About this file
This document is an Equal Benefits Ordinance Disclosure Form and Certification of Compliance issued by the City of Long Beach. The form establishes requirements for contractors and vendors entering into contracts with the City to comply with nondiscrimination provisions regarding employee benefits, specifically requiring equal benefits for employees with spouses and employees with domestic partners. The ordinance applies to for-profit employers with City contracts valued at $100,000 or more for goods, services, public works, or improvements, as well as for-profit entities generating $350,000 or more in annual gross receipts from leasing City property pursuant to written agreements exceeding 29 days in any calendar year. Contractors subject to the Equal Benefits Ordinance must certify compliance before contract execution by completing the EBO Certification Form and must allow City representatives access to records for verification purposes.
The ordinance permits implementation delays under specific circumstances: up to two years if the contractor submits evidence of reasonable compliance efforts following the first open enrollment process after contract start; up to three months for administrative incorporation of nondiscrimination measures in benefits infrastructure; or upon expiration of the contractor's current collective bargaining agreement. Contractors unable to comply must provide cash equivalent payments equal to the amount paid for spousal benefits unavailable to domestic partners. Material breach of EBO compliance can result in contract cancellation or suspension, contractor disqualification from City contracting for three years, liquidated damages assessments, and deduction of damages from monies owed. The certification must be executed under penalty of perjury, with the signatory confirming authorization to bind the entity and agreeing to all additional EBO obligations set forth in the Long Beach Municipal Code and contract terms.
