About this file

This document is an Equal Benefits Ordinance (EBO) Disclosure Form and Certification of Compliance required by the City of Long Beach for contractors and vendors awarded contracts with the municipality. The EBO applies to for-profit employers with City contracts of $100,000 or more for goods, services, public works or improvements, and construction projects, as well as for-profit entities generating $350,000 or more in annual gross receipts from leasing City property under written agreements exceeding 29 days in any calendar year. Contractors subject to the EBO must certify compliance before contract execution by completing the EBO Certification Form and provide the City with authorized access to records for compliance verification. The ordinance mandates that contractors provide equal benefits to employees with spouses and domestic partners, including health benefits, bereavement leave, family medical leave, member shop discounts, moving expenses, retirement benefits, and travel benefits, with cash equivalent payments permitted if employers cannot secure insurance provider participation for domestic partners.

The EBO allows contractors to delay implementation of compliance procedures under three circumstances: by the first effective date after the first open enrollment process following contract start, not exceeding two years, if evidence of reasonable compliance measures is submitted; within three months for administrative steps to incorporate nondiscrimination in benefits infrastructure; or upon expiration of current collective bargaining agreements. Failure to comply with the EBO after applicable timelines and any granted waivers results in material breach of contract, exposing contractors to contract cancellation, termination, suspension, disqualification as an irresponsible bidder for three years, assessment of liquidated damages, and other legal remedies. The form requires contractor signature and acknowledgment of understanding EBO provisions under California law penalty of perjury, along with submission of employee handbooks, eligibility statements, and insurance provider documentation.
