About this file
This is an Equal Benefits Ordinance Disclosure Form and Certification of Compliance document issued by the City of Long Beach applicable to contractors and vendors awarded city contracts. The form establishes requirements for selected contractors to comply with the City's nondiscrimination Equal Benefits Ordinance (EBO) as codified in Long Beach Municipal Code section 2.73 et seq. During contract performance, contractors must provide equal benefits to employees with spouses and employees with domestic partners, including health benefits, bereavement leave, family medical leave, membership discounts, moving expenses, retirement benefits, and travel benefits. The EBO applies to for-profit employers with city contracts for goods, services, public works, improvements, or construction projects valued at $100,000 or more, and for-profit entities generating $350,000 or more in annual gross receipts from leasing city property under written agreements exceeding 29 days in any calendar year. Contractors subject to the EBO must certify compliance before contract execution by completing the EBO Certification Form and allow authorized city representatives access to records for verification purposes.
Contractors not currently in compliance may delay implementation under specific circumstances: by the first effective date after the first open enrollment process following contract start date (not exceeding two years) if submitting evidence of reasonable compliance measures; within three months for administrative steps to incorporate nondiscrimination in benefits infrastructure; or upon expiration of current collective bargaining agreements. Failure to comply with the EBO after the allowable implementation period may result in material breach of contract, allowing the City to cancel, terminate, or suspend the agreement in whole or in part, deem the contractor an irresponsible bidder and disqualify them from contracting with the City for three years, assess liquidated damages, or pursue other available legal remedies. The certification form requires contractor information including name, Federal Tax ID, address, contact person, and responses to compliance questions regarding employee benefits for spouses and domestic partners, with detailed documentation potentially required at the time of purchase order or contract award.
