on sam.gov to allow any authorized seller to submit a quote.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Informal quotes have been acquired and prices from prior purchases are available for comparison.
8. A description of the market research conducted and the results.
Sources used included contacting knowledgeable individuals in Government and industry regarding market capabilities to meet requirements. Special Agent Bomb
Technicians to provided subject matter expertise. Other recent market research reports for similar or identical requirements were also reviewed. Open-source searches were also conducted for portable x-ray systems which yielded no results that are compatible with the counter-IED/WMD mission.
9. Any other facts supporting the use of other than full and open competition.
None
10. A listing of any sources that expressed a written interest in the acquisition.
Since the procurement was not advertised, no other companies have expressed an interest either orally or in writing.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The Critical Incident Response Group will continue to search for new equipment to work with current equipment or other options for use.
